After Lloyds getting a charging order on my property for a debt of just over 6k-I have heard nothing for a few months, I have now been sent a from the court a notice of application for attachment of earnings order-before it got to the charging order stage I applied for an installment order and this was ignored-any advice would be welcolmed

Thanks I acknowledged the service on line to money claim I sent in a holding defence as I needed more info as to how they came to the amount they were claiming, and also there already was a PPI issue i was persuing-never had a allocation questionnaire-never heard back from claimant re my request for info through a CPR 31.14. THE Judgement states upon the defendant not appearing or filing any evidence and upon the court determining the summary Judgement application it is adjudged that........... Pay up I am not sure what I did wrong Thanks for your help

Received from my local court today a summary judgment that was awarded against me ( dated 22nd JULY) for a credit card debt.I sent back the acknowledgment of service back in April, and also CCA the Creditor but never heard anything back until this landed on my mat. My defence would of been the incorrect monies claimed due, as I have a PPI claim on going with them.........any ideas I am not going to be able to find £4500 by monday ...HELP Thanks

Just received with a WS from Morgans and a Notice of arrears notice-the amount stated is not for what they are claiming they are claiming the full amount, any ideas Chaps? never sent anything prior to court action so why send it now

All fees would of been paid by Social service if he did not have a property or his savings was below the threshold, Social services would of taken his pension to help pay for the Homes fees- and leave him twenty pounds pocket money- the contact would be between the home and Social services the chances are that social services owe the home the money not you or your father - Challenge this with the Nursing Home

OK thanks for your advice, i will amend the draft accordingly and as you suggest and see how it goes with that, it all gets a a bit confusing as no two DJ do the same process, hence why these people are allowed to abuse the process.

Yes, they only partly complied as some of the docs were missing, them they were asked to put in amended POC claim and I put in an amended defence then the AQ turned up

Following a revised POC from Cabot in which I put in an amended defence, I have received another AQ' I am now a bit confused! I have not received much in the way of paper work from the Cabot crew, they have sent me to date a CC with my name on but it is not my signature, a representation of a NOA and a bunch of statements. I have also noticed in the statements approx£4000 of PPI charges that I have not signed up for Any ideas what I should do for the proposed directions bit Any help gratefully recieved Gal:

Hello you need to ask the DCA proof that they have the right to persue you for this debt by sending them a CCA request-thats if its a CC / Loan, there is lots of advice on this site have a good read and it will help you understand. Template letters for these requests are on here too You will need to acknowledge service of the court forms

Anyone out there that could help............ does a CCA have to have in its terms the question re PPI included in your repayments ? as statements I have recieved fron EGG havePPI on and I do not have any documention stating I asked for this, and it was not on the EGG card agreement.

another bit im confused with is i have a letter from Morgan solicitors stating " assignment transfers the rights or benefits but not relieve the assignor of duties, or burdens of liabilities in the POC morgans state the assignor legally assigned all of its rights, title and interest under the contract with the def to the claimant- is that the same thing as what the original letter stated ??????????????

just checked my credit file ..... i have a default against me by Cabot, but the original loan was taken out by EGG and cabot bought the debt, Cabot have never defaulted me..... is this how it is who ever buys the debt the registering of the default is held by them..sorry if i sound a bit thick.

Think it has not mentioned anywhere but charged for it- have to work out how much

also if anyone can help if a PPI that has been added to the account should that be in the CCA ?
