  1. Thats great stuff. So should I now write to the last registered keeper informing him that I am taking legal action, claims court, as his "rep" as sold me an un-roadworthy vehicle that was advertised as been in good working condition? Thnaks for the responses guys!!!
  2. Come to think of it mate, the address he gave me for collection was XXXX Garage on xxx road. The car was parked like in the front of the garage. At the back there were auto macs. Should I also send a letter addressed to XXXX Garage informing them of the car I apparently purchased from "their Garage"? I only got the dudes 1st name unfortunately.
  3. Hi guys, as per title, I purchased a dodgy car. Want to know how I can get around getting my money and if small claims court is worth a shot. Here's my story: Car advertised on gumtree as in "very good working condition". I go and purchase car to find. Take it for a test drive and all seems to be ok. Time to do the deal, look at log book and name of seller is not the one on log book but he tells me his doing it for a friend or wateva. So we shake hands do the deal and I drive off with my green little slip. Now once on the motorway I start burning some rubber to really get those valves to open.Then with our london roads, you know, I get caught up in some serious traffic. Thats when my nightmare all began. The car breaks down for me. Good thing i'd done my insurance and sorted breakdown cover as soon as I did the deal. Towed the car to a garage. The auto mac had a laugh at me. The problems were something else. I'll cut it all short, the car was basically set to drive ok'ish. Run it for 45mins or so all the devils come out. Car was rendered unsafe and not road worthy and not in a good conditon as advertised. I get hold of the guy who sold me the car and gave him the breakdown. We speak and agree that he will refund me some money to get the car sorted. I did get the car for a bargain so with all the costs the mechanic mentioned, it all seemed preety reasonable to follow this root. So the seller tellms me to book the car in and he will sort money out in a day or 2. I have all this evidence in the form of text messages he sent to me using number used to advertise the car. I bet you guesing what happens next?!? Yep, you guessed right, the dude turns his phone off and I havent heard from him. I recently got the log book with the previous owners address. What are my rights here? Is small claims a path to attempt? Thanks in advance for any advise given.

  5. Hi guys. Sorry, back again with this. I got a phone call from Roxburge today( Haven't heard from them in more than 2months) who put me through to some other company of which they say they have bought the debt from Roxburge. I think it is Graham White solicitors. I spoke to a woman who insited, as they do, that I pay this debt or they are taking this to court. I explained that I had asked for information on this account from both 3 and Roxburge and this information has not been given to me. She went on again saying that all that she is seeing on the screen is what I should pay and what the courts will make me pay. I told her I that I still need the info on the account so I know what I am paying towards otherwise I will not pay. She then got all cheeky on me and told me if that's what I am saying then they going to take it to court. Now I had written to 3 to get info on the state of the account when they passed this onto the debt collectors but they were unable to provide this in the required time. They still have my £10 postal order as well. As advised I wrote to the ICO in March with concerns to 3, and have not yet heard a single thing back from them. Is this normal? What should I do about that??? Statue bared for this account will be October this year. (6years) Could someone please elaborate statue bared to me as I am thinking this is possibly my way out of this? My last payment to this account was October 2004. Hope this all makes sense.
  6. Oh, thanks. Yes I did send the "Prove It" to Rox and they did respond. They letter mentions that they have been seconded by HFO to chase and collect the monies due. They put the details of the account of which are different to what I believe to be correct. They mention the Contract start date, Disconnection date, Last amount paid and then says that "The above suggests that the contract was not fulfilled and their terms and conditions not adhered to. They also stated outstanding balance £473,90 charges £10, interest £265,48 Misc charges 17.62, outstanding £767. Then lastly telling me its in my best interst to settle this asap.

I was reading on the ICO page and the part that Istly says Before you complain to us First, tell the organisation concerned and give it an opportunity to put things right. , should I write back to 3G and inform them that I am now making a complaint to the ICO? It is now 42days since I sent out the subject access. The last letter I received from 3G was the one where they stated that I need to contact their Data Protection Officer. They also mention that the accnt was passed over to HFO and that if I have any questions I should contact them. They haven't returned my £10 postal order as yet and I just wrote to royal mail to find out if this has been cashed. So going from here, say 3G is in breach of the subject access I sent them, what happens next? Roxburge now has this account? How does this help my case? Do I write to 3G letting them know that I am complaining to the ICO or do I just do the letter of compliant to ICO? I am a bit all over the place as to where to go from here and what direction I am heading towards. Again, thank you for the help.
  8. Wrote the subject access out to 3G Hutchinson sum 20 days ago, £10 postal order included, They have just written to me today stating that I should write to their Data Protection department. Now, they haven't returned the £10 postal order. When I write to the Data Protection department should I mention that I have already sent the £10 payment to 3 customer services and do I have to do another subject access? Do the 20 days gone by count towards the 40days and if they do should I put this in the letter as-well? Thanks.

  10. I was just reading the SAR and was thinking if it's better sending it to Roxburge as they still will have to provide all the info related to that debt? Orignal signed agreement, and any other info from 3G etc??? Two birds with one stone.
  11. Ok. I will do that now and post it out 1st thing tomorrow morning. Should I in the mean time inform Roxburge of this because they will be in contact very soon? Thanks
  12. Hi, I haven' t sent 3G a SAR. All I have sent is the letter you suggested I send out and that was to Roxburge. http://www.consumerforums.com/resources/templates-library/86-debt-collectors/573-general-debt-letter-if-you-know-nothing-of-the-debt Shoud I do the SAR? And should I send it to 3G or Roxburge? 3G have told me that they sold this onto HFO and all info should be requested from them. HFO have sold this onton Roxburge.
  13. Hi guys. This is the letter I sent out to Roxburge: http://www.consumerforums.com/resources/templates-library/86-debt-collectors/573-general-debt-letter-if-you-know-nothing-of-the-debt I received a reply from them. In the reply they have stated the Contract start date, Contract disconnection date and ( Last amout paid on 07-06-05) together with their Interest charges and original balance. Original balance is what I am disputing. There's really isn't much info I am getting from this reply. They dates of last payment are inconsistent with what I have from the last debt collecting agency I dealt with for this account. Last payment was made to Moorcroft was 19 October 2005 leaving outsatnding balance at £86. Is this the only info they were suppossed to give to me with the letter I sent out and is there another letter I can send out to them requesting detailed info of this debt? This mobile phone contract was taken out instore at a superdrug outlet with 3G hence I believe will be bound to the consumer credit act of 1974. I also just remembered that I had placed a £150 deposit paid with my credit card when I first took the contract out which I am not sure if it was paid back or even added to their final figure. Please advise guys and again thank you for all the help and feed back. Regards Branden
