  1. I have read that and as it says no receiving documents would not count as a good enough reason. I want to reduce the payments, as I cannot afford these, thats why I sent in a n245. So I take it I must ask for a stay of proceedings. With bailiffs visiting tomorrow, they have already added fees for tomorrow, so I do not want anymore fees. They have also told me they will be going back to court for a warrant to force entry, if they cannot get in tomorrow, how long will this take.
  2. I changed a business I do not use to my other work address on companies house, as I was told they can force entry into a business premises if they think you have private belongings there. I use one of my cars for work, but I thought it was easier to hide it than try to prove it. and I would not know how to prove it anyway.
  3. Can I apply to set aside as I did send in a defense within the time limit. The court said they did not get it in time.
  4. I sent it the same day as the bailiff visited, I had already filled it in ready to go as I was 3 months in agrears. They have sent it back saying it is the wrong form. I need a n244 to stay a high court writ of control.
  5. No to my home address. I did have one business registered to my home address but I changed this today.
  6. Ok, I have had the n245 returned today by Bradford CountyForcourt, saying I need to fill in a n244 not a n245 as it is a high court writ. I have an appointment with my court on Friday 10.30. That is the earliest they can get me an appointment to file it. I have rang marstons and they say they are coming tomorrow to take my cars. Which are currently locked in someone elses warehouse. They say if they can't gain entry, they will go back to court for a warrant to enter. This debt is 5110, as they did not send me any bills for a number of years. I was defending but the court judged as they said they did not receive a defense. Or they received it too late. I was defending it as Severn Trent could not produce any bills only a list of amounts on a spreadsheet. Not sure what to put on the n244.

  8. I have just sorted out my council tax and I have now had a letter from marstons, saying they are coming with removal contractors on July 21st. This is for a CCJ to severn trent water. I was already aware I was behind with this and had filed a N245 for a variation, however when I phone Bradford County Court on Friday they said they were just about to deal with it. Do their officers have right of entry. Should I tell them that the N245 has be sent. There will not be any cars there and I will not be at home. But I don't want them to break in. I was under the impression they could not force entry.
  9. it does say in red bold typing that I have 31 days, is this perhaps because of my complaint. They are using the same bailiffs who were giving me 7 days last week and no payment plan. It is for last year, they haven't got a liability order for this years as I have been paying, usually late but still paying. The information I was given over the telephone was incorrect. When I queried by phone today, I was told "now we have your correct address we are able to give you the correct account information". What does that mean, they made it sound as if it was my fault that they did not have my correct home address or business address. I do feel sorry for whoevers door they have been knocking on.
  10. Yes, I am going to sort that out tomorrow afternoon as I am off work. What is worrying is how they went about all this, everyone around my business premises now know the details of this. I am sstill going to persue the data protection breach though.
  11. I didn't offer it because I didn't know about it. As I have stated I received no letters at home. I was unaware of it all until last week, when they sent the bailiff the wrong company address after me. It seems either the council or the bailiffs got the details wrong.
  12. Ok, the council have started the process of enforcement from scratch. It seems that they didn't just have the wrong details for my business address they had my wrong home address as well. And the amount was wrong. It is 1104, which is half the amount they told me last week. So today I have received a letter from the same bailiffs as visited last week, starting the process from scratch, with a letter saying i have 31 days to pay or contact them to arrange payment. After that they will start to visit and add charges. If I had this in the first place I would of offered them a payment plan of £200, but I didn't know about it until last week, with the final notice.
  13. That is what I was going to do, as soon as I have confirmation from the council that it has been returned to them. I am going to pay £50 a week on their payment site if they do not accept a repayment plan.

  15. Exact wording of letter received. The exact wording of the letter is this Final Notice: Council Tax Arrears An Enforcement Agent (bailiff) has visited you home again today. Your possessions are now at risk of being REMOVED. Despite numver attempts to contact you we have still not received satisfactory response about you Council Tax Arrears An Enforcement Agent (bailiff) has visited you home again today to take control of your goods and remove them for sale. If you debt is not settled within 7 days of the date above, we will return your case with one of the following recommendations Attachment of Earnings - taking the funds from you at source Bankrupcy - this will affect your credit rating Charging order on your property - your could be forced to sell you home Commital - you could go to prison FAILURE TO CONTACT US WILL BE TAKEN AS YOUR REFUSAL TO PAY. They did not visit my home that day and did not leave a copy of this letter at my home address.
  16. Yes this was the first letter I have received. Sorry I must of made a typo in my first post, where to letter said balance owed, it was letf blank as was the date. I says nothing about not being able to levy. I will find my previous post and copy it in after I post this. Everything else is right, i think. Except the fact that the letter was not addressed to my company it was addressed to a company around the corner from me.
  17. The council are aware of my earnings as I applied for help with my council tax late last year, which they said I was entitled to, but my self employed earnings made it very difficult and it went on and on, with me keep sending information over and over again. Eventually I gave up.
  18. Please note this debt will only just be in the process of being sent back to the council, so No, it has not yet gone to a third enforcement firm

A letter was sent last week, saying the account was being sent back to the council within 7 days, I rang the council iniially to complain about them sending letters to the wrong company, they told me they had gone for another liability order for this years council tax as well and that it would go out to another enforcement company. They refused let me make a repayment plan with them.
  20. Yes I am, as the Director pay goes through PAYE, but other invoiced duties do not. As the other invoiced items are maintainance and the administration of building renovation, they do not come under the duties as part of my role as a director, and have to be invoiced and declared on a tax return. Please note I was visited May 2014 by HMRC, who checked this and agreed that this was correctly done. These duties would normally be carried out by a private contractor. I also occasionally have to invoice part of the electrical work done to the owner of the building, this work is carried out by me, not my limited company and again has to be declared on a tax return. This is all done by an accountant.
  21. I have never said I am a sole trader, I stated my company was a limited company. It was someone else who suggested Ii was a sole trader. Please let me know where you think I said that. I stated my company was limited with 2 directors. If you read my posts you will see from the beginning that my problem was that I did not receive any notices at home. They council didn't even get my correct business address, so I nearly didn't get this one.
