  1. I was on mat leave but got made redundant due to a merge of depts and there was a suitable new role. I was made to go through the whole interview process etc and was 'unsucessful' for one of the new roles. Since i left on mat leave (last april) the company had been taken over and there is a new manager that i had not even met till i got called in for the 'at risk' meeting. I have received my final pay, redundancy pay and p45. I appealed stating that i did not want a job due to breakdown in relationship and feel demeeded by the whole process. 3 weeks later i received a letter saying my appeal was upheld and i should contact my manager to make arrangements to go back. I do not want to go back and made it very clear, i want compensation for loss of earnings till i find another job. I have tried to consiliate with them through acas, but (3 weeks later) are not willing to conciliate and will defend any claine stating that they made a simple mistake that they imidiattly put right by offering a job, they don't believe there is any breake down in the relationship of breech of contract!! My questions are:- if i go to a tribunal how likely is it that the outcome would be a job? and if that is the out come would i have to go back. what would happen about the redundancy money i have already received? Do i really need a solicitor? i really can't afford one. I only have 10 days till the ET 3 month deadline as they have dragged their heels! Thank you

Thank you for replying The working hours are almost exactly the same as before, staff required between 6.15am and 10.30pm There are shifts that would have suited me and my family Would i also be entitled to ask for payment for when i attednded meetings and interview? I had to go in 4 times alltogether. all other staffer had this during their working hours.
  3. Hi, hope this is the correct place. I'm on additional mat leave (due to return may) This is my 3rd lot of mat leave since starting work for company over 6 years ago. Whilst i have been on mat leave the company has been taken over by a competitor (its a large company with locations throughout the uk). Also the general manager has changed. I got called in for a meeting almost 4 weeks ago and we got told we were at risk of redundancy. I had my consultation, 11 jobs at risk and due to head office taking part of the work there would be 2 jobs merrging (reception, which i am, and admin)and a new job 'front of house' would be created (basically my job but a different name. I 'applied' for the new job (which i'm not sure i should have had to) and had a competancy intervied. This was the same as all oth other interviews and was job based questions even though i have been out of the business for 11 months and the company has been taken over and now oppetates differantly in some areas) I worked 8 hours over 2 tea times prior to mat leave, and had a note from the previous manager stating one of those as my regular shift. Having 4 children (under 7) and a hubby that works full time does limit my availability and flexibility.on the 'application', I stated i would want to work teatimes (as before) and/or early morning. and would reduce my hours to keep my job. I also said i would not want to work a late shift(7pm-11pm) as with young children getting up early i have migraines when i have worked these shifts in the past. I went in for my final meeting to find i had done quite well and 'better than others' in the test but failed on flexibility (but sucsessful staff have been given fixed hours to work) My letter says my redundancy paynets, PILON payment 4 weeks pay. and that untaken holiday will also be paid. they have been 'unable to find any alternative work...employment willterminate on 31/03/2012' so what do i want to know? - Should my PILON be 6 weeks, 1 weeks for each complete year of service? -Is this unfair? I strongly believe it is, and if it is what do i do? - If i tell them that its unfair and they offer me hours that i can not do (I know the person offered 2 late nights has left) and i refuse will i lose my redundancy pay? -should i ask for a written statement as to why i was unsucessful/ why others were sucessful abaove me? -I'm not sure i actually would want to work there again now but feel unfaily treated. I have also been told, hearsay i know, she asked the dept manager about who had been not got a job and she said the 'obvious' staff had not made it Think that about it for now, my head is spinning Thanks
