  1. My credit file shows a £99 pound debt with Phoenix Shop Direct, logged at my ex girlfriends address. I am showing as being associated to that address by postal match only. I will check out the faq on the experian site and see what they suggest. Thanks for the info From everything I can see the debt is in my name, and i've been linked to that address, so surely as far as the DCA's are concerned its being passed around legitimately. However, as mentioned before as I knew NOTHING about this debt until the DCA's came knocking, I despair at the thought of being able to do nothing except wait for it to drop off my credit file
  2. Hi all, Quick update on this. As expected I received a letter this morning from Mackenzie Hall telling me they are no longer dealing with the account and have passed it back to their clients. Whats the next best step from this point. I've sent a similar letter to the last DCA that contacted me regarding this and had the same response. The debt has obviously been sold/passed on to Mackenzie Hall since this. Ideally I want the debt wiping from my credit report and for these DCA's to stop hassling me every few months!! Cheers!
  3. Hi all, I had a letter through the post last year from a DCA informing me I owed £99 for a catalogue account in my name. I wrongly phoned them up to explain that I knew nothing of the debt and what I could do in order to resolve the situation. They gave me the details of when the account was opened and when it defaulted and asked me to provide bank statements etc to prove I wasn't at the address when the account was opened. I did this along with asking for a copy of the CCA. I was then told by letter that the particular DCA wasn't dealing with the account anymore. The account was opened at my ex-girlfriends address. Although I stayed there from time to time, I never resided at this address. Im as certain as I can be that my ex has opened this account in my name. After getting hold of my credit report online recently, there also seems to be one other account open in my name that I have no knowledge of. This one hasn't been 'traced' back to me yet, but I'm interested in finding out what my next steps should be in this matter. I've spoken to callcredit regarding this and they've advised me to send information to the DCA, and that speaking to the police regarding a fraud would be up to me. Last week, I had another letter regarding the above debt, and have now sent the same CCA request letter off to them to see what they come back with. As I said above, I would love any advice people could give me on what I should do, as this debt seems to be getting sold from one DCA to the next, and I want these fraudulent accounts removing from my credit file!!   4. I made the mistake of calling them, but I haven't signed the letter!! It was interesting that the guy on the phone said that a CCA request would mean they could send me a copy of the CCA and all the other paperwork they had.... Guess they have nothing better to do than to waste my time and their own eh??
  5. Yeah its on my credit file. I paid to have a look at it online after the first letter came through. The account defaulted in June 06. I believe the debt was taken out in my name by my ex. I have a sneaking suspicion that she may have passed my details on to the DCA once the letters started coming through her door.It's showing on both Equifax and Callcredit reports.
  6. Im pretty certain they won't be able to provide me with a copy of the CCA. The previous lot just sent me a letter back along with the payment telling me they were no longer dealing with the account. What is the next step once they tell me they can't provide a copy of the CCA? From what I can see now this debt is being sold from one bunch of low lives to the next, and I would like it wiped off my credit file!! Cheers!

I've basically sent the same letter that I sent to the previous DCA asking for a copy of the CCA, however the bod on the phone told me to put the title subject access request and to enclose £1. Im not too hot on the whats what in terms of CCA's subject access etc. They did tell me on the phone that the account was opened in June 05 and defaulted a year after that in June 06. I've read on the internet that it may be unenforcable due to the account being opened before 2006.
  8. Hi all, Just signed up to this forum as there seems to be a lot of information on here, and I could do with some advice on a problem with the above. I had a letter arrive last year from a different collection agency regarding an alleged debt. I spoke to them on the phone (rightly or wrongly!) and it was in relation to an ex girlfriends address. The ex in question screwed me for quite a few quid when we split up and like a fool I paid the debts off as they were in my name. However this is a debt from a catalogue company and I had no knowledge of it. The previous collection agency received a subject access request letter from me and sent me back my pound along with a letter saying they were no longer dealing with the debt. I had a letter come through from Mackenzie Hall the other day in reference to an alleged debt that is in my name. After speaking to them they have asked that I send them a subject access letter as they have the original credit agreement. I am now in the process of sending the letter to them and seeing what they come back with. Im getting tired of dealing with this problem as it has been dragging on forever, and I want to get shot of this debt once and for all. I've tried looking about on the internet for information regarding situations like this, but havent found a situation too similar to mine! Is there any way I can conclusively prove that this debt was taken out in my name, against my knowledge? Can I go down the road of reporting my ex to the police for fraud? I now have access to my credit file and have found that I am only matched to the address where this debt was taken out by postal address... does this count for anything? Sorry for all the questions! Thanks in advance for any help
