  1. I've just received the exact same email. I've had porevious loans with quickquid but always paid them in full on time. The last one I had was at least 2 years ago. Not sure if I should contact them or not at this point?

The change of circumstances form did detail both the lump sum and monthly payments however I can't find a new award notice from around that time to confirm this eventhough her payments reduced after this. I'm not sure if copies were taken of her bank statements and what they showed - sorry. I did ask my mum but she is in such a state that she can't really remember what happened and when. She's convinced that she is going to prison, can someone please tell me if this is likely? Thanks
  3. I've just looked what 'deprivation of capital' is and yes you're right it could very well be seen as that. However I did tell them in the change of circumstances form that my mum had received this money so we were upfront about it. The thing is, our family have never EVER claimed any benefits so this is all new to us and unfortunately it looks like we have made some mistakes, albeit innocent ones. I'm just so worried for my mum.
  4. Thanks for your response. The people that she owed money to were me and my brother, not companies. I've had a look through her bank statements and they clearly show that cheques were issued to us shortly after she received the money. Do you think this will this be a problem?
  5. Hi, I know that there are a lot of posts about this but I've been reading them all weekend and can't find one similar to my mum's situation. I understand what happens and the reasons these interviews take place but would like some advice on how we should go ahead. Basically my mum collects her state pension and claims housing benefit and council tax benefit. She has never claimed any benefits before as she has worked her whole life. When she retired she had been suffering from depression/anxiety so our family friend was dealing with her redundancy options and secured her a payout of £20,000 and monthly payments of £250. The £20,000 was paid out to people she owed money to within one week of it being paid into her account. When she made her housing beneft/council tax claim this redundancy money/pension hadn't been sorted yet, as soon as it was I sent a change of circumstnces form with a covering letter off the the council. The next month her payments were reduced so we assumed that this was why although there is no confirmation of this in her paperwork (she has copies of everything) My mum then had 2 separate visits from the council about pension credits to check her bank statements and to discuss her pension and oher finances. This was 18 months ago, then on Friday she received an Interview Under Caution letter. I have spent all weekend going through her paperwork wth a fine tooth comb and the notes from the second visit say that she told them that she doesn't have a private pension which of course she does. I think that this is where the problem lies. My mum is now having panic attacks, can't sleep and is convinced that she is going to prison. It's awful. I am going to the interview with her but I'm not sure how involved I am allowed to be and I am also going to arrange for a solicitor to come with us. Because of my mums health I am also dealing with numerous creditors on her behalf. My mum has never been in trouble before and at the time of all this she was on a lot of medication and was off work for months with depression and anxiety, we have all the copies of sick notes for this. She said that during the home visits they asked her lots of questions and she found it all very confusing so that is when she thinks that she told them the wrong information. She said that they kept going on about different types of pensions, credits and benefits and she has obviously said the wrong thing. I'm not even sure she will cope with the interview on Friday let alone waiting to see if they prosecute. She says that she can't cope with the shame of it all. She has never claimed anything in her whole life. I have told her that I will pay the money back for her so not to worry about that but it is the fact that she may be prsoecuted for this that is scaring her to death. Does anyone have any advice or ideas what might happen? Sorry it's so long. Thanks in advance
  6. Hello everyone,I had a credit card debt with MBNA, couldn't pay so I received a letter from them saying that have passed it onto Fredricksons to collect. I have just received a request for immediate payment (£3500ish) from Fredricksons but I'm unsure how to proceed.I'm thinking that some of that is charges, late payment fees so I should send SAR?Any advice would be greatly appreciated, I've been reading about them and their tactics so I'd like to get it right first time!Thanks

