  2. Hello, Been a while! I'm trying to arrange a PPI refund on my load with GE Money. I've sent them a form detailing my complaint - and they've come back to me today, saying- They've looked into my unfair PPI claim They've looked into the commission paid to by the insurer to the lender. They're not going to uphold my complaint, because, according to the copy of the agreement shown - the loan was dealt with by a broker 'The Personal Loan Express' it was taken out in September 2003. all the boxes were typed in, and all the boxes ticked for insurance. I recall this was all done over the phone, and they told me to sign the forms and send them back, and because of the type of loan it was, i would have to pay PPI. they're not upholding it because - it's not their problem - The Personal Loan Express. have gone out of business. i can't go to the FOS because it falls out of their remit because the ICOB 'Insurance conduct of business' wasn't started until 2005 They've reviewed my account in connection to the relationship between me and GE Money, in respect of the loan agreement being unfair under s104a of the CCA because of undisclosed commission paid by the insurer to the lender/broker. They're not upholding that either - apparently s104a of the act doesn't apply to the loan agreement, because the loan agreement was entered into before April 2007, and redeemed prior to April 2008. This also falls out of the FOS jurisdiction. They've suggested i approach the FLA, closed my complaint and told me politely not to bother contacting them again. Somehow, even after the length of time - i feel a little short-changed (pardon the pun) It's almost like they're saying 'Yes we knew you had PPI, you can't claim because the firms gone bust, and plus too much time has passed.' I've got a copy of the letter which i'm happy to redact and post, as well as the one page of the agreement. Any advice, would be very grateful Cheers Dman

  4. Thanks Shadow, it sounds to me that i've been fobbed off. I've got to go to Barclaycard and ask now, spend another £11.50 on a p/o and another 40 days of my life!! bit annoyed actually, especially as they've said "our records show that this account was retained by Barclaycard and therefore you will need to contact them................" and that's it, thank you Monument for spending a further 30 seconds of this unique customer service experience actually providing me with an address!! anyway!! the 0800 917 number keeps popping up, ringing my mobile at all times of the day, i don't answer, and only a keyboard monkey called "Jason" has left a personal business call answerphone message. Out of interest, does anyone have Barclaycard Customer Services details? when i eventually get a respone i'll let you know
  5. well, just got a letter from Monumnet telling me, 'my account is no longer owned by monument, as in July 2007, Barclaycard sold a percentage of the Monument VISA portfolio to ComuCredit UK. The remaining percentage of Monument VISA accounts, were retained by Barclaycard and therefore you will need to contact them directly' they seny my P/O back and included my original letter. What next? suppose i gotta contact Barclaycard? or am i being fobbed off! need some guidance!
  6. i've clean forgotten how long to wait for the SAR to come back? I posted on the 10th of Feb (proof of postage kept) recorded delivery. Nothing's come back yet, not even a "thanks, but we're going to stall for a bit" letter !
  7. yeah i claimed for past charges on this card, got about £600 approx. just before christmas
  8. i've already had a succesful claim from Barclaycard for Credit Card Charges (only late fees, over limit fees etc.) but not PPI, i think i will drop them a SAR and see what comes up, i think i'm be good for a PPI claim, but i'll see what happens!!
  9. well, i've received a reply from cabot with a badly photocopied 'reply card' that i don't remember filling in, but it's my handwriting and signature on there (it also says my salary at the time was £32,000!! trust me, if i was earning that i wouldn't have needed monument!!) and they also sent me the loo roll of all the T & C's from Monument, in fact they sent me the T&C's for the platinum card as well as the 'classic' and also two pages of printout (it looks like payment made by me to cabot not Monument) what do you want me to post up first? all of it or just bits that are important? you can also see on the printout that they sat on the debt from 2005 until 2008 (when i still lived at the address they had) and they've lumped on £1222.64 in PENIN interest transaction

