Meanwhile, if you post a thread on the debt and bailiff's forum, someone with experienc of dealing with this situation will help you.   4. Hello Prulero, Welcome to CAG. The first thing you should do is thoroughly ead the FAQ section. Then send an SAR letter (template in the library) and request your statements for the past 6 years. While you are waiting for them to be delivered, take time to read arund he site, especially the forum of your own bank The procedure for reclaiming unlawful charges is pretty straightforward as long as you follow the step by step guide, and arm yorself with as much knowledge as you can.   8. Hi Zebra, Firstly, refuse to tlk to them on the phone. Get everything in writing. If you have sent the LBA already then 14 days after that you need to file your court claim, either the N1 at you local county court or the moneyclaim online.   9. Hi Marc, Have you read the FAQ's and step by step instructions? It is worth taking time to read these and some threads on the Halifax forum. What did you claim in the letter you sent on Dec 18th? Was it just a guess? You need your statements first before doing anything, then when you know the exact amount and dates of all the charges you can start your claim. If you have requested your statements using the SAR letter from here and enclosed the £10 fee, Halifax are legally obliged to send you the information within 40 days. While you are waiting for the statements get yourself armed with as much knowledge as you can. If you get things wrong the bank will know you haven't done your homework and will try to find ways out of paying you back. Good luck Nona
  10. Hi Helluva, Welcome to the CAG site. The first letter yu send on here gives the bank 14 days to respond and then you send the LBA. If the bbc letter says the same thing, and your 14 days are up send the LBA. If they offer you a goodwill gesture it will be less than you are claiming. You file a court claim 14 days after the LBA. Above all, stick to your own timetable. Do not be put off by the bank saying they need extra time etc. Meanwhile, as you have realised, read, read, read around the site, especially the FAQ's and as much as you can take in on the bank's forum.   12. Hi Superowls, I sent everything to Trinity Road, but if you ahve sent it to the Leeds office it will be forwarded to the relevant department so don't worry. Good luck with your claim-while waiting for responses from Halifax, read as much as you can on the site. It will give you confidence when you know what to expect form them.   14. Were do i stand? Can i still claim charges if their is a default on the account? Can you claim back phone charges for ringing the bank? Christmas is cancelled in this house thanks to Halifax. Hi Jarroda, I sympathise with your current situation. However 1. yes you can still claim regardless of thre default 2. probably can't claim back phone call charges 3. Nonsense that they can' provide you with statements-they have to. Send them a SAR letter with a payment o f£10 and by law they have to give you all the information they have.   23. Hi Leeroy, The MCOL is fairly straightforward to fill in. Go to the templates library and use the MCOL, Particulars of claim as your basis ofr filling in the form. There sometimes seems to be problems with the MCOL site-just persevere. Space is limited so if you can't fit all your information on you may need the use the N1 form and take it to to your local county court instead. Good Luck Nona
