  1. Sorry I haven’t been well, I paid the ccj and received another pcm ticket for my old car dates 28/11/2022 for £100 and 28 days to appeal. I’m going to appeal on grounds that the signage is very poor. I will upload a picture later today. They will no doubt decline it so I will go to the ipa
  2. Hi No never replied I literally mate he’s the ref to that letter to the cc’d letter received yesterday but have not received anything after that letter in August. I feel I need to pay as do not want a ccj but want to try and fight it afterwards for sure
  3. So went through all my paper work and found this the last correspondence for my old car and then I sold it to we buy any car September/October time. I am guessing that after I sold they sent all paperwork to the new address keeper or whatever the address the car was registered in after I sold? I will call Monday and update.   4. I sold my old car to we buy any car and bought a new one in October so I’m going to have to find out the address they sent all these documents to and what car it is relating to. I haven’t received any claim form or court papers at all so will call Monday morning
  5. I haven’t moved recently no, had some missing post over Xmas though but nothing major i will call northants bulk and speak to them for copy of claim form or particulars of claim. Just received a judgement for claimant for PCM (Parking Control Management) for £291.78 saying as I have not replied to the claim form but I have never received the claim form in the first place!!! Do I need to complete a N244 form? I don’t even know what parking ticket this is for? What should I do now to appeal as I know 100% no claim form came to my house and I have not moved house recently. Any help thank you
  7. Hello I have received an email from DCB Legal to say the UKPC are proceeding with the claim and I will receive a questionnaire. They did say to call them if I wish to discuss a settlement in 7 days. I have also received a letter from them today saying ‘Please be advised CPR 31 does not apply to claims allocated to the small claims track. in any event we note your request for evidence and the same has been requested from our client. On receipt of such evidence we will provide the same.’ Im guessing I just have to wait now for questionnaire? Does the above mean anything I need to worry about or be prepared for?
  8. I’ve just received a letter from Gladstone’s saying that I don’t have a defence case for these 2 parking tickets and that they will proceed with the court case if I do not pay £320. BUT they are willing to accept £200 to stop any legal proceedings??? I am going to ignore or should I reply?

  10. Hi, I am submitting my defence on MCOL and because the claim is over £300 I have to pay £50? Is this correct, it’s being called my counter claim?

  12. 1. It is admitted that Defendant is the recorded keeper of [motor vehicle]. 2. As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC), any contract requires offer and acceptance. The Claimant was only contracted to provide car park management services and is not capable of entering into a contract with the Defendant on its own account, as the car park is owned by and the terms of entry set by the landowner. Accordingly, it is denied that the Claimant has authority to bring this claim. The proper claimant is the landowner 3. It is denied that the Defendant breached any terms and conditions set on private land. 4. It is denied that the Defendant entered into a contract with the Claimant, or broke any such contract. 5. The Particulars of Claim is denied in its entirety. It is denied that the Claimant is entitled to the relief claimed or any relief at all. Am I on the right lines now? I had a read on a few threads and I’m guessing this is the generic statement needed to send as my defence?
  13. I have been typing in your google enhanced bar all day since this morning as you keep saying!!! all the claim threads relate to parking PCN’s that are not similar to my case in the slightest. I am googling defence templates, court claim defence templates, DCB Legal court claims and to be honest I am not getting anywhere as this is something that needs my 24/7 time and attention and no excuse but 3 kids and Xmas time is impossible.   14. Some points I have also researched and want to see if they can be used as they apply to my case; The Defendant was the registered keeper of the vehicle in question but liability is denied. It is not known who was the driver at the time The defendant first heard about the parking charge by post recently when the defendant received the court claim form. the defendants cannot be held liable due to the claimant not complying with the ‘keeper liability’ requirements set out in the protection of freedoms act 2012, schedule 4
  15. 1. The location in which I received this Private Parking Notice is Private Land that Swan Housing Association own, and I paid rent to at the time. 2. I was pregnant at the time of the PCN with my third child, born 03/07/2017, I was also looking after my 2 other children. I was of high risk pregnancy which involved me having more frequent hospital appointments due to high blood pressure and migraines. I do not remember any PCN being attached to my windscreen that’s was in relation to this PCN. 3. The signs within the car park were regularly graffitied on and vandalised. 4. The claimants notices attempt to make a forbidding offer, which isn’t an offer at all; therefore no contract exists. 5. There can be no legitimate interest in issuing charges to residents, as the parking scheme is aimed at external ‘abusers’ Thank you

  17. I’ve done some reading last night and this morning and have the following to use in my defence. Signage - It’s hard because I’m not sure where my car was parked as to what angle I need to take photos of the signage and it was back in 2017 so may have changed and been updated since then? I remember a sign was graffitied on once and was very unclear to read I was pregnant and in January was suffering with awful sickness and migraines. The parking was on private land and having requested this information have nothing received the proof?
  18. 9th of Jan it’s due which is a Sunday so guessing the Friday before which is the 7th Jan and that’s counting al the Christmas Ana Boxing Day dates.   19. I have responses to the AOS on the MCOL website and got confirmation. I am sending the letter to the solicitors I typed up tomorrow. Should I send as recorded first class or just first class free proof of postage? I’m trying to get a copy of my tenancy agreement or one of my old neighbours. In the meantime is there anything else I need to do to start my defence? will I have to go to court? My anxiety and panic attacks are so bad I can’t even think about going to a court room right now once again thank you so much for your help, I feel like I have done the first step with your help and now need to keep going
  20. I honestly can’t even remember it was so long ago and I use to live in the flats though that’s why I parked there. I remember getting a ticket once for parking in a wrong bay but that was because someone had parked in my bay and I had 2 kids and was pregnant so parked in another bay as I wasn’t well at the time. I got another one for parking in my bay and not displaying a permit but I don’t know which this ticket could be for? Both tickets I got I ignored.
  21. Hello it was either in one of the bays out the front or underneath the flats where there are a set of gates where I got the pcn.