Hi, I was in dispute with an old insurance company that I used a couple of years ago, they claimed that I owed money to them for not cancelling an agreement in time when actually I put it in writing and cancelled my direct debit, they just said that they didn't get any cancellation notice so I owed them the insurance premiums for that year. I argued with them on the phone that I didn't owe them the money then heard no more about it until..... About a month ago I got a letter from Daniels Silverman saying that I had to pay just over £200 plus over £100 of fees to them within 7 days. They must have bought the debt. I sent off the 'I dont owe the money, don't chase me because you are third party and the account is in dispute' letter and today I received an 'appointment notice' saying a local investigation agent will visit my property to 'discuss the pending legal case against you by our above named client.' I'd like to point out that they are based in Liverpool and we live a good few hundred miles away! So what should I do now? I'm thinking a trespass/harassment letter? Any advice or templates would be ace Thanks so much xxx

Hi, Just a bit of an update....I wrote a letter to the judge and enclosed my budget sheet with it prior to my court date which the judge did read before the hearing and I really think that this helped as I didn't have to say much. The outcome was that the judge upheld my monthly payment but also gave MBNA permission to apply for a charging order. I explained to the judge that I was 3 months behind in my mortgage payments,and had a letter to prove it, but it didnt make any difference. I also told him that it would be reposessed in the near future and that I am going to rent so I wont be a homeowner much longer. Again that didn't change anything. MBNA didnt even turn up which I was relieved about. Let them have the charging order, I wont own the house in a few months time anyway. The main issue for me was keeping my monthly payment and it not increasing which happened. Anyway Im really really pleased with the outcome so thankyou to everyone that took the time to reply to my post, it really is very much appreciated.
  11. Hi, I've written a covering letter to go with my personal budget sheet and want it attached to my case notes but who do I address it to? I have no idea who the judge is so do I just send it addressed to the court manager? Im a bit confused about this and have googled it but got different answers! It is a redetermination hearing at Nottingham County Court. Thanks in advance
  12. Hello everyone and thanks so much again for your input, it really is appreciated! Of course I know that you are all right and I must attend I'm just nervous because I've never done this before, I suppose that is what MBNA/OPTIMA is hoping! I just wanted to get it all straight in my head, the last thing in the world I want is to get a judgement against me for the full amount, I can't pay so the bailiffs come round especially with my mum at home looking after my baby every day. The thought of them turning up is much more terrifying than going to court! I just need to take a deep breath, get organised and get on with it! Can I take someone with me into the room? Also should I send a letter/my budget etc to the judge before hand? I'm not bothered about a CO, my house is in 20 grand negative equity and is due to be repossessed in the next couple of months anyway. They wont get any money from that. Should I tell the judge at the hearing this is the case? Also what happens if they get the CO, house is reposessed, they dont get their money, then what? Do I just keep paying my agreed monthly instalment? Will they come after me again? I will have no extra money and be in rented accommodation Thanks again, you're all fantastic! Thanks again
  13. Thanks everyone for taking the time to reply, it really is very much appreciated. I am a teacher so time off in term time is a no-no and I only have half hour lunch. I dont really want work to know what is going on. Does anyone have any advice about sending a letter prior to the court hearing to the judge? I just wanted to outline my case and give them all the facts before my hearing, I want the judge to see that I have tried to negotiate with MBNA/OPTIMA on numerous occasions but they were having none of it! Also what happens if I send a letter instead of turning up to the hearing? Will I get arrested or will they send the bailiffs in or anything else as equally nasty? Im not saying I wont turn up to the hearing I'm just asking so that I can try and get it all straight in my head! Thanks again, you're all very reassuring!
  14. Hi, I've been looking around the site all week and have found some great info but none that directly applies to me and my situation so some advice would be great. Here is some background.... I was with Harrington Brookes but terminated them because of the huge chunks they were taking in 'management fees' and their failure to make regular payments on my behalf. I am now dealing with everything myslef and have had complete sucess with all my creditors (5 in total) apart from MBNA/OPTIMA. I wrote to them on March 11th asking for 28 days breathing space to get my finances in order, they responded on 23rd March by sending me a claim form through Northampton County Court for the full amount. I admitted the amount (naive now I know) and gave them details of my ingoings and outgoings and how much I could afford to pay them each month. MBNA/OPTIMA objected to this amount but Northampton Court decided that this amount should stand and to make the first payment on a certain date (which I have done) I then received another letter saying that MBNA/OPTIMA have objected and that I should attend my local county court for a redetermination hearing. No more info just a date and time. So now I have some questions.... My main one is do I have to attend? I don't want to and also I cant afford to have a day off of work as I do not get paid if I dont go in. Can I put my case in writing? I already have a ccj from this and my home is in negative equity and is only a short while from being repossesed by Northern Rock as I havent paid the mortgage since February so a charging order wont make any difference to me. What would I put in a letter? I think MBNA/OPTIMA have been completely unreasonable so I was going to include copies of all my correspondance with them, proof that other creditors have accepted, my soa and letters to show my mortgage arrears. I was going to send a letter anyway prior to the hearing but have no idea where to send it or who to address it to. What a mess.....any advice would be great, I have 2 kids and have recently separated from my husband so I'm desperate to sort this and move on for a new fresh start with all payment arrangements in place...   15. I have just ditched Harrington Brooks, I checked my statement online and they had not made any payments since December 2010 despite me paying them every month. I noticed that one particular month I paid them £200 and they took £70!!! My understanding was that my monthly fee would be £29.... I sent a letter to them giving them 4 weeks notice and asking for up to date statements and they have ignored me completely. I wish that I had kept a clser eye on what they were doing, that way I would have got rid of them sooner! I am now putting it down to experience and sending my own letters with offers of payment. My advice would be to anyone that was conidering them STAY AWAY, GET FREE ADVICE AND DO IT YOURSELF!

