  4. We had a buyer, and they knew this, but they still wanted to go down the repossession route. There were several suspended court orders, then finally we got the eviction letter, due for the following Monday. Unfortunately last year, we did not know about these websites on helping people with either difficulties in paying their mortgages or trying to get back their unlawful fees/ charges. We are now in private rented accommodation. My husband is self employed, but I am currently out of work. It has been absolute hell. Personally it has affected me. I don't really have much confidence in myself, and find life at the moment just living day to day, but still wondering what the final outcome will be. At the moment we are going through a claims company, as we would not be able to do this on our own. There will be litigation on our property, as well as a large second charge loan and PPI that we took out in 2006. I do wish you lots of luck.
  5. Hi confusedbunny, Yeah, unfortunately, it would be classed as repossessed property. It happened to us, I had the property for 30 years. Last year due to unforseen circumstances we were unable to keep up with the payment, subsequently we were repossessed, and the corrupt sub prime lenders, made it a shortfall. The property was leasehold. The first month they 'found a buyer' not found ligitimately, by the sub prime lenders. It was also for about £100.000 less than the going price Then 2 months later, it was sold at the normal price.   6. Hi 42man Yes, thanks for that, absolutely disgusting. That's putting it mildly. Seems Southern Pacific have the highest fees, and still slip through the FSA net. Getting away with their appalling handling charges/fees; etc;etc. The question is WHY are they getting away with it ?

  8. Hi Was interested in your response. I had written to my MP via his researcher on numerous occasions, regarding the appalling dealings with Capstone/Acenden. I had told my MP. what had happened to us from the onset of obtaining a secured loan of £1000.000 plus PPI on our property, to unfortunately the eventual repossession. Nothing concrete came back regarding what actual fundemental steps to do next. Basically he only mentioned contacting the FSA (which I had already done via a complaint, regarding the failings of the FSA and their MCOB rules not being implemented, and also the Ombudsman which I had done already). I do have the final letter from my MP, so would very much like to get in contact with Stella Creasey. By the way, our case was highlighted in the Financial Mail on Sunday's edition in September 2011.
  9. I am composing long letter to FOS, obviously along with the charges. I was not on the deeds of the property, it was in my wife's name. She is currently unemployed. I would like to know, is it possible for her to get Legal Aid ?
  10. Crapstone thank you for the info. Will take it on board. Have been reading through the SAR just now, and they were still making charges from the date we were evicted July 2010, right up until the last part of the SAR October 2010. I would welcome your comments.

Hello everyone, Bearing in mind that the fos appears to be unwilling to deal with Capstone/Ascenden and their affiliates, it really does beg the question of how and why they are getting away with this. The lack of action would invariably lead to questions of corruption on the part of the fos, and dare I say the possibility of backhanders being given to members of this quango like organization cannot be ruled out. ALLEGEDLY, of course. Some may not like to here this, but one thing I do know about human nature is that greed often overcomes moral scruples, when there is an easy buck to be made, and remember of course Ascenden are derives from the Lehman brothers group and we know what happened to them I look forward to replies.   13. Just to let you know that I emailed my local MP, and received a reply yesterday. He thanked me and said he would bring the case up as soon as he could in Parliament. Also, have emailed the Guardian, no reply as yet.

  18. For Roxy2010 We were repossessed last July, exactly same re their charges. We only wished we had known about the N244 before. I wished the courts when we attended, had given us some guidelines. We saw 3 different judges, each one different. The solicitor from Glenisters was an extremely nasty piece of work. Anyway, Glenisters now have had their day. Ceased trading.
  19. Hi all Can anyone tell me why Glenisters have ceased trading. I would love to know, as I am pretty sure this whole pack of cards will come tumbling down this year. It is only a matter of time. I know Richard Dyson of the Mail on Sunday is on Ascenden's case.
  20. I have just received the SAR, and guess what not all the documentation was sent. They actually stated there were a list of 10 forms, which they had omitted to send. I am certain that list would of been most crucial in court. Also, there was NO ACCOUNT statements, i.e.no statement of charges, payments. Even when we were paying them monthly, the payments were still going up horrendously. Included in the documentation were a lot of blacked out words, and I mean a lot. They also hid my name. (The property was in my wife's name, but I had signed the loan agreement). I remember at the court hearing that was the first question the judge threw at the solicitor, why my name was on it. He never answered. I will give the list of omissions, if required. Look forward to hearing some comments. Stephen.
  21. Hi everyone, It is now 42 days since Ascenden received the SAR, and they have not replied. Am I surprised . What is my next step please. By the way 2 of the Glenister scumbags are now based in Bristol. Does anyone know why Glenister's ceased trading. Many thanks Stephen
