Thank you Johno100 for you advise, I have sent a letter to GT advising them that within the next 10 days I will put my property for sale on the open market with a local estate agent and I await there reply, my letter was very brief as to find out there intensions, if not got a reply by the end of week I will send them a more detailed letter as advised in above post, I will post there reply on this thread.

Thanks for your advice, my main concern now is the selling of my property to raise my benificial intrest, unfortunally my wife only works part time and cannot get a remortgage in her name only, I have no problem selling my house on the open market to achieve the full market value whilst still living there, but I do have a problem putting it on the market with vacant possession, and paying rent to live elsewhere, I have at this moment in time NOT been offered the option to stay in my property, would it worthwhile asking if this is a viable option. If I had to leave the property I would have to take an offer well below market value for a quick sale which results in less money for the creditors.
  3. Can anyone please offer any advise. I was declared bankrupt on the 24th March 2010 with debts of £50000 all in my name and all unsecured, I have a joint mortgage with my wife for £53129 our property is worth approx £95000, I have just received a letter from Grant Thornton which states there are two final order charges on my property one for £7403 Hillden Securities and one for £1444 Northern Trust Co, leaving Joint Owners interest of £16481 of which GT also require to release my intrest in the property. How can the charging orders be placed on my property when as stated above all the debts are in my name only and unsecured, Grant Thornton also wants to place the property on the open market with vacant possession and will apply possession proceedings against the property within the next 28 days, I cannot afford to keep up the mortgage payments and to rent another property hence the Building Society will reposses the house, all my mortgage payment are upto date, I intend if possible with the help of my bank (Thinkbanking) to try to remortgage my property or as a last resort sell and rent back my property.
