  1. Hi all Have just got back from a successful court hearing and they have suspended my eviction. Lot of drama leading up to the hearing (including the court unable to take my application payment because their machine was down) but managed to get an emergency hearing for Today (eviction was set for tomorrow at 1pm). SPML agreed to my offer before going before the judge so everything was pretty painless. Just wanted to say a huge thankyou to Ell-enn for all her help and advice, you are a godsend. Good luck to everyone else going through the same thing and remembed there is always hope x

  4. Hi Ellen I have missed 6 payments in total. Yes I cleared all the arrears to the penny as at sept 2013, but along with my work restructuring and my back getting worse (I have a disc condition which means I have to take very strong painkillers and I'm not allowed to drive. My husband drives me to all my meetings etc which enables me to carry on working but does prevent him from getting another job ) I got into arrears again.
  5. Thankyou so much for your encouraging words above. It really means a lot to know that I'm not alone. 12 months ago I was completely up to date with the mortgage, and I had started tackling all debt that I had with everyone, but Council Tax baliffs came to the door and then Southern Electric wanted to cut me off. These 2 are now sorted (I am up to date with council tax and I have had pre-payment meters put in for my gas and electric). But because of my drop in wages, by the time I paid for these and kept my business going,I fell into arrears again (I owe £7100). Yes, I know robbing peter to pay paul, but being self-employed if I didn't keep the business going I would have nothing coming in. I can finally see light at the end of the tunnel, and whilst my last 12 months have been a huge struggle, my income will only improve over the next few months. I am in a position to pay the mortgage but I am concerned they will push for a high repayment off the arrears. Realistically I can only afford £75 per month but I'm worried this won't be acceptable. I do have over 16 years left on the mortgage. I have started to do my budget and started the N244, so hopefully Ellen will help me as soon as she can. Thanks again for your help and kind words.x

  7. Hi Back in 2012 Ascendon applied for and got an eviction date from a suspended repossesion order from 2008. I posted on here and thanks to Ellen's fantastic help and advice I attended court and the judge suspended the order again provided I paid the monthly mortgage and £300 per month. At the time this seemed realistic and affordable but Ascendon kept on making things very difficult for me. They wouldn't change the payment date despite me not getting paid until the 10th of every month and they insisted I phone up every time.However by sept 2013 I was completely up to date with the mortgage but my business has struggled over the last year (due to a restructure of the company I work for) and I've fallen behind with the mortgage again. They have now gone back to court and obtained another eviction date, set for Thursday 23rd October 2014. My questions are:- 1. How long does a repossession order last-as it seems to just sit there indefinately and as soon as I'm a couple of months behind they start proceedings again. They know I'm self-employed and they always get their money but they are so inflexible and keep adding on countless charges. 2.I never get noticed of when they go to court to obtain an eviction date-is this right ? I just find out from their solicitors letter, which by the time it arrived this time gave me 2 weeks notice. 3. I will fight again to get the eviction date suspended, but I can't remember what to put on the n244 etc (I lost all copies of my previous eviction when my house flooded) Can anyone help ? Thankyou
  8. Sorry just 1 more thing. On the way out of the court, the solicitor said "off course interest and charges will still go on this" so you'll need to find some capital to pay this off quickly. The judge took the amout owed today and divided by the amount I can pay and set the term at 16 months. However, Kensington are adding £150 in charges and interest, so I would get this clear withing the 16 months-what can I do ? Can I get Kensington interest and charges stopped or reduced ? Please can someone advise.
