  1. Yes they do, how they got them I don't know though! Yes it was from a sheriffs office although this is the first time I've heard of them even going to court!i have proof of when I moved out of the property as id to call the police since my ex landlord locked my daughter and mum in the house and wouldn't let me or the removal men remove my property. As for moving in, the only proof I've got is when I submitted the housing benefit application form and a scrap piece of paper that my ex landlord wrote on to say I'd paid the deposit.
  2. I've just received this in the post and I don't know when it starts from and if I can stop it from happening! I am being billed for council tax for dates on a precious property for when I lived there AND for after I moved out. I am planning on going bankrupt in the next few months and am now wondering should I do that now? Please help!
  3. Hi I'm currently living in Scotland but have a mortgage on a property in Northern Ireland which has been granted by a court order to be taken on 22nd April. The property is joint owned although my ex has now moved out and done a runner. The house also is half owned by Coownership which is a company who helps first time buyers get onto the property ladder. I am not wanting to stop it. I simply want advice about where I can go bankrupt and the procedure as I'm not sure if the Scottish bankruptcy will cover Northern Ireland. Also does a tax credits or council tax debt get wiped out by the bankruptcy?? Thanks in advance
  4. I miscarried his child in 2011, I didn't realise I hadn't written that bit. I will get all of the relevant paperwork out and contact them about putting it into trust for my daughter Thankyou.   5. Sadly the valuation is correct as a house two doors down sold for £1000 more. We bought the house at the height of the property boom plus being in a bidding battle pushed the original house price from £89,000 to £143,000. My daughter isn't his daughter, her father is dead. I am trying to remain calm, I just want my life to be fully free of him. He had so much control and hold over me when we were together that I need for him to have no more ever again.

We bought the house in 2007 for £143,000 It is now valued £58,000 according to the local council who charges Rates (similar to council tax) The house was bought with a Preferred Mortgage for £71,500 and Coownership bought half with £71,500 which is classed us as half tenants as we are meant to pay a small rental charge each month. The mortgage is an interest only so the full £71,500 is still due. When you say issue bankruptcy proceedings against him what exactly do you mean?
  7. Yeah the solicitor said that equity proceedings is the technical term for pushing for the sale of the house. BazzaS yes the child benefit number will change also, sadly mine didn't exist in the uk database and therefore had to apply as a new claimant even though I have been receiving it every week for the last 12 & 1/2 years.
  8. I don't have any savings or properties, I'm living in a rental and any savings I do build up pay for us to go home to Northern Ireland to visit our family. Any idea roughly how much equity proceedings would be?
  9. Even though when I moved to Scotland. I had to get a new child benefit number and a new medical number because they claimed that Northern Ireland was not part of the UK (even though I have a British passport??)
  10. Sorry for the delay in commenting, I haven't had the energy to do anything apart from look after my daughter. The last time we were in court (November 2011) the mortgage company were going to reposess but didn't because my ex partner lied and said that he could only afford a small repayment. The Master agreed to this repayment plan even though I said that I would not be paying anything towards the house and wanted off the mortgage and deeds. In 5 - 10 years time I would like to be happy again and have no financial or property ties to my ex. I don't care if he keeps the house but I want off the deeds and mortgage. I asked my solicitor last week if by me going bankrupt would help my case and she said it would push along equity proceedings but she was unsure of whether I would have to go bankrupt in Scotland or Northern Ireland. In Northern Ireland it is over £700 and in Scotland it is £100 so obviously it would be financially easier to be declared bankrupt in Scotland but I don't know whether it would include the mortgage since it is based on a property in Northern Ireland. Bottom line, I want away from my ex and the property. Yes I would be saying that if there was equity in it. I don't want anything from him or to do with him.

