  1. So it could be a 'bug' in the system then? Could someone have got into my account & looked at them? I was purposefully leaving them unread for now as I know they are probably going to be questions which will take some time for me to reply to, so left them unread as a reminder IYKWIM? Thanks for the reply anyway - at least I know now it's happened before.
  2. That should be 'would have' not 'would of' I just couldn't resist that correction ... that's just one that happens to annoy me slightly ... no offence intended! ps - I'm sure I can be 'picked up on plenty myself before anyone starts quoting my grammatical errors!!
  3. Sorry to 'butt in' but this seems to be the perfect place for me to ask this Q atm (On-topic like!) Over the last few days I haven't spent much time online so have seen but not viewed some of my subscribed threads which were highlighted as having new posts ... Again this evening they were still there ..... I've just gone back to the list in my User CP & some of them have now dissappeared?? (from the unread list) The actual threads still exist in my subscribed threads but if I go into one there are NO un-read posts but there ARE posts which I haven't yet read as I haven't even visited those threads yet since the new posts were added :-? I'm presuming that they don't just 'drop off' the new posts bit if you don't read them after a certain length of time .... Can admin/mods shed any light on this as it has puzzled me .. I honestly haven't viewed them by mistake BTW I assure you! :?

  7. I agree too FWIW! That's exactly what I did & then I even went on to not showing it on the schedule at all & just mentioning it in my next letter ... ie 'as you have already refunded £XX then the balance outstanding is now £XXX'

    YUP! you certainly can - go for it ... I'm in the same situation & am claiming back from almost everyone I owe to .... I would advise only doing them a few at a time tho as it's more time consuming than you think. As another poster said tho - if you owe them money then they will probably (most probably!) use any repayment to reduce your balance with them - You can go online to CCCS website & reduce the balance if/when this happens. (Although tbh this doesn't bother me as my main priority is to reduce my debts) Remember tho that any costs you pay out that are re-claimable (ie court fees) then you are actually entitled for the refund of these to be sent to you & NOT paid off your balance. I actually told my CCCS advisor I was going to be claiming back charges when I started on my plan & he wished me luck! Said he would be interested to hear how I got on! Hopw this helps & good luck & get claiming!

If that is the current rate for your account then yes that's the one to use - Basically if your bank disagree with the amount you are claiming it is up to them to prove you wrong or otherwise - You only have to prove that as a lay person you have done your best with the resources you have to calculate the amount of your claim Is this any clearer for you now?

Studio Cards & Gifts Customer Services Department Preston PR20 2BP 16th October 2006 Request for repayment of charges Dear Sir/Madam ACCOUNT NUMBER: xxxxxxxx My request I am writing to ask you to refund to me the charges which you have levied from my account over the period 29.01.04 to 06.03.06. I now understand that the regime of fees which you have been applying to my account in relation to Administration Charges are unlawful at Common Law, Statute and recent consumer regulations. If you say that they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your penalties really do reflect your costs. Additionally, it has now been confirmed that your particularly high level of penalties are considered to be unfair per se by the OFT who reported on the 5th April 2006 and are therefore presumed to be unlawful in the absence of specific proof to the contrary. This report was NOT limited to banking and credit card institutions. Your responsibilities I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them. Your concealment of the true nature of your charges has prevented me from asserting my right until now. What I require I calculate that you have taken £xx.xx. I enclose a schedule of the charges which I am claiming with this letter My targets to resolve this matter I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets. I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment. If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments. After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline. Yours faithfully chezt I did revise it a week or so later & add contractual interest as they didn't respond to my initial prelim (I will post that if you want it too) - When they paid out they paid the charges + the interest I'd paid on them + 8% stat interest - I decided not to persue the rest of the contractual interest as I felt it was not wise to do so & I was more than happy with my refund Hope this helps?
