  1. I have a judgement against a debtor who owes me £35,000. I hope to place charges then force a sale of property he owns to get my money back. I know he owns quite a few properties he rents out. Is it possible to find out the addresses of his properties via the Land Registry? Thanks.
  2. Thanks again. One more thing, on the CHARGES REGISTER, there is the following: 3 (03.02.2010) Proprietor: SANTANDER UK PLC (Co. Regn. No. 2294747) of Deeds Services, 101 Midsummer Boulevard, Milton Keynes MK9 1AA. Does this mean there was a charge on the property on that date as well?
  3. Thank you. Yes, I have details about the mortgage. I am just wondering why, on the RESTRICTION , dated 14.12.2010, why only one person is mentioned in that paragraph, (the wife) even though I know this is a joint mortgage.
  4. I have just completed a Land Registry search to find out if someone who owes me a lot of money has recently re-mortgaged his house. The property was purchased in 2006, but can someone please explain what the following means and am I correct in assuming they have remortgaged in 2008 and 2010?: (16.07.2008) RESTRICTION: No disposition of the registered estate by the proprietor of the registered estate is to be registered without a written consent signed by the proprietor for the time being of the Charge dated xx xxxx 2008 in favour of Santander UK PLC referred to in the Charges Register. 5 (14.12.2010) RESTRICTION: No disposition of the registered estate, other than a disposition by the proprietor of any registered charge registered before the entry of this restriction, is to be registered without a certificate signed by the applicant for registration or their conveyancer that written notice of the disposition was given to Northern Rock (Asset Management) PLC (Co Reg No: xxxxxx) at care of XXXXX Solicitors, XXXXXXXXXXXXXXXX Newcastle upon Tyne XXXXX (Reference: XXXXXXXXXXXXXX), being the person with the benefit of an Interim charging order on the beneficial interest of XXXXXXXXXX (nee XXXXXXXXX) made by the Gateshead County Court on XXXXXXXX 2010 (Court reference XXXXXXX).   5. Hi Shadow, I am not sure what you mean by "embarrased". I have simply told them the facts. Unemployed for 4 and half years, no savings, no saleable assets, unable to find suitable employment due to health reasons. I have told this to MBNA and Link Financial repeatedly, but they are still taking me to court.
  6. Last week I received an "Allocation Questionaire" which I filled in and returned. Today I received a copy of Link Financials Allocation Questionaire which says that they "would request that the Defence be struck out and Judgement entered for those sums claimed". What does this mean? And, after repeatedly explaining to MBNA and Link Financial that I have been unemployed now for four and half years with my only income being housing benefit, I am surprised that they are taking this to court. They are hoping to get £2260 from me, What do they expect to achieve when I have no money?
  7. Today I received a "Notice of Transfer of Proceedings" moving this to my local court. Also enclosed was a "Small Claims Mediation Service" form which claims to be a free service. But on the form it asks if I have attached a fee. I am a bit puzzled by this as it states: "An allocation fee is payable if your claim or counterclaim exceeds £1,500" I am not making a claim or counterclaim.

  11. I honestly cannot remember if I applied online. If I had applied online, surely I would have been sent forms to sign?
