  1. this is years later just logged in the forum again and have seen this post. just to update those who might be curious. at the time i rang the council and told them it to either auction off the car or get the clamp removed as the bailiff was acting on their behalf. as i had cleared the debt with them could they kindly advise me why the car was still clamped, the lady mumbled and i spoke to her supervisior. next day recieved a call from the bailiff wanting to talk i.e (he wanted me to cover some of his expenses) the fees had gone down drastically . That had to be the best moment of my life. i obviously refused out of principal. told him to use his bailiff powers he had threatened me with to get his money. He came next day and was forced to unclamp by the council without me paying any fees (result). word of advise to everyone else Pay your council tax on time it's a priority bill. if for any reason you can't don't ever open your door when you get a letter that the bailiff is coming round. infact don't open your door to anyone you don't know
  2. I've sent the bailiffs and council an email and am now just going to wait and see what the response is in the morning. Hope they don't bloody take my HP Van.
  3. Yes he is certified i have checked on the register. the company name is jacobs . i have faxed and sent a registered copy to there company and they have confirmed recipet of this n they have also acknowledged receipt of the letter. They stated they are going to try and talk to finance company for permission to sell. I have checked with the finance company and they have confirmed no one has contacted them. When i rang them this afternoon their office and explained what finance company had said they stated that they would keep the clamp on indefinately until they recieved payment. is this legal???
  4. When they levied the council had told them the bill was about 900 odd quid. when i spoke to council the corrected the issue and opened a new acc which ihave kept up with. plus what will happen if i don't pay as intend to take the issue further to the courts so a judge or someone indepent can review this??? how long can they keep my car clamped??? i have been looking at the forumns for days now. boy i wish i had found this website b4 all this. yes the bailiffs have sent me a copy of the dates, oct 9 visit fee £24.5 walking possession oct 20 2009 £ 12 levy fee october 20th £52 january 13 waiting £60, jan 13 attendence / van £100
  5. i have written to the bailiffs office to complain and they have mainly fobbed me off. saying i signed a walking possession so the they would contact finance company to ask if they can sell car . is this walking possession paper valid if the car is on finance? spoke to the bailiffs office and they were very evasive but did however state nthe clamp would would be staying on until i paid them. any ideas anyone???
  6. Hi Everyone i'm a newbie so bear with me. bailiffs attended my property in regards to a council tax bill last year i declined to let them in but he offered for me to sign a peice of paper so he could go away saying he would take my car (on finance) . At time of signing i had no issue with it as i was aware i did actually owe the tax. However upon further analysis of the bill i discovered i was being charged to much by council . so i rang them and they made the corrective adjuments. (i used to live with my girlfriend but we split up and she forwarded the mail to her address , so i never got the bills plus i was entitled to some single resident discount). so when the council had made the necessary updates. anyway bottom line is bailiff money they were asked to collect changed from £900 to £142. counci opened a new account which i have kept up with. so bailiff ended up coming to my house and putting a clamp on my car because i refused to pay him and paid the council direct. they refused payment but you go go around this by using internet. so the council has confirmed that the bill has been cleared but the bailiffs charges are still pending. I rang the council on the 15 they confirmed they had recieved the payment and my balance was clear but bailiffs charges were still pending. so i woke up one morning about to go to work only to find a great big sticker on my car saying "this vehicle has been immobilised and will be removed for auction for non payment of local taxation. The good thing is it's not my car as it is still under finance. Normally i would have been happy to the charges but he is asking for £248.5 for a 142 pound bill. broken down as follows visit 1 24.50 walking possession 12 levy 52 waiting 60 attendance 100 totalling 248.5 Spoke to finance company and they have stated they won't be allowing anyone to remove and sale the car. so car has been there for 6 days. Bailiffs are refusing to remove clamp until i pay them. i did write to the council and bailiffs compnay complaining cause the bailiffs was genuinely rude and dismissive. So my question is what do i need to do to get bailiffs to remove clamp.
