  1. Hi Everyone, Sent a CCA request to MBNA. Sorry scanner not working at the moment, but would appreciate if with your knowledge of MBNA if this is an enforceable agreement. Received today a copy of : Credit Card Application Form. It is headed Credit Agreement Regulated by the Consumer Credit Act 1974 Down the left hand side of the page are Terms and Conditions 1-3. On the back of this is adverstising " see how much you could save " etc Seperate sheet with remaining terms and conditions, not numbered or headed. At the bottom of the application is my signature but none of the lender. Any advice appreciated. Many thanks

  3. Hi, Thank you in advance for clarification on this point: If a DCA holds more than one account, do you need to send a postal order per account or does one postal order cover all accounts of yours they have? Many Thanks

  5. Hi, Just looking for a general advice - thank you in advance. Now living abroad (EU), trying to get our finances sorted out. Have CCA'd creditors, have a couple of application forms back etc and checking over these, two potentially look dodgy. Creditors at this stage do not as yet have our new address ( all mail forwarded from old Uk address by Royal Mail) - should we give them this? Just a bit concerned if any of them ever took us to court using our old address that we would not be able to have this set aside if they had not been given our new address abroad? Thank you in adavnce for any advice.

  8. Thanks, sorry if my posting was a bit confusing, what I meant was: 12 working days as the banks and many businesses state them mon-fri and not including weekends or 12 days - all days including weekends? Regards
  9. Hi, Just looking for some confirmation please if posible. Last week I sent off 5 CCA Requests, could someone please confirm if the response time for the creditors is: 12 working days plus 2 days for posting, or 12 days plus two for posting, and does the countdown date start from my day of posting or the next day? Sorry for asking a question which has probably been answered many times, but I am just a bit confused. Thanks in advance. Regards

  11. Hi, I'm sure this has been discussed many times, however would be grateful if someone could confirm the process for a Scottish resident requesting CCA information. If you could confirm the steps, timescales for the creditor to respond etc and any templates that I can use it would be very much appreciated. It is all very confusing and need some guidance. Thank you in advance.
  12. Thanks again cerberusalert Based on your information above it would seem that it is a safer option that here creditors now know that she is abroad. On that basis ok to go ahead and give her home address abroad to keep communication open? Sorry for all the questions, but all the input is very much appreciated. Regards

  14. Hi hoping you can help, My parents now live overseas ( almost two years) , last week I received a very panicked phone call from my Father. They own a house in the country where they live ( EU) and my mother has just dropped a bombshell that for the last three years she has been in a DMP to pay of large unsecured personal debts (which she is committed to paying and will continue to pay as she works in the country she now lives in) of which my Father knew nothing about.....he was initially very angry that she hadn't told him, but now they are worrying together. They do not have internet access therefore I said I would try and find out a bit for them, and I have to say that this site is a godsend - thank you. After going through many posts of others in a similar position could someone please confirm that my findings are correct, I can then hopefully get some positive information to them. 1. She has no court orders against her - now that she has no UK address this will be impossible to get, therefore no EEO? 2. I have read about a EPO - if any of her creditors tried this route she should contest amounts/ agreement etc and it then goes back to the country of origin ( UK) and without a UK address the creditor would be back to sqaure one? 3. As she has no UK address any bankruptcy order would only have effect if she ever returned to the UK? 4. If any of her debts were sold to local agents, although I have read that recovery procedures would be then under the law of that country they would first have to prove what steps they had taken to make a UK credit agreement lawful under there own procedures - I imagine this would be very expensive and quite unlikely? 5. As she is currently in a DMP with her mail being redirected ( this is what has brought this to a head as the limit of time of two years redirection is about to expire) would it be safe and sensible for her to give her current address abroad. Sorry for all these questions, but we are all very worried about this, worried that everything my Father has worked for may be taken away from them. Many Thanks to anyone who can help. Regards
