Thanks, I am sort of expecting the SAR request response but since they have apparently used all of this information to come to the decision then I don't feel I should have to make one for it, it isn't unreasonable to expect them to at least let me have sight of the evidence they have claimed to use to make the decision as it will affect whether I choose to proceed with the claim. At least that is my opinion, I am sure theirs will differ. Or this is a generic response with no looking at evidence and no more than a stalling tactic.... I know which one I think it is

  3. annie, my housemate has been in a similar situation with a claims company but after several rounds of letter tennis they have now accepted (and put in writing) that the refund she received was not on an account she gave them permission to work on. All I can advise is to write back to them asking for a copy of the document you signed giving them permission to work on that specific account. check all numbers they send carefully, so far as I can see if they don't have that signed paperwork then they don't get any money. keep it all in writing too - just refuse to take the calls

After my successful claim with Tescos - http://www.consumeractiongroup.co.uk/forum/showthread.php?319622-Help-please-PPI-claim-and-tescos-***-SUCCESS-*** admittedly set against the arrears, but that is what I expected and knew would happen I then found some paperwork indicating PPI on threel Barclay loans from 2001-2003 so sent in a questionaire for each one back in mid June. today's post contained a letter upholding my claim, and included a fourth loan I knew nothing about. total refund of £4.2k and into my account since i still bank with Barclays. I was expecting around the £2k mark (very roughly caclulated using what I had to hand) so more than happy with that result. Thanks again to everyone on here who has helped me out and donation to the site on its way

I had a Tescoloan made via an internet application and was successful in claiming back the ppi so it is definitely worth it My reasons were : Pre-ticked box and when untick it was not approved & The loan was over 7 years but I believe the policy only covered me for 5 years and this was not made clear. I never had a policy doc so could only put this as I believed it to be the case not definite as I didn't actually SAR them prior to doing it. They offered me a figure within £75 of what I claimed so I must have been close
  7. That letter you posted appears to be a standard computer generated letter - my housemate recently received an identical one in response to one of her claims. In her case she had simply sent a fishing letter to them having discovered ppi, and successfully reclaimed it on another loan. Her reasons were just that she never asked for it and so if it was present it was without her knowledge. I have three claims in with barclays at the moment and am due a response imminently, so will see if I get the same reply
  8. Hassle? - a friend used one against my advice and all the so-called company did was send her a copy of the standard questionairre to fill in. She was instructed to send it back to them and they forwarded it on to the loan company. So for the cost of 2 stamps they make 30% of any refund. You still do all the work and they are no quicker than doing it yourself. If you are desperate to give away your money then I can reccomend 'Whoosh PPI reclaim ltd'

Allied Int did this to me last year, so sent it on to the original creditor as outlined above - for my purposes timescale still ran from the original request, and I would maintain that in your case while sending it to their client. Account is in dispute so remind them they should cease activity Did they send the payment back? - if not make a fuss as they may try and claim it as a payment to the debt. Make it clear that it isn't.
  10. my house mate is in a similar position with one of these companies atm - before she realised how simple it was to do herself and as part of a DMP she used this company to look at ppi on the loans within the DMP. None of these had ppi and she knows that for a fact, however in the process the original lender paid back on a settled loan they claims company were not asked to look at. She sent them a lovely letter informing them that as she had not asked them to investigate anything other than the three accounts specified on the form they sent to her she viewed their efforts on this successful one as a kind and generous act on their part but did not feel obliged to pay them since she had not instructed them to carry the workout. It's all quiet right now, but no doubt it will start again at some point
  11. umm yeah, and no doubt he filled in all the paerwork himself too. From what I can work out these cheeky gits send you a fos questionairre and get you to send it back to the oc, so for the cost of a stamp they earn 30% of the claim - nice work if you can get it...
  12. next time they call just tell them that before you can continue the conversation you need to take them through security. Ask them anything you fancy - when I was being called I liked to ask them their porn star name I have decided that these phone calls are just a free form of entertainment

