  1. My defence IS weak and I won't waste your time with it, but that was not my reason for the clarity. I was only trying to point out if you are correct, and with your knowledge against mine, I'm sure you are, it is very misleading of the courts to say 5 days after. Many thanks for the help.
  2. I'm not faffin about, I trying to clarify something something that may be very important to somebody in future. The oldrouge pointed me to: Date of issue XX + 19 days ( 5 day for service + 14 days to acknowledge) = XX + 14 days to submit defence = XX (33 days in total) - ^^^^^ NOTE : WHEN CALCULATING THE TIMELINE - PLEASE REMEMBER THAT THE DATE OF THE CLAIM IS DAY 1 [example: Issue date 01.03.2014 + 19 days (5 days for service + 14 days to acknowledge) = 19.03.2014 + 14 days to submit defence = 02.04.2014] = 33 days in total Is this mentioned somewhere from the cour
  3. It will be the first time I have been to Court and I was not aware of what I had to do, although I should have been. Of course, I will treat tomorrow as the deadline, but it may to valuable for CAG members to clarify the due dates. If 1 day after today is tomorrow, 33 days after 30 July is Monday 1 September. Do you agree, if not please can you explain? As this is very misleading on behalf of the courts.
  4. Thanks Sham will steal a bit of yours. dx, I have been working until the early hours for the last two months 7 days a week and simply did not know that I had tp send the CCA and CPR letters until earlier this week. My only excuse is ignorance. I did NOT "ack the claim" as you say, I acknowledged service.
  5. The issue date is taken as 5 days after the issue date shown? Am I missing something - 1 day after today is not today!!
  6. Sorry dx isn't the defence due date on Monday 1 September? Issue date: 30/7/14 Date of service: (+ 5 days) 4/8/14 Acknowledge: (+14 days) 18/8/15 Defence: (+14 days) 1/9/15
  7. Thanks dx, I found the issue date was 30 July not 29, so have until tomorrow. The emails I have is mcol@hmcts.gsi.gov.uk and enquiries@northampton.countycourt.gsi.gov.uk. Do you have a better one? I will continue to try tomorrow, but if I cannot get in, should I send a covering email saying I was unable to log in and attach a Defence and Counterclaim(specified amount) which I can download? and as you suggest post it on the forum before sending.
  8. I have been trying to file the defence since Friday evening and it won't allow me to login saying: Your details could not be confirmed, please contact the helpdesk or try again later. It will accept the details to issue a new password, but not login. Helpdesk support is normal office hours. Tried Windows 8, 7 and XP and IE (2 versions and Fierfox). What can I do if they are having server problems? An
  9. In the end, rang the bailiff and as they had not added any further charges to their original one, I just paid the balance to them in two payments. Recorded conversation to avoid confusion.
  10. Many thanks for your advice, I should have dealt with it weeks ago.
  11. They will receive the requests tomorrow, not sure what you mean.
  12. Thanks dx100 all posted now. What is the best way to word the defence. Can you point me to an example please.
  13. Thanks, wouldn't it be better to send both forms to both solicitor and claimant?
  14. No deadline is given by the courts on their form. I thought defences needed to be filed within a certain time.
  15. Couldn't get to the post office today, but don't want to mess up on a technicality. The claimant is Arrow but payments should be sent to their solicitors, Wilkins Chapman. Who should the requests be sent be sent to?
  16. Thanks, doing the CPR 31.14 now. Can you give me a link to a CCA requesr please.
  17. Name of the Claimant ? Arrow Global Guernsey Ltd Date of issue – 29th July 2014 What is the claim for – the reason they have issued the claim? The claimants claim for £10,xxx being monies due from the defendant to the claimant in respect of a regulated credit card agreement between the defendant and Virgin (card no) and being assigned to the claimant on 11/11/11 notice of which has been provided to the defendant. The defendant has failed to make payment in accordance with the agreement and a default notice has been served pursuant to the CCA 1974.
  18. Just a point, but if I was Arrow, I would follow this forum. Doesn't completing the form on here make me highly identifiable and give them info I would prefer they did not have?
  19. Thanks dx100, will do. Defence deadline is next Monday, will sort out tonight.
  20. Just did the acknowledgement of service online.
  21. Hi, I had a Virgin credit card with a credit limit of £8,500 and could not afford to repay it. No payments or transactions in four years and the debt has been now been purchased by Arrow Global. With charges it's around £10k now and they have issued a summons and I have filed online a defence for the full amount. What is the best course of action from here. I have priority debts which I am having to deal with and they will have purchased this for a fraction of the actual debt and piled on the solicitors costs. Thanks for any advice.
