I also missed this sad news, Docman helped me with my case against Nationwide,even meeting up with me before my day at county court, he put my mind at ease, and could not thank him enough RIP Docman.

Its now 3 years and have not received anything until today, a letter from Nationwide saying they believe i have been mis-sold Credit Card Payment Protection, any thoughts on what i shoud do?

my wife has received a (judgement for claimant -after determination) from northampton county court, the debt is £3640.50 and they asking for payment in full or installments of £1094.05 monthly, my wife only earns around £1500 per month and i earn around £1800 per month after all outgoings we are left with around £150, so the amount asked for would put us in serious financial difficulties ,i.e not paying any motgage + other bill for 3 months, is there anyone out there who can give some good advice quickly,thanks in advance

Good call again Docman, about the appeal,got the following letter from Nationwide Group Legal Solicitor today NATIONWIDE BUILDING SOCIETY-v-JIMARICH We refer to the above matter and the hearing heard on the 16th March 2011 We wish to inform you that we are considering appealing the decision of the District Judge. We have requested a transcript of the hearing and will in all likelihood serve documents in relation to the appeal in the next few weeks. yours faithfully Nationwide Solicitor

Judge dismissed the case due to: The requirement of section 87 of the Act is that a Default Notice is issued BEFORE the claimant can take the steps outlined in the section. The section does not state the Default Notice can be issued AFTER action or at A DATE IN THE FUTURE or more particularly WHEN THE CLAIMANTS SOLICITOR HAS REALISED THERE IS A FATAL ERROR IN THE PARTICULARS OF CLAIM. The claimant has admitted in the Amended Particulars of Claim that the Default Notice was issued after they had terminated and so therefore they are not entitled to bring the claim in the first place. Nationwide solictor told me that they would be putting in a new claim asap.. Round One to us.
