  1. So so so so so many grounds to dispute it on. What evening was it? I would request evidence first - just make sure they have it right in the first place!
  2. Even more people will be oveer with RBK when they put evening parking spaces are up to £2 after 6.30pm! Hopefully RBK will be over this bus lane by time they have been to PATAS twice in a week!

  4. It said 'BUS LANE' at the time of your alleged contravention - but the TURN RIGHT and arrow was NO LEFT TURN AHEAD!
  5. is it not the presence of the 'only' sign that stops it being applicable? Since this make is a bus only route rather than a lane so the road markings should be buses only rather than bus lane? Not 100% just trying to get the arguments together to throw at RBK? I am learning more and more that even if you are governed by legislation and you are employed in a department which relies on it this does not mean that you know how to interpret it!

As I read the regs - 953 is for a bus only lane (which i guess by loose definition a bus lane could be) but the 1048 version which should be used should state ONLY (1048.3/1048.4) - however on the approach from the opposite end the 960 sign is specifically for a contraflow bus lane - and then 1048 or 1048.1 should have been used - so the upright signage conflicts with itself under the legislation - regardless of what the DfT have approved!
  7. And by time its reset and the process is as far as photo requesting we should hopefully have some firm accepted grounds for rejection!
  8. A bailiff isnt always what you see on the BBC1 show and I'm pretty sure they will give you time to pay it. As Hymn and Mi says I also assume that you want it reset so you can appeal it properly?
  9. Not until the warrant of execution is served and that may well give you time to pay the debt before the bailiffs are sent out.

  11. I think its £5 max or it may even be free since its a public service. I know when solicitors witness docs its £5 so shouldnt be much more than that - it just makes it formal.

  13. What have they asked you to fill in? Is it a set aside default judgment form??
  14. You need to issue a statutory declaration to the traffic enforcement centre - as detailed on the traffic adjudicators website. The traffic adjudicators website is official and deals specifically with the rules relating to it.
  15. I interpret this completely differently - I interpret that a bus lane is one that is reserved for the use of buses and other permitted vehicles. This section of legislation is in fact only defining what a bus lane is at subsection 2 within the signs detailed in subsection 1. I think the important point is that the sign used is not consistent with the 953 upright - as I think the legislation says 1048 is not applicable with this sign but it is however applicable with the 960 used on the approach in the other direction.
  16. This is the enforcement notice I have received - I think there is a wording issue in relation to the increase in the charge to £180 - they say it WILL happen but LLA says it should state this may happen - any comments?
  17. The 14 days is extended from the date of the photograph they send. My only concern about waiting to request the photographic evidence is that it could put J.W on a back footing in that they might consider that it has been dragged out - as we know - they assume that people only contest the penalty to buy themselves times anyway!

  19. Lack of signage and incorrect signage are main points raised! I think they usually reject in an attempt to get people to pay as the wording of the letters of rejection are quite forceful in reminding you that you the fine may go up to £120.
  20. when the matter gets put on hold they 'freeze' the £60 and you have a further 14 days to pay from the date of any response they give you (these responses will usually take about 3 months to appear) so you have a much prolonged period over which the £60 is frozen - only if you let the 14 days after their response expire with no correspondence with them and no payment does the £120 become payable. The councils reason for the right turn arrow and wording was that there were many accidents and people hitting street furniture so not as a warning that there is a bus lane ahead and - the fact that cannot be ignored is that most evenings you cannot turn right there!
  21. The sign that is within the bus lane is not sufficient to be advance warning - there should be some on the approcach. All my friends of the area also had no idea and on approaching it by foot on Tuesday night a friend I was with was looking out for it and he still could not see it until we were right on it! This is why the lane penalties need to be fought tooth and nail as otherwise the Council will keep subsidising their budget with money from an honest mistake!
  22. As RBK are treating that section of road as a bus lane, you just need to argue that you were not aware that is a bus lane and that it is not treated as a bus lane as they direct. For example - on the website the bus lane is operational 'at all times' but the road in which motorists should turn right, St James Road, is often blocked off and RBK have admitted that at these times it is permissible to use the 'bus lane'. Therefore if you regularly drive in Kingston of an evening (as I do) you would often use this stretch of road and face no penalty. - A bus lane should have advance warning - approaching the 'bus lane' from High Street there is nothing to advise that you are approaching the bus lane. - There is a technical argument about the road marking - this is well explained on the ticket fighter website. As you state that you were not aware that there is a bus lane in that position and you know the area well you should fight this penalty charge - I dread to think how many people are being slapped with these fines and aren't even aware that there is a bus lane there - these fines are unjust as people are unaware that there is the chance that they are contravening anything!
