  1. Thanks for that. I could resist sending him that., I also asked if this act of god prevents me from paying rent for the unit is that ok aswell ? i should really let it drop now but i would like to know what response if any i get back from that.
  2. Just recieved this reply back from the site manager. Hi Paul I am sorry but we will not be offering compensation for this as it was an “Act of God” and therefore out of our control. I would refer you to Clause 21 of our Licence Agreement 21. FORCE MAJEURE The Licensor (Bizspace) shall not be liable for any loss or damage which the Licensee (Tenant) suffers as a direct or indirect result of the performance of this Licence being prevented hindered or delayed by reason of any act of God riot strike or lockout trade dispute or labour disturbance accident breakdown of plant or machinery fire flood difficulty in obtaining workmen materials or transport electrical power failures or other circumstances whatsoever outside its control and which affect the provision by the Licensor of access to or use of the Space. I sent a repy asking how can it be an act of god when the archway of the gates been moving since the middle of december and that the site was built in the late 1800's. Dont you think this has more to do with it ? And even so we should have been informed. Should i just accept it or should i carry on fighting this or just put it down to experience ?
  3. Thanks for your wise words mariner51. I totally agree with what your saying. Somthing has been wrong with the gate since the middle of december so i cant understand why it was left until after the xmas holidays to do somthing about it. I agree it could have been alot worse but i have had nothing but problems from this company since day 1 and been treated appallingly by them. Since the new site manager has taken over last year things have improved slightly. The things that really grates me up is that they dont even care about what effect it has on your whole life. Im still thinking of writing to the MD. I wrote to him before when i was treat like a dog and he sorted things out for me. Its the way they conveniently ignore your emails and fob you off that gets to me. Alot of people are leaving the site due to this. my lease runs out this year and if i can find a unit around the same price ill be off like a shot.
  4. Just as i thought i havnt had any response from the site manager after i sent an email asking what he intends to do about the losses caused by the above. Ive sent him another email asking again what does he intend to do and how would he feel if it happened to him. I doubt ill get a reply and if i do it will probably just be another fob off. Im thinking of writing to the company director or going to the news paper. Can anyone advise on what i should do next? Thanks in advance.
  5. Thank you for your repy. I went down today and spoke with the on site warden and it turns out he didnt even know they were coming to attatch this beam. He has given me an alternative entrance to use whilst its fixed and said it will be fixed in the next few days. I wrote an email to the site manager asking what does he intend to do about my loss of earnings and i received this reply " Hi Paul I am sorry that you weren’t notified and for any inconvenience but unfortunately we had no alternative but to secure the main gate as it was damaged by the wind just prior to Christmas and we were unable to get it fixed over the holiday period. Work has already started on the repairs and should be complete within a couple of days. In the meantime if you can contact the onsite warden, he will arrange alternative short term access. Thanks & Regards I replied saying i have already done so but what was he going to do to compensate for my losses because of this. I even suggested some ideas like a small discount or free electric for 2 weeks. I am still awaiting a reply. By the way whats LL i dont have any insurance for loss of earnings unfortunatly.
  6. Please Help! Yesterday evening i came to my unit ( which i have been in for 2 yrs) to restart working after the xmas break only to find the main gate to the site had a big steel beam across it and a sign saying " Do not open gate, unsafe" I was never told or informed about this by anyone and as a result i have lost earnings (which are badly needed after 2 weeks of not earing a penny) Also my customers and myself made the effort to get to my unit only to find out it was a journey wasted. I am deeply worried, i am self employed and have not earned any money over the xmas holiday period. i desperatly need to get back to working but cannot if i cant even acess my unit. My business is/was supposed to resume back to normal from yesterday. I have customers arriving at various times almost everyday. I have also done a large advertising campain to bring in new custom. I also have other projects that need attention asap, not to mention to loss of custom if they turn up and see that the site is unacessable. What can i do about this ? I have emailed the manager expaining the above. My business is my living and i have my wife and 6 month old son to support. Please help ! Thank you in advance.
  7. Can anyone please advise ? I have been renting a unit for 18 months now and since i first started renting its had a leak in the roof. I have been asking almost every month and i keep getting told it will be fixed in a few weeks but we have no specific date. I have logged every email about this and all other past problems ive experienced. It was fixed over a year ago but it started leaking a couple of months after and has sprung a leak in another place. This has caused me alot of stress not to mention loss of earings and damage to some of my equipment. I recently recieved my rent/licience renewel and to my shock they want to raise it by £60 per year and are asking for another £30 deposit. This may not seem alot to some but to me and my wife it is yet another increase plus i have have been paying rent for a unit that is not in full working condition. I have wrote to the site manager over the weekend expressing i am not happy with the rise and how can they expect me to pay more when the roofs still leaking but i still have not had any reply. My next step will be to write to the regional manager and expain as i have done before and to his credit he has helped in the past. I dont know where else to turn if they raise the rent. Whats most upsetting is that our first childs due anytime now and this silly issue is on my mind. Can anyone please advise on what i can do ? Any help on this would be much appriciated. Many thanks in advance.
  8. Went to see the landlord and to my great surprize he was very understanding and said i do not owe anything other than the rent every month. Everything sorted now. Sop happy.
  9. I accidently came accross this forum so i thought id ask for abit of advice. To cut a long story short i recently signed a 6 month contract for a unit to run my business out of. The lease was contracted to start on 1st of feb. The land lord also said that he would make the unit usable e.g paint it etc. Because we agreed the 1st of feb i left my old premises to start at the new one. When the time came the landlord said would i mind waiting unitl 1st of march to move in as they still hadnt fixed the unit up and they had found a small leak in the roof. I told the landlord i could not wait as i had no where to run my business. Again without going into loads of detial it took the land lord 2 months to repair the leaking roof. He also kept fobbing me off about painting the unit. I asked for rent discount unitl the unit was finished as i couldnt run my busniess from there and the landlord again kept fobbing me off saying that if/when i came to renew the lease he would credit me the rent i paid back. Im the mean time i couldnt pay my houshold bills and had to borrow the money. The land lord said he would get the unit painted for me and when he said he had finished painting all that he had painted was the floor (which didnt even need doing) I told the landlord that if he bought the paint i would finish it off myself. Which i did. I told him due to this i still couldnt afford to pay rent yet, he never said anything aprart from cancel your direct debit for a month. I did that a few weeks later i then receive a phone call from his secretary whist whe was on holiday saying if i didnt pay anyrent i would be evicted so i rounded up some money to pay the rent. I contacted the landlord to say i can now pay rent could i set up the direct debit again and he said my account currently has some arrears on it and once they were credited we could set it up again but he said to come and pay the rent in person. I have all emails between me and the landlord and i also have photgraphic evidence of the state of the unit. he also said that he will credit me somthing when i renew the lease but he is never clear with his intentions. Im wanting to know when he said there are arrears that need crediting does he mean he will credit the account as he hasnt sent me any letters saying i owe anything apart from the rent for this month which i expected anyway. This has caused so much stress and loss to me and my family i cant take anymore.
