  1. Hi Slick. Thanks for the post. Just so I get this clear: Firstly, no matter what else I decide to do, get the SAR/CCA as simply put there can be no harm done? Secondly (and somewhat more confusingly ): If B/card do issue start a CCJ claim, their claim can effectively start: 1/11/04 Balance B/f £3,000.00 (and they would have no need to justify this figure because of the 6 year rule) I accept your point about not having to provide more than 6 years of figures but the balance of the claim is made up of stuff going back to 1992. Just to make my point another way, let's say B/C were really cynical and knew I had suffered a house fire and lost all my statements. They could then up the balance by £5k simply by putting 1/11/04 Balance B/f £8,000.00 as they would never have to justify such a figure.

  3. Hi Firstship, Many thanks for your prompt reply - always good to know that people on this site are so willing to help. Just one quick point as I know what I have written is a bit full on: I'm happy to request the CCA and SAR. However, I am equally happy to sit and wait for them to issue a CCJ and then demand that they give me all the statements (which they would have to do in order to justify the figure they sought) and use these as a counterclaim for the charges on the account. Whilst 6 years statements would be a start, I think it is the really old stuff (cumulative amounts over all those years) that is going to be more beneficial for me, yet (detrementally for them ) upon which they themselves must rely in order to justify the existing balance. Hi, Summary: I had an old Barc curr a/c from '94 to '08 with plenty of "unauthorised" charges etc on it (still £1300 o/d left) and various, separate loans rolled in to t'other with Call Serve now chasing the remaining £7.5k thereof...." Instruct one of our local collectors.......Proceed with legal action for recovery" Situation: I'm temping in the financial sector and can't afford a CCJ resultingly. My contract will end at Xmas and I will have to find similar? work thereafter as and when it materialises. Furthermore, I have had to leave my last, rented address and have a mail redirect in effect until I can (hopefully) move in to a friend's place without advising any of my creditors of this. My credit file is a shocker and I have bugger all money so I would regard myself as vunerably housed (have just made a similar post at B/Card in case you are getting deja vu ;-). Resultingly, I want to pay as little as poss (pref nothing) to my creditors without jeopardising employment prospects. Gameplan: I would like to use as much of the "unauthorised" charges on the current a/c to offset the charges thereon with enough left over to clear some of the Barc Loan as well whilst having a delaying stategy on both until I can earn a few grand in future employments to wipe the slate clean across the two. As I doubt I have the majority of the statements on the current a/c, I would need Barc current a/c to play their hand by issuing a CCJ so necessatating the provision of all historic statements, then fighting to reclaim charges so I could clear that debt and the other. I appreciate this is a really tall order and would be really appreciative if anyone can help with tactic/strategy advice so I can try to pull this off! Many thanks and to all

Hi, Summary: Took out a B/c back in '92 when at college and have been using ever since and now owe some £4k (per last statement) which is being pursued by Mercers: "A local debt collector................." Situation: I work in finance and don't want a CCJ but am temping and about to come to end of contract and don't know when next employment will start or what it will even be. Also, I have left my last address and await a friend's place to come up with mail re-directing to another mate's address. Needless to say the last thing I need is to be forking out for cc repayments when I am potentially vunerably housed, jobless and with a credit rating worse than a boy band's comeback tour. Game plan: As I've always paid late etc throughout my teens/20's (and also of late) reckon there are a bundle of "dubious" charges on the account which would hopefully negate the existing debt. However, doubt I have lion's share of the statements and accept B/C won't volunteer these either. I intend to stop all communication with them and their cronies and wait for them to issue a CCJ (if they ever do). I would then demand complete statements to justify their charges and try to offset their whole claim on the above basis. Appreciate this sounds abrupt but wanted to convery the picture as succinctly/unemotionally as possible. Any help on this would be truly appreicated! Thanks
  6. Hi all, Just got the usual initial letter from Bryan Carter stating that: Captial One This matter will be referred for court proceedings to be issued on 4 August 2010. Etc From reading the other posts on here I know the first step is to request a CCA letter from them and they only have 12+2 days to reply. I also know (from this site) that they will most likely start the claim, send the paperwork to an old address (although I have lived at my present address for 6 years), win the claim as a result cos I then can't defend. What I am concerned about is balliffs turning up: I also don't understand how if they have started the claim (and won by default) at one address they can start gunning for you at another address - ie balliffs, attachment of earnings etc? If they do send the paperwork to my existing address then I will defend using the 'haven't got the CCA back' etc defence outlined elsewhere. Also know that they will only claim for about £250 despite owing cap about £8-900. BTW I took the signed the original agreement back in 2002, but appreciate that the pre-2007 stuff is a separate issue that has mention in other posts. So, in summary, if they get a default at my previous addres. How can they go for me at my present address and will I have Balliffs turning up with appraently - bona fide paperwork for my present address. MAny thanks
