  1. Hi there. Not sure if this is the correct forum or not. After falling into hard times my wife's car was finally repossessed. This was sold at auction for a fraction of its value. Fasttrack, the company dealing with this asked my wife to say how much she could pay to settle this. We have recently had a new baby and as such my wife only gets maternity allowance. My wages are not huge. At the weekend we both received letters from Fasttrack saying they were applying for an interim charging order on our house. Can they do this as the debt is in her name and the morgare is in joint names? What do I need to do to stop this from happening? The application will be heard on 21 Nov 2011. Thanks.
  2. Well there's a good question. This is what happened..... I purchased the van from the Citroen dealer and signed the forms in March 06. However, the guy I was dealing with went on the sick and the forms were lost so they faxed through a new agreement for me to sign and fax back to them which I did; this agreement is dated 22/05/06. I don't have an original of the agreement or the T&Cs. Maybe its my stupid fault for not checking this through properly in the first place. What can I do to stop Santander from reprossessing the van. Should I ring them up and dispute the agreement or is it too late for that. If I can stop the repossession that would be good and it would give me time to sort things out. Thanks.
  3. Thanks for the reply. Could it be that the van was bought through my company so it is outside the CCA. But in that case why am I down as the customer and not my company. Doesn't figure. On the van log book the owner is me T/A company. I just don't know about this and not sure what to do next so any and all help appreciated.
  4. Hi there can anyone help. 3 yrs ago I entered a HP agreement with GE Money (now Santander) to purchase a van for my company. The company has gone bust and I am 3 months in arrears. I have had various letters and I have spoken with Santander but I am unable to pay off the arrears as I am out of work. Whats more they keep adding charges on for late payment etc. Last night after 7pm I had 2 repo men knock on my door saying they were going to take the van. After some heated discussions and getting the police involved they left empty handed. This morning I rang Santander and said I thought they needed a court order to take the van as I have paid 3yrs out of 5 so far. I was told they can take the van when they want without a court order as the agreement is "Hire Purchase Agreement for Use Outside the Consumer Credit Act 1974". Does anyone know what this means as I thought all HP agreements were covered by the CCA. Santander have giving me today to try and pay off the arrears then they will inform the repo men again. All help is greatly appreciated. Thanks.
