  1. In December 2006, bought a SONY Mp3 player in Comet. Cost was £39.99 In September, it stopped working - the display was blank, and no sound either. They insisted sending it away to, they claim, Sony for repair or authority to replace. Last week, they finally advised me that the unit has been damaged due to water damage, and will not be replaced or repaired. Firstly, it's not been near water, so how they can claim that I dont know. Secondly, they now want to charge me £32 to post it back to me faulty. They flatly refuse to now refund the purchase price, or replace with an equivalent model - even at the same or cheaper price. Any ideas on what I should do next ? Thanks Jon
  2. As I understand it, searches usually stay on file for 6 months - they did with my file with Equifax. I agree with the other replies - you must now ensure you keep all your payments up to date - do this for 6 months and your credit score will recover... I have been through the multiple search issue myself !

    I wrote back to steve Bailey on 14 August, giving him 14 days to reconsider the position. As of today I haven't heard anything back from them. (18 days). So, I have the claim ready to file - but will contact the Customer Advocate office first, to see if there is any last minute offer on the table. Otherwise another MCOL will be filed !

  5. I just received my next statement. They credited the full amount owing, and the balance is NIL, except that their system then added a Late Payment fee (now £12) because no payments were received. The credits were shown as Refunds not payments. Doh.... I have written to them asking them to sort this out, and confirm the account is closed, so I can close the matter with them... I await their response.

    OK, thanks for that. I have drafted the claim, wording below: I will recalculate figures for the day I actually submit it which will either be middle this week, or at the expiry of my original deadline. I guess I need to forward a copy of my schedule, complete with interest calculations to FD's legal dept. Do the court need a copy too ?? However, concerning my original timescale, FD have yet again responded negatively to my final letter, and say the only course of action is for me to report to the ombundsman..... so I feel confident in issuing the claim without waiting for the original timescale to expire. Court costs are indeed £250 according to Moneyclaim, as it's over £5000.

    In response to my "LBA" sent to FD on 14 August, I have now received a reply from Robert Kernaghan. It is the standard referral to the ombundsman, which he hopes I won't find necessary. Next action will be a court claim, but I am worried about the amount I am claiming: Charges claimed: 4681.50 S69 Interest: 1278.21 Total 5959.71 The total is over the Small Claims limit - which means it may be allocated to fast track. Up to now, most (all ?) of the First Direct / HSBC settlements we have heard of were due to commercial reasons under the small claims regime of no costs being awarded. Has anyone claimed more than £5000 successfully ? Should I ignore the interest !! (I don't want to). Is the total value of the claim or just the exc of interest value used when deciding which track to assign the claim to ? Thanks

    The points raised in their letter are: First Direct does not agree that the charges are unlawful The T&C you agreed to said we would charge xxx for going overdrawn/returned dd etc We are unable to agree to your request. If you wish to escalate please write to Robert Kernaghan (which I did) If they don't hear from me within 8 weeks they will close the "complaint" So, it looks like nothing more will happen unless I write back to them.

    I sent my request for refund of charges, directly to Robert Kernaghan at FD, on 9 Aug. I have today received a reply from Steve Smithard, in which he states the usual "fd does not agree with you....." Advising me to write to Robert Kernaghan if I wish to escalate. It seems like they are on the ball at the moment, as this reply was turned around in a couple of days. Any suggestions as to what to do next ? Should I wait for 14 days ?, or write an LBA now, as their reply seems fairly definate.

    I chased up MBNA last week, and have now received a "final offer" letter from Steve Bailey. They still claim their charges are fair, yet also tell me how they have reduced them to the OFT suggested £12......and refer me to the OFT information. Again, a standard reply, because I already brought this to their attention. They have credited my account with £510 as final settlement, which seems a common ploy according to threads here. The funny bit of the letter, which is obviously a template, is that they say that I am such a good customer, and value my custom....which is not possible because the account was suspended by them 3 years ago. Rather than issuing the Moneyclaim straight away, I plan to call them on Monday and see what I can get them to do. If that fails, I plan on issuing the claim.
  13. Received full settlement offer by letter on 8th, sent a reply and spoke to them yesterday. I owe a bit more on the card, than the settlement offer was for, and they wouldn't send me a cheque, but did agree to cancel the account and clear all the outstanding money instead. So, one less debt to worry about, but no cash-in-hand. Can't have it both ways I suppose. Thanks to all who have helped.
  14. OK, I wrote back reminding them of my timetable, and accepting the £500 as part payment of the amount due. No response heard today, so I will be filing my claim shortly.
