Hi Can I ask a question I have seen an article'"Loans and credit card cards taken out prior to April 07 may be legally unenforceable therefore may not need to be repaid and can exercise my rights under consumer credit act 1974" Is this correct and if so is there a template to follow. If I have posted in the wrong place I app, and will repost as directed. Thankyou in advance....Desperate
  2. Thanksfor your response its so nice to feel your not alone in all this mess. HSBC called me today to ask for income & expenditure details , they really caught me at a bad time,so I asked the lady for hers. I would not give the details as I hadn't yet seen the reply to my question here. Hopefully I have done the right thing? Now I know I can send the income form back to them I will. Thanks again Annie

  4. Hi hope im posting in the right place? Its not my first contact with this great site but i'm not too good with PC's. With the sites help I had charges refunded.I am now going through the process again and I have posted a preliminary letter and received an income & expenditure form in response, with their standard you new our terms b4 you opened an account with us letter,am i right in thinking I do NOT fill this in but send the LBA letter next? I am on Disability benefits and really struggling and menioned the hardship fact but to no avail.   6. Thanks Elsinore Just found the old paperwork The only time I seem to have sent a "schedule of charges "was with my Letter Before Action. My ignorance at that time must have been blindly obvious to them as i seem to have sent a copy of the charges they sent me!! No wonder they submitted a defence stating " ...claim is insufficiently particularised and is embarrassing". But they paid up in full 10 days later ? I was under a lot of pressure at the time.   7. Thanks H After reading step by step instr.on site do I only need to send Preliminary letter, as I can probably add up the charges on satements since then? If so how can I attach a schedule of charges? ( I can't remember how I did this before) Sorry to sound a bit thick Thanks for your help. Annie

Succesfully claimed bank charges over 4 years with lloyds Feb 07.They FULLY REPAID £3000. wITH ALL YOUR GUYS SITE ADVICE THANKS My question now is they have been taking chargies since then to date can I reclaim from them or am I pushing my luck?   10. wonderful news Lloyds have refunded all my charges!!!!!!!!! Thank you to everyone who listened to my moans and offered advice. I am in a state of shock....best news i have had for years!!!!!!!!!!
  11. Hi everybody I have just been to the cash point (8.pm) to take £20 out of my account and hey presto i could not beleive my balance............. they have refunded all my charges. I spent this weekend ammending my claim and made it ready to send on monday morning. I am in a state of shock!!!!!!!!!!!!! Thanks so much to all of you You would not believe the difference this is going to make to my family and I.
  12. i submitted my claim on line and i was asked for a brief description of my claim.It never asked for any other details so i did not offer any such as the statement of charges lloyds sent me.which lloyds have now mentioned in their defence. All I stated was the following:Knowing what I now know it makes embarrasing reading.And I feel completely ignorant. I am claiming for unfair charges and interest on my account by lloyds bank. i have tried to reason with them to no avail. i have had money taken when i have been in desperate situations my only incoming money was into the bank by way of disability benefit and income support and some weeks left with no credit at all. This has happened week after week for years. They are not interested in me or my situation. I have missed hospital appointments because i have had no money for fares and a lot of weeks without food electricity or gas. Do I have any chance of ammending ?
