  1. So, as it stands with respect to me, barclaycard have come back with documents. (citi) have come back with documents for Citi and Egg MBNA have come back with computer screen grabs but failing to provide any numerical data or statements saying that they don't have it anymore. RBS have been awkward and now have thrust me onto some online documentation switch system which has not allowed me to sign up or create an account to view the document that I have been sent. Mrs Sev SAR's will be going off by the end of the week.
  2. Hi all, Following my successfully having written off all of Mrs Sev's debts, I am now on the crusade to reclaim PPi for the both of us. I had the following cards or institutions : Barclaycard - SAR sent - Information received. Abbey CC / MBNA - SAR To be sent Citicard CC - SAR To be sent Egg CC - MINT CC - SAR To be sent and historic loans with barclays and abbey Mrs Sev has a few more to add to the list. My question is this at this point in time, is more to do with which address do I send the SAR to? With the egg card, would Barclaycard have supplied me with any relevant information? ( I have yet to go through all of their package) Abbey / MBNA CC - do I write to Abbey/santander or MBNA? Mint etc, - the southend credit card centre? The citicard - I have a choice of several addresses: Citi Financial 33 Canada Square London E14 5LB or Citi Card PO Box 4904 Worthing BN99 3AS Fingers crossed we come good on this, as I've pledged to give at least 10% of anything I can claw back to this forum for all the help it has given us in the past.   4. Since Mrs Sev was diagnosed with Lewy Bodies Disease, I managed to get all her debt written off by the various DCA's that had been hounding her since her fortunes turned for the worse. It was a long fight and in the end we got there, thanks to this forum it's community and the infinite patience of the likes of dx100uk. I am in the process of going through old paperwork with a view on trying to recover as much as I can for her to help contribute towards her ongoing care. I have found old paperwork for the following: Barclaycard Visa and Mastercard Co-OP Visa Capital One Visa Monsoon / GE Capital Russell & Bromley / GE capital Harvey Nichols / GE capital Frasercard / GE MBNA Mastercard & Visa RBS Visa Mint Mastercard. Natwest Mastercard. The paperwork consists of: some old statements but also some of them have the original fold that the card was delivered in, and some the actual PPI letter. The original signed CCA is not in any of the documents. So, my initial question is this - Should I begin by sending an SAR to each of the creditors or will the proof that I have already be enough? We probably have statements going back as well, but these might not be for the full term going back to when the card was taken out. I may well send SAR to Barclaycard as I am sure that she took out a Barclayloan or two in the past. I'll be honest, the ones I hope most to get something from are GE and MBNA for their relentless harassment in the past. thanks in advance Sev.

So after many months of no contact other than the usual pestering phone calls and automated calls ( of which I had asked them to stop and only communicate in writing- obviously ignored), I received a letter with a Notice of Assignement. Hoist Portfolio Holding Ltd (HPH) has sold my account to Hoist Finance UK Holdings 1 Limited (HFUKH1L) They've basically sold my alleged debt to themselves haven't they!
  6. I hadn't realised how long it's been since this thread was updated! It's been since the other side of last year that I've not heard anything after sending the CCA request. Both Barclaycard and RW have remained silent. Barclaycard however did comply with my SAR and sent me a massive file of nearly a ream of history with them. If they (RW) have called and not left a message then they've probably been caught up in the auto ignore of all the telepest phone calls we all get on a daily basis. So I suppose I'm asking where do I go from here? I've not had any reply to the SAR or CCA from RW who wrote to say they had referred back to the original creditor (Barclayshark). Were they to call / write etc do I entertain them?, and if so, how?
  7. No problem. So date wise it goes like this; Payment arrangement with egg which was maintained right through to barclaycard taking on all egg card business (2012?). Iirc I started the payment arrangement with them around end of 2005 into 2006. At that point a new card number was assigned along with notification that barclaycard were now in charge. I rang barclaycard to discuss arrangement and to see about getting payment details for such. Barclaycard collections said that someone would be in touch in due course as they 'had nothing to do with this at the time' I continued to make payments to the old egg banking details I had until I heard something back. Since by 2014 I had heard nothing I stopped the payments. The next contact was this one with barclaycard informing me that they have sold everything to hoist- ironically for probably a pittance of their worth. So I've never really defaulted on a payment arrangement as far as I was concerned. Would I be right in thinking that barclaycard have written off the debt and anything that hoist make over and above what they have paid is all profit for them?
  8. Oh I couldn't agree more. It was actually Mrs S who opted out of the roll as she had issues a long time ago with a previous ex who was not the nicest of people. - but that was a very long time ago. Sorry, I should clarify, we're both on voters, but not on the public register. And no, I don't do running and hiding. The credit rating to be fair is the last of my troubles at the moment. It's been shot for years, and will be until I clear all of my debts, which will not be for years!
  9. Thanks slick123, I may well do that. So today's update is that Robinson Way have just made contact. First letter with notice of assignment and asking me to make contact with usual sabre rattling about arrears etc. The intresting thing is this... The card was taken out back when I still lived at home with parents, so, original account, as the bc account and all others were taken out at that address. Now, this correspondence has been sent to my and mrs sev's address. So they have obviously done a credit search or whatever, as we are not on the roll. My first instinct is to request the cca then see where it goes from there.
  10. Sorry Slick, I haven't been on the forum for a while. I have subsidence to worry about on top of everything else, and the insurance company is trying to avoid paying out. As if Mrs sev' dimentia and Parkinson's wasn't enough.... but either way that's a thread on its own. I have statements going back to 2002 for all my cards and for my abbey overdraft as was. Update... Sar was sent to Barclay card but as yet no reply, I'll give. It another week and chase. However this morning I get a letter forwarded to me. Barclaycard had sent a copy of the notification letter to an address I had in the past, which was not linked to any of my barclaycard accounts. Very interesting mr bond. I have yet to have Robinson way make contact.