  9. Hi Just thought I'd update. I phoned the court yesturday and asked for an Emergency hearing for today. I told them the truth, as always, and said that I would be out of the country after Thursday. The court staff and process were brilliant and the judge ordered Kensington to accept what I was offering. So pressure is now off. However , whilst I was waiting to go in the Kensingston "Legal representative" spoke to me before the hearing as he said "he didn't have a clue" and if I could give him the facts that would speed the process up. All the way there I kept telling myself not to fall for it and not to answer his questions, BUT I did-truthfully and he concluded by saying-"I really sympathise-but my client wants their money NOW and won't accept anything less".He said he was sorry but on Monday I would lose my home. He got me so upset he actually reduced me to tears. (Which doesn't happen very often as I have to be the strong one). ANyway we went into the judge, who only confirmed my name and then spent the time discussing with this 12 year old legal bod. The judge did make it very clear that he was not on their side and they were being very unfair and that there was no way he would evict us based on this small amount (which reduced overnight by £3K-strangely). BUT what really got to me was the outright lies that this legal person told. At first I tried to answer, but the judge told me not to (which was very frustrating). Kensington's solicitor sat there and literally called me unreliable, with no provable income (I told him I could send him every piece of paper to back up what I said prior to the hearing). He said my husband was obviously a liability as he's lost his job 3 times . There were so many "made" up things from him and Kensington that I sat there opened mouthed ! However, thankfully the Judge I think saw through it , asked me what I could pay and then set that for 16 months.So yes all over for now, but how can these people get away with their bullying tactics ! Imagine if I had been much older, or seriously ill, they could cause irrepairable damage. Not to mention giving the leagl profession a bad name. Thanks for at least listening everyone x
  10. Hi Once again I find myself in a horrible situation. I last came on here to stop my Capstone repossessing my house and Ell-en was totally amazing with her advice. I spent one of the longest and worst days of my life in court but the judge suspended it and gave me longer to pay. That was 12 months ago and I've cleared £13k of arrears with £800 to go. However, and here's my new problem-despite tackling all my debts and clearing a fair few, Kensington (secured loan of £5000) have now got a repossession order and will evict us on monday 17th @12.45. Despite paying the loan for 2 years, with their charges added they say we owe over £9K ! My husband lost his job last November and has been off work since. I have been paying everything that I can myself and working 16 hours a day. He is now very depressed and quite frankly suicidal, so I can't discuss this with him ! After last time I know that I could get the N222 (?) from the court and apply for it to be suspended, but I don't have the time. I know that sounds crazy, but I have an all-day meeting for my business on Wednesday and from Thursday 9am until 7am Monday 17th I am actually out of the country. My employers have paid for myself and other managers to attend a conference in New York. If I don't go I will lose my job (as they have paid so much for my place). Although I work for 1 company, my position is classed as Sef-employed. So what can I do ? I know you're probably all thinking there's no choice I have to stay at home and deal with, but if I lose my job there really is no point. I am going to contact them again tomorow to see if they will accept a repayment plan, BUT when I tried to do this 6 weeks ago they kept asking for more information and didn't agree with my expenditure. eg) My phone bill is £98 per month (but that's for tv, telephone for house PLUS broadband, 2nd telephone for office as I work from home) Please help as I am worried sick. I basically have 2 free days to sort this out (but I don't know if I can ask the court for a specific date ?) Thankyou. Any help or advice would be fantastic.
  11. Hi Well I just got back. Only 3 cases listed, but mine was last and the others took nearly 1/2 an hour each. SPML's solicitor did approach me and wanted to talk, but I have to say that anyone listening would think he was working for me. He told me that SPML had already rejected what I had offered and would not except anything other than my soul, so I should stick with what I had put down. He even said the Judge always favoured people like me, so not to worry. He talked me through the process, gave me advice and told me not to worry !!!! Really strange !. Anyway, Ellen, you were right. The judge was more than happy to suspend the eviction as it was clear I had may significant payments for over 12 months and he was happy to set the arrears at £250 per month as there was more than enough time for it to be paid during the remainder of the mortgage. Their solicitor even told me that I should go back to court if my circumstances change and I need to have the extra payment reduced. The judge didn't speak to me once, and I felt a bit redundant !!! The only setback was the fact that they have cancelled my agreed payment date of 15th (after I get paid) and it has reverted back to the 1st of the month !! So I have to find the first payment before I get paid in October. Thankyou for all your help and support-I don't know how I would have got through the last wek without you
