Here is Barclays 13 point defense, hopefully we shall meet in court soon. 1/ the defendant is entitled to charge the claimant for unauthorised borrowings by reason of its standard terms and conditions. The charges constitute payments the claimant agreed to make by reason of the terms and conditions of her account and were consideration for the defendant advancing credit to them claimant, which the defendant was under no obligation to advance.   3. Hi all Abbey after trying the microfiche route then no manual intervention route have failed to supply all the infomation requested under the data protection act. They only sent 18 months of statements!!! Their last letter asked me to explain why i was unhappy with their service!!!!! Now its off to court to force the issue of getting the data requested! Any tips or advice is greatly welcomed Andy
  4. Hi all After getting a settlement in full from the RBS without entering court papers i feel a little chuffed however i need the address for the court papers to the woolwich. I am sueing for £3800 of charges they wont give me a decent settlement ie full refund. I know to put on the papers Barclays bank PLC trading as the woolwich but which address? my branch? or another address? I have several letters of correspondance all with different addresses!   5. Hi All After long debates with the RBS i claimed a total of £1810.00 from them. I got an offer letter two weeks ago for £510 which ofcourse i refused then went on holiday for two weeks, before i went and when i refused i said to them in writing i would now let a judge in court decide. I WOM YIPEE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! On my return from holiday i had recieved a letter from head office stating that as a gesture of goodwill they agree to refund all £1810.00! Im just waiting the 5 days for this to arrive into my account! When its in i will gladly donate 5% to this site for all
  6. Hi all Well at the stage now of sueing the woolwich! They offered me a settlement of £2k on £3800! So question is as all correspondance and offers have come from barclays who do i sue? My branch of the woolwich or is it barclays? Cheers Andy
  7. Hi All Stage 1 Data letter sent took them 36 days to send info Stage 2 Both claim letters for £3800 sent Reply from bank is "as a sign of good faith on behalf of the bank we will refund £1000! Guiess what i said no Got phone call yesterday upping this offer to £1700 for full and final settlement! Sending them letter to say no today! Will keep you posted, now where are the county court forms and a letter sample to report them for non complience to OFT? Andy
  8. Hi all Sent data protection letter to the woolwich on the 3/7/06. Got a reply back on the 10/7/06 saying they were concerned art my request and would look into it with a response by the 4/8/2006. They also said on this instance they would supply statements free and refunded my £10 payment. Will keep you all infiormed of new correspondances. As a futher notee have had no reply so far from the Royal Bank of Scotland to date!! it was sent same day as the above Andy
  9. Hello all Thank you for allowing me into thisd community and i have already started action with two banks to recouperate bank charges. I hope to make a donation to this invaluble site when i recouperate themm but in the mean time i will keep you all updated.