Hello, the above company sent a letter to me the other day inviting me to 'pay the full outstanding balance now if you can' i think it relates to finance for a PC from Dell, but i think it is statute barred as i bought the PC just before i split up from my first wife (well i've been with my current wife for 5 years) so i can safely say, 6 years have passed. I just need to confirm whether i can just ignore this, or send them a 'prove it' letter or SAR Dell? to find out if it is SB? (if i need to send a prove it letter can you point in the direction of where it's kept plz ) Thank u
  11. thanks, i can't remember the last time i got a statement and i also received a letter from them today, stating that they have approached the original lender for the documents and they have returned my p/o. so i'm waiting for Monument to come up empty or come up with a toilet rolls worth of a credit agreement!!

Thanks for responses! and a good point dx about the 8%, i'll look into that, also jimbo, i'm attempting to get bank details of cr@pbot, in order to set up a s/o, actually what i'm waiting on is them to mess up on the CCA i've asked them for, but at least Natwest are chasing them about the indemnity! and no phone calls from them!!
  13. £616.00 into my account this morning, then the phone rang this afternoon!! got 'em on the run! and i bet they can't find a DD signed by me to prove to the bank!! now just got to wait for the response to the CCA then i can put the whole thing to bed!
  14. right i'll try again, i think i was speaking to a phone monkey, as he kept putting me on hold, and then he couldn't transfer me to someone who deals with indemnity's when i do get a call back, i'll get this sorted, it has been cancelled, but i will keep a careful eye on my account. i've let them know about these shisters and their antics.
  15. Well, i sorted out an indemnity claim with the bank today, just waiting for it to be confirmed. I've also sent the CCA off today as well. And, i'm going to complain using the links so kindly given to me by Bazooka. I'll keep you posted on the CCA, no doubt, the next step will be putting the account in dispute, although the DD for £88 has just been cancelled (but not by me, hadn't got round to it.) which leads me to believe there about to try increasing my payments again! i'll keep you posted, and as soon as i see it set up i'll cancel it and put in another claim!
  16. thank you caggers.....i thought i found their bank details off an old letter i uncovered, but apparently the sort code is wrong, can someone furnish me with some details? or how would i go about finding out? i'll put in a complaint, and also lodge a complaint with the bank and get some money back on a claim. i'll keep you posted with regards to the CCA. xx
  17. Ah of course, the Direct Debit Gurantee!? i'll get in touch with the bank. On the CCA note, i haven't, and now i'm thinking that perhaps i should, i recently used an outside firm to recover credit card charges from Monument (Barclaycard) with whom the debt is from, and got about £600 back, dealt directly with Barclaycard, i think i will CCA them and see what they've got, if anything!   18. Hi, I've just had a nose round Cabot's site, and checked my payment history and noticed in July my payments increased from £80 to £88, I have received nothing from Cabot. I'm sure they can't do this, can anyone offer me any advice? i first agreed to pay £70 a month for a Monument Credit Card, way back in 2008 (01/09/2008 - first payment) then about three months after that, they phoned me and kept on and on, pushing me to up my payments which i did, then in July 2010 they up'ed it again this time with no call or anything....and certainly without my permission. What's my next move, to whom should i report them to? is it worth contacting them? i've got to do something as i recently lost my job (i found other employment quickly but have had to take a drastic pay cut) Any advice gratefully received.
  19. well, it's been 10 days since i was dismissed (they said i was dismissed but they've given me a month's noitce and put me on `Garden leave' and they're paying me until the end of December) one thing though, i haven't actually received any notification of the decision and they haven't asked for any uniform back, don't why there is a delay, i'm wondering if i'm going to get this before my appeal, as it also contains the minutes for the last bit of the hearing, which i would like to see. And i'm raising a grievance too, i don't care, i've been unfairly treated this last few months, from the office manager shouting and swearing at me (convieniently in private!) to being told to clean out the stationary cupboard (more than once, when i was the only one of my team on duty) to finding a dead body in a McDonalds toilet cubilce, whilst on duty and not being offered any support afterwards! (none of this is in my contract) you might think some of these are superficial, BUT, i work on the street, i , or my team have no reason to use, store, dirty up the stationary cupboard. There has also been several incidents of a member of my team, harassing a member of staff in a shop, her complaint was `swept under the carpet' then a few months ago he assualts a member of the public, on duty , in uniform, with the office manager present, and gets arrested, spends some time in custody, although the police take no further action, he is not disciplined for the `physical assault' or `fighting', which feature clearly as gross misconduct in the HR policies, not even for `bringing the company into disripute', he was back to work in a week?!? where's the consistency and fairness and proportion?

