  1. I sent the SAR letter first class recorded on the 14th March but it's still showing as undelivered on Royal Mail website. It had a postal order inside. What do I do now?
  2. Fill out your charges on the spreadsheet available.This will calculate your interest. So to summarise: Charges = Total of charges Interest charged = is any interest they have imposed ewhilst you were overdrawn Daily rate = charges plus interest * 0.00022(i think off the top of my head) Other interest is the 8% malarky. Its all in the templates section. I would also advise posting all further info on this one thread and then everyone can follow your progress easily and offered advice when needed. Chica
  3. Well after my success first time round, I'm now claiming back from September till now. Another £500 quid. I've sent prelim and LBA and here is the reply: Thank you for your letter about the charges on your account. I have now carried out a full investigation on your behalf. I'm sorry you are unhappy with the charges and I understand you would like these refunded. I can confirm the charges were applied correctly, as you had insufficent available funds at the time. As we have previously refunded charges as a gesture of goodwill, I am unable to agree to refund any further. I appreciate your feelings on this matter but we are satisfied that the charges do not contravene the Unfair terms in Consumer Contracts Regulations 1999 or common law. We also comply with the OFT, in dealing fairly and openly with our customers. The OFT annoucement was in realtion to Credit Card default charges and not overdraft default charges or other products, such as Bank Accounts. This means our Tariff of Charges continues to apply. When opening your account you were provided with information detailing the T&C's. W ehave also sent you regular updates and Tariff of Charges, which details the amounts of our charges. I have enclosed a further copy for you. To avoid further charges, please ensure there is enough money in your account to cover direct debits and other payments made. I would also recommend checking youtr balance regularly. You have asked Abbey to provide a breakdown of how our charges are apportioned. Abbey are not obliged to provide the specific information you have asked for. Our charges are not out of line with other financial institutions within the UK and are outlined in the T&C's of your account. Please be assured I have carried out a full investigation for you and I hope you feel I have offered a considered and complete response to all of the issues you've raised. I will keep your file open for 8 weeks and if I don't hear from you within that time, I will assumed everything is resloved and will close your file. If you remain dissatisfied though, the leaflet you'll find within this letter explains your rights and how to take your complaint further. If you remain unhappy with the response form the Complaints Department, you have an ultimate right to refer your complaint to the Financial Ombudsman Service.   7. Thanks. My sister says she can't find her numbers as she has cut up her cards so I was thinking if I add in a line saying for example, and any information relating to other accounts with yourself, Will that do do you think?

  12. Yep just the bog standard "you have took my money I want it back" and with it being sent to a debt collectors I thought it would have been hard work!!!

    Chica v's Egg!!

    I'm just about to start on my claim for Egg among others after successfully winning against Abbey and First Direct. Going to send DPA Subject Request on Monday. I owe them £18275.91!!! I'm not expecting all that back obviously but some of it would be great!! I'll keep you updated.
  17. Am now more confident in what I'm doing even so far as helping friends and family do their claims, so I'm submitting court claim on Monday...or do you think I need to send LBA again?

  19. Hi all After being succesfull with my claim against the Abbey I'm now helping friends and family etc get their money back!!! Is the SAR the same for store cards as it is for banks? Or do I need to change the wording slighty? Much appreciated!!1 Chica
  20. I hope you do well Elky. One thing I would say is to sign your witness statement when it gets to court time!!! I didn't and the judge rejected it but Abbey payed up anyway!!!

  23. I did send the LBA but back in July 2006. Does this make a difference? Am I best sending another LBA?
