  1. Success!!! Had a phone call today from Capital One. They have cleared her balance and closed the account. We have decided not to push it and ask for a refund on the money she already paid we're just grateful it's all over and she won't be getting any more phone calls.
  2. Mine was registered post and guaranteed to get there ( and be signed for) on Mon March 8th. My old lady received two letters today one from Director of Collections telling her they were closing the account("Yay"), that they were blacklisting her credit rating ( like she cares! she's 78 for god's sake, she doesn't need HP) and that they may sell the account to a debt collection agency (don't think this is legal as she is disputing the account). The other letter was from Debitas requesting the balance, Cap One certainly don't hang about. However I have heard nothing from their legal team and have decided to photocopy and forward the original CCA request letter stating how it was sent and that the last two letters are not enforceable due to the previous letter stating that the account was in dispute. Now I shall have to wait and see what happens.

I'm about to send a CCA to Capital One and rather than send it to the Customer Contact Response Department as advised by their telephone operator, I have decided to send it to the following address as there is no PO Box No. and will go hopefully straight to the relevant department. What do you think? The address is Legal Compliance Specialist Capital One Bank (Europe) plc Trent House Station street Nottingham NG2 3HX I believe this address deals will information held by the Data Protection Act. Was also thinking of sending copies to the PO Box no just to cover all wickets so to speak.
  4. Thank you for your reply it has been most helpful. I don't think the amount has anything to do with annual fees as I am sure the amount owing would have been a lot more considering she has had the card since 2004 what statements I have found have been made up of penalty charges an minute amount of interest eg. 20 odd p. She actually sent the a cheque for £30 in September to pay the account off I believe the cheque arrived too late and she incurred another penalty charge which through that and interest has amounted to the £60 she owes today curiously I have found no evidence of the cheque payment on her statements even though the cheque was cashed, and one other disturbing thing is she insists she never filled in an application form for this card it merely arrived in the post one day addressed to her which she duly put in a drawer and forgot about, so I definately want to see evidence of an application form or consent form. However I am going to forward an authorisation letter, a letter of complaint regarding their practices and a subject access request pending legal representation and hopefully we will get some response. I am hoping the small amount might encourage them to write the debt off rather than taking it further.
  5. Could someone help me with this situation. I look after a disabled seventy eight year old lady who applied for a capital one card some years ago. According to her she has never used this card ever however Capital One are now chasing her for money which appears to be penalty charges. the total is only a small sum approx £65 but to her it is a fortune and as I have said she has never used the card which expires in 2008. She continuously has calls from them and has recently received a letter threatening her with bailiffs. I can't understand why they should put interest and penalty charges onto an account that has no purchases unless it is an annual fee but given the amount it seems unlikely. I have offered to phone them on her behalf to try to sort this matter (hopefully armed with legal/consumer advice )and want to request a copy of the original transaction. Unfortunately this process has gone on so long because she forgot about the card and threw most of the earlier statements away thinking it was just junk mail.