  21. well they dismissed me.....not for GM....but a misconduct charge......but cos i already had a final written...they'd have got me some how....they've wanted me out for ages...gonna appeal and raise a grievance...i think the findings and sanctions were unfair.....and i think the disciplinary procedure was not used correctly...and there was an uneccasarily protracted time between complaint and diciplinary hearing..and for my boss to highlight to me the seriousness of the complaint why wait nearly 4 weeks for the hearing...his reasons for the delay....'to allow us time to contact our HR people'......'to allow a disc bundle to be put together..(there were 3 pages to it?!)'.......'other business issues..(i.e....they needed my help at the town xmas light switch on..where nearly 20,000 people attended)..which i think is irrelevant! if it was that serious...deal with it ASAP!!........i'm looking at taking legal action too....please.....someone tell me if it's a lost cause....(to claim UD...not neccasarily CD)

Thanks SAR, To clairfy, ignore the bit about the chunk missing form the HR policies folder, although there is a chunk missing, they sent me the procedures thorugh with the invitation to the disc hearing. In view of my point regarding consistency, my colleague found himself in a position where he went 'over the top' when dealing with an aggresive member of the public, and ended up punching this man 3 or 4 times, instead of trying to de-escalating the situation or retreating, he had a fist fight in the middle of the street on a saturday, with his line manager present, and a PCSO. My colleague was arrested for the assault (think the initial was for 'affray') after a few hours in custody no further action was taken by the police, he was suspended, whilst the company investigated. he was eventually allowed back to work, nothing occured under the disciplinary process, i don't think this is fair as there are clearly two actions here that constitute gross misconduct as per our Policy - 'Physical violence including fighting and assault on another person, AND, because he was on duty in full uniform - 'bringing the company into disrepute.' I use one swear word, in a private conversation, was overheard, apologised there and then, and they're trying to throw the book at me!! no,no,no.....i don't think that's "promoting fairness and consistency in the treatment of individuals.!"

Thanks for the input, i'm not going to go off sick, i've given three and half years to this job, went above and beyond the call of duty the other week in trying to save a ladies life in the street, she lay there dying in the street i did CPR for 30 minutes with a paramedic. was very distressing she was 'shocked' by de-fib five times as well....and this is how i get repaid!!! anyway......i admitted it straight away to my CEO and the office manager as i felt because i apologised to the lady at the time of my transgression that it was done and dusted, i've been getting on with my job and then suddenly they hit me with this......the original complaint was made by telephone on the 5th at 1015 and they waited until the 1st Dec at 1pm to do anything about it......my HR policies state the Disc policy and procedure will help to promote fairness and consistency in the treatment of individuals, well i don't think this is fair ....so i intend to raise a greivance as well, i need your advice peeps....... there are circumstances which lead me to believe i have a strong grievance against the company with regard to consistency, and also the fact that the HR procedure relating to Disciplinary has a large chunk missing and i cannot find it on the company computer system, therfore can only refer to a small portion of it.
  24. oh, i forgot to mention, i'm already on a final written warning for an incident in January, so i could really use a hand as my company seem to be looking for ways to get rid of me (or thats how it feels anyway!)
