  1. Blackhorse are going to have a very bad day thanks to the Data Protection Technical Guidance Filing defaults with credit reference agencies (The definition of a default)
  2. FIGHT AND WIN 1 REF-Black Horse Ltd /Account number XXXX/Loan/(Defaulted 02/2009)Start date 03/2004/Last know payment was round July 2005 /When will this account drop off my credit file eg 6 years from the default date or 6 year from the last payment made. Thank you for getting in touch. 1.Credit agreement information remains on your credit report for a period of six years from the date that the account was settled or defaulted, whichever occurs first. It appears on your report that the default date of your Black Horse Ltd account was on ##/##/2009, so the account will be removed from your credit report after six years from this date. 2 .I dispute that they can add a default after 4 years of non payments this is illegal. Equifax you know you can only hold account info that is negitave for (6 years)eg Law relating to debts: statute-barred debts/ this will start from the last payment made to the account not the default date that they have added, please (confirm what date you will be removing this data account from you files )as i wish to pass this account data and the way you are trying to fob me off to the information commision office and make a severe dispute 3.Data Protection Technical Guidance Filing defaults with credit reference agencies Accounts should normally be filed as being in default where those payments due have not been received for six months !!!NOT AFTER 4 YEARS CHANGE THE DEFAULT DATE TO SIX MONTHS AFTER THE LAST PATMENT MADE. Information Commissioner 4.LLOYDS A total of 5 default notices have been sent over a period of 12 months to the customer, the most recent being September 2006, therefore this will be the correct default date which has been updated on databases today. 5.Read the Data Protection Technical Guidance maximium 6 months of last payment make.September 2006 that is still incorrect i am passing my finding on to the ico have a nice day. 6.The company has investigated your query and have advised Equifax that the information is correct and should remain unchanged. Black Horse Ltd has advised us that the correct default date on this account is ##/09/2006. This information is supplied by the company and we are unable to amend it without their permission. We suggest that you contact the company directly if you need further information. 7.The default date should be around November 2005 Lloyds please confirm the last payment date that is showing on your records Then add six month's and that is the correct default that should be showing on this dispute 8.Black Horse Ltd has advised us that the correct default date on this account is ##/09/2006 9.Lloyds so you are saying the last payment made that is showing on your records is 03/2006 i dispute that date Lloyds please confirm the last payment date that is showing on your records this information will clear up this dispute 10.five default notices were sent to cust between june 05 and sept 06. Default date of ##.9.06 is correctly recorded last payment received was £####on ## May 2005 11.Lloyds said Last payment received was on the ## May 2005 THE CORRECT DEFAULT DATE SHOULD BE THE (## NOVEMBER 2005) REF lloyds needs to read (((((((((Data Protection Technical Guidance 2010))))))))))) Filing defaults with credit reference agencies (The definition of a default) 9 A ‘default’ can be said to occur as soon as a borrower fails to meet the terms of their credit arrangement. However, adopting this definition for credit referencing purposes would create difficulties since it is accepted that not all these defaults should be reported, for example, where weekly payments are late but are quickly remedied. Accounts should not be routinely filed as being in default where full payments or those due under a rescheduled agreement are fewer than three consecutive months in arrears. • Accounts should be filed as being in default where those payments due have not been received for six months. You must show the correct default date now or this info will be passed on the information commissioner office stating that you are not complying with the Data Protection Technical Guidance 2010 ref to Filing defaults with credit reference agencies with the time scale stated. 12.##/9/06 default date (does not comply) with the Data Protection Technical Guidance ref Filing defaults with credit reference agencies 13.LLOYDS SAID DEFAULT SENT Between June 2005 -----! Bylaw you can only default an account once,so the default in JUNE 2005 THE FIRST DEFAULT IS THE CORRECT ONE THAT YOU SHOULD BE SHOWING ON THIS CREDIT FILE not the last one. 14.Thank you for getting in touch. Black Horse Ltd ####### The company has investigated your query and have advised Equifax that the information is correct and should remain unchanged. This information is supplied by the company and we are unable to amend it without their permission. We suggest that you contact the company directly if you need further information. You will notice that there are two tables in the Previous Searches Section Table 1: (Credit Searches and Outstanding Debt Searches): Any Searches appearing in this table are viewable by Lenders and the number of searches recorded can affect your Credit Score. • Credit Searches remain on Report for 12 months but only affect your Credit History for the first 6 months. • Outstanding Debt searches remain in your Report for 2 years and affect your Credit History for that length of time.
