  1. Hi logbook. did they look at your car when you took the loan out. also you have posted your hpi check. and it is listed as a chattle morgage. can you post your agreement up ???

     

    a memorandum agreement is just like a bill of sale except no court has to stamp it. either party can stop the agreement at any time with full payment or collection of goods listed on the agreement. in your case your car. but unlike a bill of sale the amount on the agreement is the loan amount ..... no stupid interest.

  2. if you are the original person on the bill of sale then no court order is needed as signed on the bill of sale...... a court order is only needed if you have stored your car at another location other than the address on the bill of sale or if the car has been sold onto a third party.

     

     

    CCTV, I do not have any Bill of sale attached to my car which LBL cofirmed today. They gave me a hire purchase agreement as an alternative, as per my other post have u ever heard of a memorandum of delivery as this is what they claim gives the the legal right to take thecar without any order etc

    My parents had a visit today from a dodgy representative and seemingly his wife looking for my car to repo.

     

    I called the guy as he left his number and he pretty much admitted that he cant take it from a private driveway but if it hits the public road then he will snap it up quickly even although he doesnt even have a court order. Well he cant get a court order cos it wouldnt be granted in SCotland!!!

     

    He says he will visit several times and report bk to LBL. I told him good luck in his endevours but no way jose are they getting my car. He claims the DONT need a court order which is lies although im fully aware they will take it if they get a chance.

     

    The car is far far away and is secure but can any1 give me any kind of advice and also does any1 know a lawyer who specialises in this field ??

    Sorry to be more of a pain but more advice on the following.

     

    Done an hpi check on my car which throws up a "chattel mortgage" with logbook loans but I have found that a chattel mortgage isnt valid in Scotland.

     

    Here is the info and any advice going forward would be appreciated:

    Now if this is classified as a chattel mortgage,I found the following statement on IFS Financial

     

    Chattel Mortgages

    A chattel mortgage is a type of fixed charge taken over identifiable and moveable assets such as plant and machinery. Chattels are defined as any property other than freehold land. Chattel mortgages are normally only available if the customer is a corporate body in England and Wales (Scotland does not recognize them except for ships or aircraft).

    thanks for replying.

     

    I actually dont have a bill of sale, its a hire purchase agreement I have with them.

     

    Will it definitely show if I do an hpi check as I called trading standards and she says as far as she is concerned its not a legal document and they need a court order in scotland which they wont get. I appreciate they just take it anyway but I would rather sell to an "innocent" party which means someone has a new car with no ties and I can deal with this **** by making a payment plan offer or something.

    I have a question and would appreciate that only if you know the answer factually that you please reply.

     

    In Scotland, if you are an innocent purchaser of a vehicle with a hire purchase agreement (as my car has with LBL), then you will remain the owner regardless of whether finance is on it.

     

    Does any1 know if u sell a car to webuyanycar, if the lbl actully shows up in any checks that they would do.

     

    Even although they are still able to keep the car if they purchase with HP in scotland, is there some kind of check I can personaly do on my vehicle to establish whether there is any info on it that LBL would have applied to it?

    I am a young guy in Scotland wth about 25 grand of unsercured debt plus many many payday loans spiralling out of control on interest.

     

    Basically, I need out of this rut. I want to go bankrupt and wondered how it actually works in Scotland.

     

    I earn around 1100 basic salary excluding bonus and I can easily demonstrate that this is gone in a flash without even paying any debt due to rent, fuel etc etc etc.

     

    I hear you go bankrupt but still within the 1s yr you may owe money back if u make extra etc,

     

    Can any1 atall explain how this works and wot youthink my best option may be?

    good to have your input, you seem like the man in the know on this forum in relation to lbl.

     

    yes, i got the loan secured against the car, before any1 starts, save me the lecture. I know what i have done wrong but my priority is to fight to try and gain control of situation. can any1 answer questions on my 1st post?

    Just found all paperwork received at time at cash generators meeting.

     

    I have 2 documents, a "hire purchase agreement regulated by tge consumer creditact 1974 - this is 2 pages

     

    I have a "sale agreement" which is many many pages, about 12 roughly.

     

    I dont have these bill of sale that people have been mentioning which is strange.

    I got a letter advising 16 days final demand to pay or else..

     

    Im in scotland, im waiting on trading standards to get back (who will prob be useless) and also going to solicitor tomorrow.

     

    have a few questions at my stage, basically, how quick are they likely to be at my door, ie tmrro. Here is the questions I would be please if people can answer, remember i live in Scotland just incase this changes things...

     

    What is their process, will the knock my door or will I look out ewindow one morning and it will be gone (they have my spare key)

     

    I dont have garage or drive to hide it, if I hide it a few streets away,what do they normally do, do they search the area or if it aint at premises move on, or do they perhaps wait about outside and stuff?

     

    What can I demand to see for them to take care,I know I hae heard loads about things being invalid in scotland?

     

    what false threats can they give me if they cant find car and chap door, can the police make me tell them where it is?

    I would really appreciate any help like you would never imagine.

     

    basically, I stupidly got a logbook loan 5 months ago but have only managed to pay them a few hundred pounds.

     

    Someone mentioned that bill of sales arent valid in scotland. I have received a letter from them saying final demand - 16 day to pay.

     

    If I dont pay they will seize my car.

     

     

    My initial question is very simple, if I sell my car to webuyanycar.com , will this transaction go through or will they know I owe logbook money on it.

     

    Im really depressed thru this and any help is much much appreciated.
