  3. I want to reclaim the missed direct debit charges on my GE Motor loan (now Santander) but I'm not sure which template letter to use. I have already got the statement with the list of charges so I'm ready to go if someone can point me towards the correct letter to use. Thanks
  4. As far as I can see allowing for time for the letter to be deemed served, they only have till tomorrow to get the judgment set-aside. I just thought it may be quicker if i contacted them to see if they wanted to pay their debt without me resorting to the bailiffs
  5. Received Judgment on a letter dated 31st May saying that Citi's defence had been struck out as they had failed to supply their documentation. The order is dated 16th May. Should I phone Citi and ask them When they will be paying? or do i just go and get a Warrant and send in the Bailiffs? Does anyone have the phone number I should use to speak to Citi about their outstanding debt ?

  9. So I mention in my letter accompanying the AQ that I have had a partial refund. Should I also write to Citi to say I accept their payment as a partial settlement but that court proceedings will continue until I receive full payment...and re-enclose a schedule of charges?
  10. OK I received the Allocation Questionairre today. Does anyone have any tips on filling them in or is it straight forward. Also do I need to do anything about the points I made earlier in this thread?
  11. I lodged my claim through moneyclaim and have today received a cheque for the difference between £12 & £25 and a copy of their defence. In their defence they state that "the particulars of claim neither particularise the dates upon which the amounts claimed arose nor the nature of the charges made, and puts the claimant to strict proof of these" the next statement then reads..... "The defendant admits that, between November 2002 and July 2006, £xxx was debited to the claimant's account." This was by way of late payment fees and overlimit fees....." so in one one
  12. Is it true that if you do not have any contact with an organisation or acknowledge the debt with an organisation for 6 years then it is unenforceable?
  13. It was more about sticking to when I had the £50 court fee spare!!! I haven't even responded to their derisory offer.
  14. Just an update on my case. I had all my statements so I could calculate my charges myself. Sent LBA in Early March for the return of £500. Received the standard complaint reply. After 4 weeks received a letter stating they would respond within 4 weeks. Finally had enough of waiting and served papers on them via Moneyclaim on the 8th May for £500 plus interest and costs. 10th May had letter from Halifax admitting no wrongdoing but offering £180 which I have ignored. 12th May Halifax acknowledged the claim with the intention to defend in full.
