  1. we have not moved and cannot understand why we are requested for further IUC fm another council. All the letter states is that undersigned will conduct interview on behalf of our Council.

  3. I hv supplied the council with the MOU which is signed by my father solicitors as well as a witness. They are wanting us to repay all benefits incl HB/CTB and IS from even before we occupied the house as they claim that the property was purchased in 2003 but we only moved into it in 2009. However they claim that since our names are on the property deed then we had enough funds abv the threshold at time the property was ppurchased. Thrfore we hv to repay all benefits dated back to 2003 despite us living in another house
  4. Forgot to mention that the reason we did not disclose abt our names being mentioned on property title was because we did not have any financial benefit from the property. This is a major error on our part. Any ideas. Reallt streesd and in need of help
  5. I recvd a letter from the Council for IUC a year ago, after receiving letter stating that they suspected that I did not disclose change in circumstances whilst claiming HB/CTB and IS. The problems starts from my father including me on Title Deed for a property he purchased. My father never informed me when was was purchasing the property nor were we informed that he had inserted my name and my wifes name on the Title Deed. We were only informed after all formalities were completed. We signed an MOU with him stating that our names are only on the property to enable us look after his interests. This was because my father lives overseas. We have no financial gain from the property nor do we have any right to sell the property or a share of the property. We never provided any monies to facilitate my father purchase the house. 2 years ago, we moved into this property on rent at a subsidised rental charge as father felt that we would be more comfortable since my daughter is a special needs child he felt that this would assist us as the property is more suitable for her. We have not recvd any HB at this property and Council now requesting us to pay back any HB/CTB and IS from our previous residence since they say that we had sufficient capital [otherwise would not be able to afford to have this house] and therefore do not qualify for the benefits. We have not paid any rent to my father and he is pretty upset about all of this but understanding at the same time however he does need income for the investment that he had made. We attended the IUC and after several months they stated that they stand by the decision and sent an invoice to settle payment. We have put in an appeal and awaiting whether the Tribunal will accept the hearing. In the mean time, we have recvd a letter for further IUC from another council that will conduct the interview on behalf of our local council. I really do not know what to do, my relationship with my wife has taken a downturn since the allegation. Our daughter who is a special needs child with a rare degenerative disorder has become a secondary problem and we have prioritised our Council problem. She has to undergo a spinal op soon but we are unable to take good care of her as we are under enormus mental and physical strain to resolve this problem. We do hv legal help through legal aid. I am not sure what will happen if we are prosecuted and feel liek telling them that we have had enough and that we are ready to back all amounts and fines to close the matter. This would assist is in payign attention to our major concern of our daughter. It is more important for us to look after our daughter and give her a comfortable life as possible, money is secondary even if I have to get into major debts and loans. My family and more importantly my daughter is much much more important. However the only reason we are nto doing this is because we feel the matter will come to haunt us in the future. We are going thru unexplainable emotional trauma and seems like the council are only interested in refund, fines and prosecution, thereby willgotoany lengths and bully us into accepting. Please help.
  6. is anyone able to advise whether we can secure copy of tape from interview under caution. We have submitted our case to tribunal for appeal and have not heard from them yet. However a year after our Interview Under Caution they ar enow requesting for further Inetrview Under Caution and to be done by a completely different Council on behalf of our council.
