    Name of the Claimant : UK Parking control Ltd


    Claimants Solicitors: DCB Legal Ltd


    Date of issue – 7th December 2021

    What is the claim for 


    1. The defendant is indebted to the claimant for a parking charge issued to vehicle **** *** at ******************.


    2.The PCN details are 15/01/2017, *****************. The PCN was issued on private land  owned or managed by the claimant. The vehicle was parked in breach of the Terms on Cs signs (the contract), thus incurring the PCN.


    3.The driver agreed to pay within 28 days but did not. Defendant is liable as the driver or keeper. Despite requests, the PCN is outstanding.


    4.The contract entitles claimant to damages. 


    £160 being total of the PCN(s) and damages. Interest at a rate of 8% per annum pursuant to s.69 of the county courts Act 1984 from the date hereof at a daily rate of £0.02 until judgement or sooner payment.

    They sent two NTK's for one of the "alleged" breaches presumably because the first one did not comply with PoFA.


    They then sent you another version of the NTK which was also not compliant with PoFA. Total muppets. And of course the other PCN was also non compliant.


     I find it hard to believe that they are even threatening to go to Court with you. There is no way on God's earth that they can win if you bring their failures to the Court's attention.


    As your PCNs were both windscreen tickets then when they follow up with their Notice to Keeper  comes under section 8 of PoFA and in s8 2] it states "must". As such the procedures and wording must be virtually identical to the procedures and words in the Act.


    So in s8 2] [f] it states "

    (f)warn the keeper that if, at the end of the period of 28 days beginning with the day after that on which the notice to keeper is given—

    (i)the amount of the unpaid parking charges (as specified under paragraph (c) or (d)) has not been paid in full, and

    (ii)the creditor does not know both the name of the driver and a current address for service for the driver,

    the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;"


    In their version they ignore most of those words and then say "This is inclusive of  recovery action and is in accordance with Schedule 4 of the Act. Which it isn't.

    cheers for your Letter Before Claim.  I had a good laugh at the idea you actually really thought I'd take such tripe seriously and cough up!


    As usual you'll have been too bone idle to do any due diligence before sending out your bilge otherwise you'd have seen this is a residential parking case.  You know and I know and now you know that I know why your client isn't entitled to a red cent in such cases.


    Your client has also scored a big own goal by adding a whopping £120 in Unicorn Food Tax.  Oh dear oh dear oh dear.  Judges don't like these made-up sums, do they?


    Your client can either drop this hopeless case or get a good kicking in court where I will go for an unreasonable costs order under CPR 27.14(2)(g) and spend it all on a foreign holiday now that we can all travel again, while all the time laughing at your client's expense.


    I look forward to your deafening silence.





    Wait and see what the other regulars think today, then if there is no retweaking send off copies both to Gladstones and to PCM tomorrow by 2nd class post, and make sure you get two free Certificates of Posting from the post office.


    Any competent company would see "residential parking" and give up as they know full well it is very difficult for them to win such cases.  However, they may be blinded by £££££ as there are two tickets.  I've tried to hint that you know the law but at the same time tried not to play our cards too early.

    Both I have been sent photographic evidence along with case report details which I presume is them putting my Car reg in to obtain my name and address.

  5. Hello, I have sent the SAR had no response as of yet. Just wanted to double check the reference I used was the car registration so hoping I got this right and also I put the dates in which I purchased the car and sold the car? Is this correct also? Quote below from letter.


    "Please note that I require disclosure of any personal data which you hold on the above vehicle for the entire period between the dates 02/01/2017 to 31/05/2019"


    As soon as I hear anything I will let you know. I sent direct to PCM LTD to address that was on their website.

Thank you so much my anxiety just coming on this website at the start and dealing with this matter goes through the roof but I know I have to face this sort of things or else it makes me so ill and now I feel a weight off my shoulders so thank you. I will get the SAR off tomorrow and get the proof of postage and 100% keep you updated. Thank you 

  7. My housing association is L&Q London and Quadrant. I parked in my specified parking bay that the housing association allocated to me to my property but my permit wasn’t on show. I’m not even sure how many charges I have actually got on this car from PCM but more then certain it was more then 2. 

    Thank you recommending a SAR letter to send (if there is a link to the template that would be fab thank you) and I will prepare now to send to them. 

  8. I know what you mean by once you make one payment they think they have you!! I totally agree with you and in all honesty I have ignored the majority of them and they all went away this is the furthest a private parking ticket has gone so this is why I need the help now.

  9. Thank you for you help.


    I have used this site previously mainly for council pcns which helped me a lot and I have even attended court before through using this site and won a few appeals one when I was heavily pregnant with my son who is now 9. 


    I had a few private ones which I was fighting but due to stress etc a family member paid them for me which is why I never got to continue appealing them.


    These ones all of a sudden have appeared out of no where and because I know how useless Trace is I do usually ignore their letters of demands for money and never hear anything after a while. 


    With this letter from Solicitors I have decided to ask for help rather then ignore any more so thank you for your continuing support and help.

    I am asking for help now which if you are not willing to help either then thank you for taking a look into my case asking me questions editing my PDF and then judging me????

  11. Hello I would love some help please, 


    I have received a letter from Gladstone Solicitors regarding 2 pcns from a car I use to own from a residential car park where I live which is housing association.


    I have had a quite a few but they have pick up on these 2 and decided to send these to Gladstone Sols and this is the first letter I have received from them.


    It doesn’t state anywhere in tenancy about parking and would like to know if I should ignore or what I should prepare for or write back in return etc as the last thing I need is bailiffs or ccjs as I literally have no money from my ex leaving me in absolute debt and slowly starting to climb out of it.

  12. I haven't got access to scan until Monday but I can confirm it says



    1. The application for AoE order is dismissed

    2. Within 14 days....... So from my understanding do I now have to wait to see if the claimant wants the AoE reconsidered?


    If they don't apply for reconsideration how will they expect me to pay back the money I owe them?

    Not sure if this is good need or bad need