  12. Hi Slick, no at the time I didn't. I was concentrating on reclaiming my Abbey National charges back then and sorry to say failed miserably due to my own fault in not getting the court pack ready properly. That kind of put me off back then. I have all my statements from abbey from that era still. More as a reminder on the cost of not doing it right. I have a very different head on my shoulders now.

  14. thanks Bazooka Boo, yes the original card was taken out around 2000, and the payments post 2006 were around a few pounds a month.
  15. I need to do acredit report as I haven't done one for many years, and as yet I haven't asked for the CCA as RW haven't made contact. Initially when the debt was managed by Egg Credit card I reached an amicable agreement with them , and when Barclaycard took over they said that they weren't concerning themselves with it and that "somebody would probably be in touch at some point" so I never bothered with the CCA request.
  16. This week I received a letter from Barclaycard stating that the egg credit card account they took over back in 2011 will now be sold off to Robinson Way. I've dealt with Robinson Way before and so I know them of old, and they don't do reason. The situation as it stands is as follows. I came to an agreement with Egg back in 2006 for reduced payment when I couldn't afford the debt any longer. I paid them a token amount every month via bank transfer, not DD. When the account was bought by Barclaycard I rang them and asked about making payment - they couldn't give me any details of payment or account numbers. I continued to make payments to the original account details till 2013. The last payment going out on 3rd Jul 2013. I'm just wondering where I stand with this - as it stands. In retrospect I don't even think that the payments I did make throughout 2012 to jul 2013 ever reached Barclaycard and when I did try to call they did actually say that the debt wasn't something on their radar, which makes me think that now they're doing housekeeping and just selling off old rubbish they couldn't be bothered to deal with before now. All advice gratefully received.

I really don't know what made them change heart, whether it was the copies sent to BBC Watchdog and MP or whether I just made it pretty clear that as I was now in charge of the financial decisions they could whistle, or what I really don't know. if MP got involved I certainly don't know about it, but I'd like to hope that it's started something.   18. So a final update, Following a rather blunt written discussion, in which I sent a copy to my local MP to raise in the commons, IDEM agreed to write off the debt in full. They also today delivered the full contents of the SAR. I suppose they finally did the right thing even though stating in their complaints resolution letter that they had done everything above board. Irrespective, the goal was achieved to give my other half peace of mind for whatever years she has left. She is now debt free, and I would just like to than you all for your support and giving me the conviction to stick to my guns. Thank you all so very much

Mrs Sev recorded it by holding a dictaphone to the microphone of the telephone - landline, she wasn't up on technology but did manage to get that one, unfortunately that conversation never went out in writing mores the pity. Sorry for the delay in updating but today we have had news from IDEM Shortly after sending the above I received a call from them asking to go over the paperwork submitted and the financial statement. The paperwork included a letter from the neurologist and psychiatrist detailing her ailing health and also her inability to keep memory and the fragility of her mental condition. I made it quite clear that she was deteriorating and would eventually (probably within 12-18 months) be at the point where I would need to enact power of attorny over her affairs. I also enclosed a break down of what Lewy Bodies Disease was. I'm sickened by them to the pit of my stomach. I thought I made it quite clear she is in no position to manage her own finances or make her own financial decisions any longer. I think an SAR for the telephone transcripts and again a CCA request reminder is in order. They seem to have ignored that bit. Idem are the only ones now who have not written off her debts. I wonder if they have pictures of hitler and Saville in their offices as role models to look up to? just to add, this was after the "review by management" which took two months and now they've dragged it out another month till writing the above letter. I have reduced the standing order to only pay £1 till that document is produced - and after taking their three months free offer up. And no more phone calls, they can do it all in writing. I'm very tempted to forward everything thus far to Watchdog or the press as it's got some meat on it, but a big part of me wants to leave it till Mrs Sev is in a position where she won't know any of it, for her own dignity. Dirty bottom feeding opportunists that they are.
  20. So here's the update so far. I collated together documents from consultants and physiotherapists proving her condition, and her mentally impaired state, and letter of authority - authorising me to take charge of all dealings. Within 4 weeks fair credit to them, M&S bank had written off all debts owed. Last month RBS/ Mint and Natwest through the Southend card centre had also written off all debt owed. Robinson way have handed back to Hoist Portfolio with all supporting documents citing that they can no longer service the debt and have referred back to creditor. As yet I have still to hear anything. Idem have "referred to management" now for over two months. They tried the "there is a balance outstanding that needs to be settled" routine. I dutifully reminded them of the following: The balance outstanding is the difference between the agreed payment and her token payment. How they choose to do their accounting is up to them, but I am more than happy to request transcripts of all telephone conversations and prove that they accepted her offer of five pounds. That now that I am dealing with things, if they cannot produce the CCA then they will get nothing. The threat of credit file damage is no threat, nor has it been since 2006 when their industry decided to royally shaft us. That I still have recorded evidence of MBNA harassment, one of which was them proposing to her that she should either sell our cats or have them put down in order to release funds to service their debt. I still await their reply.

  22. nope it hasn't been to court, and they, all credit cards were taken out in mid 90's. She has never asked for CCR or anything else other than paying what was asked as she couldn't take the phone calls pestering from them.
  23. Thanks You've put a different perspective on this sutuation. Thanks for that, as it means that I can write to Cabot as well to reduce the payments I make to them. I suppose the first thing to so is for me to write on her behalf and send a CCR together with a new figure telling them what we intend to pay?
