  1. He was sacked for internet usage, basically he's a maintenance engineer doing night shifts and whilst quiet he's been surfing. He acknowledges this and says that's fair enough but a fellow worker who was up for the same thing has been let off due to a clerical error. All the evidence was put in a pack for him to receive a couple of weeks ago and a disciplinary hearing scheduled soon after. Another guy was targeted and attended his disciplinary hearing, where he was accused of gross misconduct, the union guy pointed out that the letter he got to summons him to the hearing only mentioned disciplinary. His hearing went ahead and he got a 6 month written warning, as my mate was off work the day of the hearing they recalled his pack, re-wrote it and included the words gross misconduct in the amended letter. Consequently he was sacked whereas the other guy who had a similar raft of IT evidence against him got away with the warning.
  2. A mate of mine is needing to issue a Subject Access Request to his company for a hearing he has next week, are there any templates available that he could use? Thanks in advance.
  3. Looked into it, they haven't added interest to the charges as the finance charge was front loaded as part of the initial balance.
  4. How does this reply look? With regards to the interest in restitution, is that the same as contractual interest and when would I claim this if I did, at court or in this letter?
  5. Thanks for that, I'll write up a letter tomorrow. I may add something about the fact that the direct debit and cheque charges are as unjust as the arrears charges and will expect them to be included.
  6. Just figured out where they get the £450 from, that is the Arrears Charges, they seem to have ignored other charges such as Unpaid Direct Debit Payment Charge and Unpaid Cheque Charge. Are they completely stupid? That was of course a rhetorical question.
  7. Just had this response in the post today to my Preliminary letter, they are offering half of the charges they believe they've applied to my account, I calculated them as £570. So then as I'm not accepting half of what they think owe me what do I send them now, can't really send LBA as they've responded in time and what about their assumption I've had less charges applied than I've calculated?
  8. I guess it'll be in their interest to settle early, they'll save a bit of cash that way.
  9. Blimey that does make a hell of a difference doesn't it. To be fair though I probably won't go for the Contractual Interest, I know I should but I've pretty much paid for the credit I initially took out and if they refund the charges they've made I'll be happy. With regards to the preliminary letter, I've amended the Bank Charges template slightly. Does that look okay to you?
  10. With interest it will be £619.20. Will send the preliminary letter listing the £570 charges today.
  11. Actually ignore that last bit about amending I've not factored in the 8% interest, so in effect they'll owe me more than the debt owed.
  12. Seems I've been lucky, just received the full statement of my account and out of a balance of £579.36 I have charges totalling £570. Going to send them the Preliminary letter out today, would it be worth me amending the letter slightly to suggest I pay them £9.36 as a full and final offer on the account due to the bulk of the balance being made up of charges?
  13. Cheers William, I don't worry about these people now their sabre rattling and threats no longer register as I'm now dictating the way things work. Have received no letter in today's post after my Prelim letter sent on 30th July, guess I'll pop the LBA in the post today. Will they never learn.
  14. Great, our other account(budget) incurred charges from last month and I've just noticed they've applied £100 worth of charges to the account on Friday. Just called to ask if the charges can be returned as the money that was in there was to pay this months mortgage. I was told by the chap on the phone that nobody is able to refund it as the computer has added the charge. Is he telling me that their entire bank is beyond human intervention? So any ideas on how to get the money credited back or am I going to have to rob Peter to pay Paul(C&G)? And yes they will be getting a SAR in the next few days.

  18. I've noticed in the DN that the parts BEFORE THE DATE SHOWN are not in bold font when compared to the font around it, I was under the impression that this needed to be prominent in Bold lettering.