I have drafted a letter and would appreciate any feedback: WITHOUT PREJUDICE 24th August 2010 Dear *name* I am writing to you concerning a letter I was sent on 20/08/10 by CPO *name* regarding a Fixed Penalty Notice for allegedly throwing a cigarette end out of a car window. Firstly CPO ** sent a covering letter and a page of notes but no fixed penalty notice with it as stated in their letter. This means that I have not been served with a fixed penalty notice and the correct procedures have not been followed which is a serious error on your part. I understand that you could issue the fixed penalty notice again but you should know that I am prepared to fight this ridiculous allegation in court for a number of reasons outlined below. I think that it is important to point out that I am currently eight months pregnant and have never smoked and can prove this through my medical records and more recently my maternity records in court if necessary. Furthermore, as the Registered Keeper of the vehicle I have not been positively identified as the alleged offender nor do you have sufficient evidence for prosecution as to prove beyond all reasonable doubt that I have committed the alleged offence. As I said before I am prepared to defend this position in court. I therefore wish to appeal this proposed Fixed Penalty Notice and request that it is cancelled immediately. I am due to give birth in early September and am finding this allegation very stressful and unnecessary. I look forward to your prompt response, Yours sincerely *name*

  19. Hi, Im a newbie so hoping this is in the right place. On Saturday I received a letter through the post from a Community Protection Officer saying that they had seen me throw a cigarette end from my car window the day before. They said that as the registered keeper I am responsible, if I was not the driver then I am to tell them who is. They said that they had issued me with a Fixed penalty notice and that it was enclosed and that I should follow the instructions on this to pay. The problem is that there was no fixed penalty notice included with the letter! Does this make it invalid? Also I did not throw anything out of the window especially a cigarette end as I am 8 months pregnant and have never smoked in my life as all my medical records and maternity records could prove. So what action can I take, I know that I did not do this and do not want to pay the fine and admit to something that I absolutely did not do. They have the correct car reg and I was travelling down that road at that time but like I said did not do this. It is a busy road and it was raining so I find it hard to believe that this person's eyesight is that good! Any advice would be greatly appreciated, I want to appeal but don't really know where to start as nothing like this has ever happened to me. The letter doesn't seem very professional at all, it is not on official headed paper and could have been done on any home computer, at first I thought that it was a joke! Now its just a headache that I could do without as I'm due to give birth anyday now. Thanks
