  1. hi thanks for the info , the solicitor i mentioned charges the same £130 p/h , i was planning to submit the et1 myself but was not sure whether to put on the form to represent myself as would the company see this and think that i have no chance ? i am aware that the company has broken health and safety rules but this might not be relevant to my case i have to look into it more , could i use this in my case ? i am out of work at the momment but i have not signed on as i have been working for an agency , i have exhausted the company appeal procedure , thanks again for the help
  2. hi thanks i thought it might be the case , i did follow the procedures after the incident to stop anything else from happening which they did take into account , i know that the company is very worried about me taking it any further and there serious issues in training that has not been done in the company , whats the rough average costs for a solicitor to put a case together and go to tribunal ? i thought £10 was quite excessive
  3. hi great forum lots of useful info my question is do i have enough of a case to take this to tribunal ? any help or info is greatly appreciated i was working for a big petroleum company for 2 and a half years refuelling aircraft , i started at one airport with my basic training i was then moved to another airport where i had no follow up training by management or a trainer , i was shown the lorries and fuelling equipment by other employees over a couple of weeks , i was there a year in this time i had no appraisels or checks by management or a trainer , i then had an accident while refuelling a light aircraft , which i put the wrong in ( very similar to putting pertrol in a diesel car ) i realised after i had done it and it cost the company $400 to rectify , i did not follow the company procedures at the time due to distraction from the pilot , i admitted this from the start , i was suspended on the day pending an investigation , before the incident i had a completely clear record with no time of sick and no other incidents on my work record , after the investigation i had a disciplinary hearing where by they summarily dismissed me , i appealed on the grounds of my lack of training and new procedures that were not implemented , at the appeal they did not uphold my appeal , i was very disapointed as my union rep said that he thought i had a good case , i want to take this to a tribunal as a colleage i worked with had an incident the end of last year where he did not follow company procedure by way of not walking round his vehicle before driving away , as he drove away he hit a parked vehicle and damaged the the side of the tanker nearly splitting it , if the tanks had split there would of been a fuel spillage and possible fire/ fatality which i feel was similar to my incident in that if the aircraft had taken off there was a possibility it could have stalled and there could of been a fatality , my colleage who had the accident got a 3/4 month writtern warning , is this fair considering i was dismissed , i have a disciplinary descion matrix that the company uses and because i did not intentionaly refuell the aircraft with the wrong fuel it reads that i should have been given a final writtern warning , this was backed up by the manager who held my first disciplinary hearing saying that he knows i did not intentionaly refuel the aircraft with the wrong fuel , i have spoken to a solicitor breifly and she said there is a chance a tribunal would overturn the companies descion ( she does not know about my colleages accident ) but the solicitors want £10k to do a tribunal which is a lot of money , what should i do ? i have been told that the company would not want to go to tribunal as they are multi national and it looks very bad for them to be taken to tribunal , can anyone advise on a cheaper way of going to tribunal , i have no experience in tribunals or employment legal matters , can anyone recommend a decent employment solicitor in the south ? thanks
