  1. Background: I lived in a private rented 2BHK flat between 8th April 2011 and 8th April 2012. I have no content insurance for this rented flat. I bought a house and exchanged contract on 20th March 2012 and for this house I bought both building and content insurance starting 20th march 2012. On 4th April 2012 ( 4th days before moving out of the house), there was a water leak from the flat above because the owner of the flat above left his kitchen tap open for 2 hours and it flooded my flat. Some of my contents in my rented flat ( bed & mattress, laptop, rolling chair, beddings, clothes) got damaged . My landlord came to apartment on 5th april 2012 and removed all the carpets in one of the bedroom and bathroom which was spoiled and throwed that in the bath tub. He also paid for 4 days accommodation in a nearby hotel. I moved all my things to my new house on 7th April and arranged for a cleaner to clean the room that was not affected by water leak and I have an invoice from the cleaning company as well. Question: 1. How can I claim the damages to my contents because of this water leak and who is liable for the same. 2. When I went on 8th april 2012 for the final inspection with my landlord and he told that kitchen was not cleaned properly and he has to re-clean the same. 3. I didn’t throw away the damaged bed and mattress from the bedroom and he informed me that he will deduct from the deposit for clearing the same. Is it fine since he did not make the house in a liveable condition after the leak?. 4. In one bedroom which was not damaged, the curtains was in a fine condition and he wants me to dry clean the same. Answers to this will be highly appreciated. regards, Kiru
  2. Hi All,Thanks everyone for the response. I got an Judgement order in favour of me and land lord was asked to pay me3x deposit plus fee (£3120). Now LL had sent me a cheque for £900.But he has applied for variation order in court statting he wantsto pay the remaining amount in installments of £50 per month.I would like help on responding to that order for him to pay the remainingamount in full within a month. Please help

Also, can you please tell me some reasons why this case should be mutitrack and not small claims since i need to fill that up in my allocation questioner. Hi, I stayed in a apartment from 12-nov-2007 till 31-may-2010. i have given him 1 month notice before i vacated and he did not come to inspect the house while i left. he refused to return my deposit and that time i found that he has not protected my deposit hence i made a claim for 3X deposit using MCOL for £2700. Now my landlord has send me a counterclaim for £3400 making false statement that the house needs reparing and cleaning. I have a signed tenancy agreement with inventories and those were there in the house in a good condition. also in the tenancy agreement there was no basline condition of house other then the listed inventory. now i have been sent a questioner by court to fill in. needed advice on the following. 1.) can i send all the evidence while responding to court questioner. 2.) i had my work collegues who inspected the house when i left and they are ready to provide a statement as witness on the good condition of house. 3.) he has created mental agony for me by stating all false information in his counterclaim, is there anything that i can do for that. your response is appreciated.
  7. i have already submitted a claim using online, should i submit another claim using N208 form?. Also in my claim i have asking for 3Xdeposit how can i now change it to 3X deposit plus deposit.

  9. Hi, I needed help in getting back my deposit. I have paid £900 and vacated the flat on 30th may, my LL is refusing to give my deposit back. I have used online moneyclaim and send his a notice asking for 3x deposit since i found out that he has not protected mmy deposit in TDS. am i using the correct claim system, if not how do i chance to that i can re-issue the notice through correct form. Help needed urgentely since the online claim that i had submitted shows that he has acknowledged my notice and ready to defend my claims made against him. --Kiruban