Just seen my solicitor, we are applying for a non molestation order against him but we don't think it will be granted due to me no longer residing in n.ireland however we are going to try to state the case that we are back during school holidays. In reference to the house proceedings, apparently the only option is to begin equity proceedings which are lengthly and expensive, they have to be started in n.ireland due to the property being there but my solicitor wasn't sure whether I should go bankrupt in Scotland or n.ireland as the Scottish one may not stand in my favour as much as the n.ireland one which was bound to be the result since it's roughly £750 in charges in n.ireland and only £100ish in Scotland. I'm living in Scotland not England as I previously stated, don't know why I said England, automatic survival kicking in or something...I don't know. Apparently the big issue is getting my name off the mortgage which is essentially up to the mortgage company Is this what everyone on here would agree? I am really thankful of all of your help, you have given me some strength today in hoping that there may be light at the end of the tunnel.
  12. I will Thankyou, I can't put into words how much I appreciate your help, I just hope it works. I don't hold much hope though, my ex has always managed to convince people that he's right, if someone had blue eyes he could convince them that they were brown.
  13. Sorry for late reply, I've only stopped crying if I'm honest. I didn't want this mess, I just want free of him so I can completely move on without him in my nightmares. When you say to write a letter to my ex, do you mean just a copy of the letter I'm sending to the mortgage company? I'm going to go into my solicitors in the morning so hopefully she will see me instead of fobbing me off over the phone.
  14. I've just been cautioned for assault :'-( I have to stay in n.ireland until the case has been put forward to the ppi (I think) I'm probably going to lose my job
  15. I am just back from visiting. It resulted in him punching me. I rang the police and they came out. But due to the fact that I don't have any marks from where he punched me and he now has a scratch mark on his face from me trying to push him away from me and his shirt is torn because I grabbed onto it when I was falling, the police have stated that there is more evidence that I assaulted him regardless of witness statements. Apparently he won't press charges if I don't. I'm in pieces. All I want to do is have him out of my life completely.
  16. I am hopefully going to go to the house tonight and see if I can get access. I don't know whether I should be hoping for him not to be in or what but at least after I go I will honestly be able to say one way or another as to whether I will be allowed access. Nervous is an understatement. Will keep you updated on what happens and you can keep me on the right path. I just want financial security again which I can't have until I'm off the mortgage.
  17. I just want out of the mortgage and away from him financially but I don't know of any way that this can happen without forcing a sale which I can't afford to do or physically do because I no longer live in n.ireland and I can't leave my job in England to do so incase it does take years

I have spoken to the police and they said that they won't do anything in regards to searching the house or even questioning him as there is no hard evidence that he's growing and it would be deemed as police harassment. His brother in law works in the local station, even though he wasn't in the same department as was used when the non molesation and occupation order was being served he was still able to tip my ex off. We are in negative equity hence why the mortgage company said yes to his proposal of him staying in the house and paying half of the normal monthly amount due, he's paying £75 per month.
  19. Thankyou so much for your comment, it comforted me a lot to read your opinion. In terms of me divorcing him, I can't as I was never married to him, it would actually be a lot easier to get away from him if I had been married to him because a divorce is final. I'm stuck in limbo because he won't sell the house and has the mortgage company on his side. He fed them a sob story and a pack of lies and they agreed for him to remain in the house and pay less than half of the mortgage monthly agreement. Due to me not living in Northern Ireland I can't start legal proceedings to try to force a sale as my solicitor in n.ireland has said that it can be a lengthy action and will cost more than normal... Also I may have taken her up wrongly but she said that they had to happen in n.ireland (I don't know whether she means I have to be a resident there??) As for asking my ex in advance for keys or access, I don't want to do that because I fear he is growing illegal plants and I don't want to tip him off and give him a chance of getting rid of them. I'm only home for a short time and thought that perhaps if I caught him off guard and he was growing then I could ring the police an somehow that would go in my favour with the mortgage company and somehow the house could be taken from us. I need away from him financially, I can't fully move on. According to Acenden Mortgages we can't change the mortgage ie change a named person or remortgage due to the mortgage being an old Lehman brothers one and due to them going bust the mortgage can't be altered. My ex won't remortgage on his own because on paper he wouldn't be able to afford it so he needs me on the mortgage to keep the house. I'm stuck with him financially. I'm stuck with him in my nightmares. I'm in fear of asking the local police back home for advice incase they tip him off what with his brother in law being a policeman. I'm at my wits end. I'm trying so hard to move on but he always creeps back into my thoughts as fears. There's no point in me getting a locksmith and changing the locks as he will only change them again when I leave n.ireland. Then again I suppose there's no reason that he won't change them after he gives me a set of keys... I don't know. I just feel trapped and I suppose I was hoping someone on here would have an idea of a way I could fully be free from him once and for all. I don't think I ever will be

  22. My solicitor isn't returning my emails and when I ring to speak to her she is busy hence asking on here. Both of our names are on the deeds since the property is jointly owned.

Acenden took us to court, was granted an order and we arranged a payment plan... Then in July 2011 I had to get an occupation order out against my ex, this was granted and he was removed from the property. The order was then dropped a month later with attachments due to me finding out I was pregnant and him making me believe that he would change. Then in March 2012 he threatened me with burning the house down if I didn't leave. I had to think of my 12year old daughter so we left. He then subsequently moved in 5 months later and changed the locks. I have not been paying towards the mortgage as I have struggled to find another home for myself and my daughter. I also am living in England now instead of Northern Ireland due to my ex. My question is, do I still have rights to a set of keys to the property and can my ex refuse entry to the property as I fear he may have turned it into a growing factory as he always said he would...
