We put a deposit of £1,000 on a motorhome with a dealer and one week before we were due to collect it we carried out a credit check, this was returned as showing outstanding debt on the vehicle. The dealer hadn't told us this so when we found out we cancelled the order as we might have bought it and then had it reposessed for the debt, he has now written to us claiming we owe him £9,000 leaving us £10,000 out of pocket. His terms and conditions say he can do is but surely they had a duty to tell us at the time that we paid a deposit he didn't own the vehicle. Should we put a claim for our deposit back ?