I have done exactly this with a Tesco Loan, they have upheld my claim and stated that the repayment would be paid onto the outstanding balance.Mine is still owned by Tesco and that was exactly what I was hoping them to decide/do. Just waiting for them to actually do it now. I would download the FOS questionairre and if you have the payments then use the spreadsheet on here to tell them exactly how much you expect themto pay back - mine was within £75 of the amount I claimed and to be honest I couldn't see the point of arguing over that so accepted it. there are far more knowledgable people than me here who I am sure can help if you need it.
  14. thanks that's pretty much what I was thinking with the difference - it is a small part of the deal really and I didn't quite see the point of arguing but always worth seeing what those more experienced think. That also makes sense on the premiums - as might be obvious I'm not that good with this financial stuff and get easily confused
  15. Been a while and it has been pretty quiet. Got a successful response yesterday but before I sign it and send it back couple of questions: 1. the amount offered differs (in their favour) by about £75 - is it worth arguing given the total is nigh on 3k? 2. thie offer only relates to the premiums paid by me - no mention has been made of the initial premium attached to the loan and what happens with that. This is still part of the outstanding amount can I trust them to recalculate this or should I get them to confirm they are doing this. Is there any wording to be clear about this the knowledgeable people can advise? Thanks to everyone who helped me get this done, I now have 3 out with Barclays and discovered last week that at some point a credit card had ppi as well so waiting on those now.
  16. I haven't SAR'd them, they sent me a full set of statements with the copy of my agreement for me so there hasn't been any reason for me to. The 2007 default does tie in reasonably closely with the time when I began to have difficulty with this one so far as I recall, I'm just a bit surprised that they should mark it defaulted without telling me.
  17. Right, after a slight hiatus while I sorted out other details I'm back to looking at this again. I have completed the spreadsheet and the FOS questionnaire and started a letter. All of the numbers are confusing me however, obviously the original loan amount and policy premium need to be on the letter but does the amount on the spreadsheet? Or do I simply submit it all and wait for their reply?

  19. Hi, I'm back again after a bit of toing and froing with Tesco I finally unplugged my digit from my orifice and checked my credit report with Equifax. It's left me even more confused:???: Unfortunately the tesco loan is on it but shows a default of october 2007 In the meantime tesco have apologised for sending it to wetcloths but claim it is my fault for not phoning them, even though I was in written communication at the time. They have also told me it is normal for them to continue to collect while I dispute the total (ppi claim) and sent me lovely income/expenditure form to complete (which I shall not be doing though it might make a good firelighter ) such fun

Scan 1 & 2 came stapled togetheras one document.at least to my uneducated eyes That explains the second default - I didn't realise the payment agreement acted to remedy.(wish I'd know about here back then) On the secondI made the time allowed as only thirteen days once you took into account delivery time etc - I assumed a five day week and didn't count weekends? Again it is the total balance outstanding ( including the ppi I am claiming back) but the agreement was a fixed loan and I think the term has expired so does this make a difference?
  21. That was the total owing, not just arrears Same on scan 3 but I think the account was due to be ended by now so I suppose it could all be called arrears
  22. right, here goes (think i have covered everything up..) These 2 are the original 08 default - never remedied this although I did enter a payment agreement which i maintained until last year. No envelope for this one as before i realised the importance of paper trails and stuff scan0001.pdf scan0002.pdf this is the latest default - going on your timeline it still didn'tgive me sufficient time to remedy. I have the envelope and this was sent 1st class but my calcs still make it a day short. scan0003.pdf
  23. I won't be able to scan them up until Tuesday when i can get to the scanner so will do it then. I'll check the more recent one and scan that too, in case they should claim it is a correction although kt looks like a completely different default to me. No sure if have the first one's envelope but I definitely have the more recent one. Thanks
  24. Hi All (again) another letter from Tescos stating that as i have not complied with the deault notice they issued on the 5/1/12 they want the money. This is despite me being in contact, them looking into the dispute I raised and me recently writing back to them disputing the total (PPI) I'm now peeved It has however caused me to look at the previous default notice and I'm wondering if they may have made a mistake: It doesn't give 14 clear days to resolve (in fact it was sent with a letter dated the 16th Sept 2008 and required payment by the 22/9/08 It also required the account to be paid in full, from a quick scout round the site it appears it should have been only for the arrears on the account. They have indicated the whole amount is the arrears? Is this right and if so what does that mean for me? Thanks Whoosh
