  1. please help - what interest can be claimed on top of the charges. Debit interest? Overdraft interest? Contractual interest? etc. I know I can claim 8% sec 69 interest when I go to court (if). Is it best to just claim this interest.
  2. I need to amend my claim as the figures I claimed are wrong. My AQ has gone to the court already, but apparently I can amend. Do I have to fill in a new form, or just write a letter. Do I have to give a full explanation or just amend the necessary figures. My problem is understanding the interest. In my original claim, I included debit interest (which I assume is incorrect), so this portion has to be removed. I did make a note of the 8% sec 69 on the original claim form and know I can claim this if it goes to court. I haven't been able to master a spreadsheet but have seen your contractual thread today which looks easy!!!?? As I am against natwest would the APR be 29.6%. I have an unarranged rate of 2.19% p.m. effective annual 29.6% on Ad Gold Ac stmt. Would it be easier to just claim the charges only plus the 8% or is there an interest charge (contractual, compounded?? etc) that most people claim? When I amend, do I have to keep within the same date frame or can I add closer dates to the claim? sory for all the questions, it's just that I'm so close, I don't want to cock it all up with something wrong, that could probably be put right simply. many thanks

  4. thanks for your prompt reply! with your response, I assume debit interest of any kind cannot be reclaimed? Also, my claim of charges is up to September 06. If this goes well, or not as the case may be, can I make another claim for charges from September 06 to current time? Also, if my claim should fail, can a claim be repeated? ta again!
  5. can anybody advise plse? I had sent my claim to northampton with charges plus interest paid (I know this was wrong) total £2179 (should have been just 1501.00) I added the 8% sec.69 interest totalling 2930.00. / should have been 1501 +517.00 = 2018. The court was transferred to Birmingham, and to date I have got to the AQ stage and paid the £100. Cobbetts have now also submitted their AQ. They did make an goodwill gesture of £1100 with conditions of 'silence' which I rejected. They did insinuate that £1501 was the only charge I could claim and they feel my claim has no prospect of succeeding. They make a gesture of goodwill with a payment of £1100 on the basis that they deny any liability to me. They also state that the letter is written without prejudice save as to costs and should I decline the offer their letter will be brought to the Court's attention as their offer in their view is entirely reasonable in the circumstances. (in the circumstances seems confusing?) Should I send in an amended claim to the court before we get set a date with obviously the interest deducted (even though there are interest charges connected to the overdraft)? I have requested sight of my contract and also a reply to whether there has been any manual intervention on my account and if not, I would like this stated. This has been ignored so I faxed them last week for a response. Still nothing. Is this reply worth persuing? Many thanks - love your site - brilliant - definitely send contribution if get money back
  6. thanks for quick response! did not do a spreadsheet as couldn't download at the time - so did an itemised list from statements. The interest is what was actually taken from the account.

  8. Hi, glad to see you battling along with so many of us!! have sent all paperwork up to and including Allocation Questionnaire to court. Cobbetts responded to my decline of offer with a copy of their AQ sent to the Court, the day they got my response, so they got in to the court just in time!. Have heard nothing since, but did fax over a request for sight of my contract and also a response to my question, in my rejection letter of whether there had been any manual intervention on my account, and if not, I wanted a reply saying so. Nothing to date!!! SO maybe court for me!!
  9. Hi Marta I have just filled in all doc's chasing Nat West charges. Done the Online claim, had it defended by the Bank then got the dreaded Solicitos letter. Have responded to this 18/11/06 - had to be with them 20/11/06. Today 21/11/06 got an offer 'without prejudice' with a gagging clause if I were to accept. As you go through peoples replies, you will see that you never put 'without prejudice' on your letters or forms. This will disallow the paperwork to be used in court (should it go that far). My offer was for £1100.00 / my claim was £1501 charges plus interest charged £677 plus compounded interest over past 4 years £751. I don't think I'll accept. I'm going to be very brave and challenge them and send in my allocation questionnaire tomorrow with my next fee. Goog luck with your claim and I'm sure there will be somebody halping you all the way. ps I did find it useful looking at help from people specifically fighting Lloyds even though everybody's comments are useful. IS THERE ANYBODY THAT CAN COMMENT ON MY CLAIM. THE SOLICITORS SEEM TO BE JUST WORKING ON THE CHARGES FIGURE, NOT INCLUDING THE INTEREST CHARGES OR THE 8% CHARGES. i AM ENTITLED TO THE INTEREST CHARGES ACTUALLY CHARGED THROUGH MY STATEMENTS, OR DO I ONLY CLAIM THE 4YEAR 8% CHARGE??? hartleyhartley
  10. Can anybody give me information about reclaiming a payment made to a collection agency after the debt had apparently been 'sold' to them from HSBC. When we originally contacted them, they said they were collecting on behalf of HSBC. When we contacted HSBC, they told us the debt had been 'moved on' because they could not contact us over the past 5 years. They apparently sent 2 letters (after we had moved) in 2001, then nothing was done for 3 years. The debt was then passed on twice, finishing with the collection agency. When we went back to the agency, they were very threatening and told us they would send baliffs, etc and were really not willing to negotiate!. HSBC denied having any connection to this company, even though the collection agency emphasised HSBC at the beginning of their letter. Would a claim be worth pursuing?
