  1. Letter recieved today dated 3rd October. I won't bore you with all the details.....bascially they have now offered me £241!!!!!!!!!! I've got my charges back!!!! Yeah Woooooh (Chica dances round the kitchen!!!!) The acceptance form they want me to sign reads as: In Full and Final Settlement, I.....of.......confirm that I accept the offer of £241 form Halifax/Bank of Scotland in full and final settlement of my complaint regarding Credit Card charges on any of my Halifax/Bank of Scotland Credit Card account. This will be paid into my Halifax/Bank of Scotland credit card account only. Signed me!! Do I sign this or is there another form I should us? Should I go for the default notice now? Advise please. A very happy Chica.
  2. Yep but I don't have the cash at the mo to file the court claim. Have just done so for the Abbey and that cost me £120!!! That i don't really have!!! When the Abbey have settled I will be starting the claims for halifax and capital one.
  3. Have recieved another letter from the Halifax offered me £148 which is half what I am claiming. Sending rejection letter.

  6. I have a contract with the bank dated Nov 2004 and which is conducted on their standard terms and conditions. I am claiming the return of money taken by the Abbey in the way of charges over the last 2 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law.Further,as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2 (1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have repeatedly asked the bank to justify their charges but they have declined to do so. I am claiming interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 21 Mar 2005 to 15 Sept 2006 of £108.25 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 0.42p. Hi Guys. With regards to the wording above, I am trying to file my claim online but it tells me I have too many lines. Only allowed 24 apparetnly. Is there anyway I can shorten this without taking the important stuff out??? Thanks

  12. Hiya Update: Letter recieved today from Capital One dated 29 August 2006. Basically saying that they are reducing their fees to £12 in view of the recent OFT report. They have therefore offered me £190 back which is the difference between their fees and the new £12 fees. My claim is for £489 so I will accept as part payment and continue for the extra. Will keep you updated!! Chica
  13. Thanks for all your help with the dodgy car issue. I spoke to him nicely and he gave me £100 extra of the price of the car so only paid £150 for it. I have since sold it to a friend of a friend whoo knew exactly what condition it was in and exactly how much it would cost. He's a mechanic anyway so cheap labour at least!!!
  14. You only have to pay £10 for all your statements under the SAR. Use the template in the letters section. Send a cheque or postal order. They will most prob not cash it. If they do you claim it back at the end when you are filing your court case. No way would I pay £720 for 6 years bank statments!!

The Bank belives it is fair to pass these costs onto the accounts affected, rather than absorb them into other areas of the otrganisation, penalising all our other customers as a result. HBOS clearly outlines our charging policy in the Terms and Conditions that apply to your account. In addition we are committed to complying with the Banking Code, which sets out standards of good banking practice for banks and building societies follow when dealing with personal customers. To demonstrate our commitment to you as a valued customer I am prepared to offer you a refund of charges to the value of £75 representing half the amount of charges applied to your account within the calender year Jan 04 to Jan 05. If this is agreeable to you please sign and return the enclosed acceptance form to allow us to complete the refund to your account. I trust this resloves the matter for you. Should I not hear form you within the next eight weeks, I will close my file on this matter.   18. The main thing I'm peeded off about is that I was informed it had failed on 3 or 4 things which would cost me £150ish. Turns out it needs nearly everything doing to it at a cost of £450. Can I do anything about false information maybe??

  22. Bought a car from a colleague at work. Its his dads car and he was just organising it. The deal was £500, he would MOT and I would tax. MOT ran out a few days ago and tax end of month. His dad took it for an MOT and it failed. I was told on 3 things costing around £150. The deal then changed to a) Full price, he gets it fixed but charges me for the repairs b) Half price and I do the repairs or c) No deal. I chose b. So paid him £250 cash and signed a reciept saying bought as seen, no MOT and car tax runs out end of month. Took it to my garage to be repaires, will cost £450.Because it needs nearly everything doing to it. Brakes front and back, loads of welding, etc etc. Basically completly unroadworthy. I obviously don't want to spend £450 on a £250 car, because not only do I not have it really it's also not worth it. Whats my position? Where do I stand? Have I been stiffed? Any ideas folks??   23. Mods,feel free to move this if its in the wrong place. Basically, I arranged to by a colleague from work's dad's car for £500. He was going to MOT it and I was going to tax(runs out this month). MOT expired 22/08/06. It went for it's MOT yesterday and failed, so the deal changed to a) Pay full price, bloke gets it MOT and I pay for the repairs b) Pay half price and I sort out repairs or c) No deal. I chose option B. The colleage said his dad reckoned about 3150 for the repairs. So I bought the car, gave his dad the £250 and signed a recipet saying bought as sold, no MOT, car tax to run out this month. I took it to my garage today only to be told £450 for repairs as needs loads doing to it to pass MOT. I was told it failed on three things only. What's my position now cos I don't want to pay £450 repairs on a £250 car?? Anybody help?? Thanks Chica
