  1. Any chance of you copying it onto here so that we can get a giggle from the letter/email you sent? I've just had a reply from GMAC via Paratus today, where they are saying they forwarded a cheque in 2010 for redress of just under £400 to the address of the house that I sold - should know I haven't lived there for 5 years now, and apparently the cheque was cashed!!! They're saying that they only have to refund for charges for non payment by DD, which I believe is garbage, as the FSA stated that charges not reflective of actual admin costs were unfair/illegal, which includes the £50 arrears charges every month. Going to send them a letter back advising about the wrongly addressed cheque (I certainly didn't get it!) and telling them not to bother replying, just wait for the summons as I'd always intended this to go to court as it's the only way to get a forced breakdown from them. I work regularly in a court setting, so I'm not intimidated by it at all. Bit of a pain having to do it, but it'll be worth it, I think, at the end of the day.
  2. I don't know of any template letters, Woodwa, sorry. I just wanted to ask, are you claiming restitution in the form of compound interest? And how did you go about working out the rate, if you are?
  3. Hi, I'm in the process of looking at my charges with a view to pursuing my old mortgage company to get them back. This sounds like a scare tactic to me - they can only claim litigation costs if it's found they haven't done anything wrong, can't they? Can you amend your action against them to add your own costs?
  4. When I reclaimed my PPI, they did this to me too - not bos, another company. I think they will just try anything to pay you as little as possible, don't panic! I wrote to them, advising that they hadn't paid me in full, and giving information on what I had received from them, the amount I should have received from them, and the difference still owed. I got back - very quickly - a letter containing a cheque for the outstanding amount and "a sincere apology" for their "genuine error" - since when do these people make errors lol! Be firm. If you have written confirmation of the amount agreed on, they'll have to pay it. Just write a letter to them, as other posters have advised, and you'll get the shortfall, probably with an excuse of them having made an "error". They've no honesty or integrity. That's about the size of it! Good luck.

  6. Brilliant news! Why are they still allowed to hide by paying though? Obviously they have illegal/unfair practises if they are unwilling to be investigated fully in court.
  7. In that first segment, one.com is attempting to write off the consumers basic rights. You cannot sign your rights away. You have the right of withdrawal. I believe this is an illegal term in the contract, and doubt it would be enforced. A contract must be agreed to by both parties. You have agreed to a one year contract, you did not agree to a second year. It's been discussed to death that contract law states that in a court a company will only be able to claim back any monies that it has been cost by a breach. If you haven't contacted them within 35 days, and these 35 days are days which you haven't paid for, then the 35 days is all that's outstanding, surely? I've cancelled with one.com today - the end of the subscription period for the 1 year is 23rd March 2012, they're saying that I have to pay them until 23rd March 2013. Yeah, good luck with that, one.com! Lol. I'm absolutely digging my heels in; they want me to pay them because I'm NO LONGER using their service? That's ludicrous, and as far as I'm concerned it's theft. Bottom line is, if we let them away with it, they'll keep doing it.
  8. I'm so sorry you've gone through such a horrible experience. The last thing you need is this dreadful company piling on more pressure - and shame on the BAYV rep on this page as well! If you're still on the receiving end of this treatment, try answering the door with a camera in hand, record the whole thing, and put it on youtube so that everyone who knows this bullying creep can see the harassment he's deliberately placing on a family going through such a dreadful time. I'm surprised the police didn't approach him to warn him about harassment - a criminal activity - when you told them about it, he's certainly guilty of it. I hope your daughter recovers fully, and that you can all start putting this behind you. I'd just like to point you in the direction of victim support as well, if you aren't already aware of them. They're a charity set up purely to help victims of crime get assistance they need to help recover after things like this. Take care.

  10. Thanks so much for that update. I feel like the biggest pessimist now that I realised I was assuming the worst because there was no news. GLC is doing amazing work just now, hopefully we'll really start to get somewhere with the dishonest banks. I'll just have to remember from now on: no news is good news!
  11. Hi, S. I just came across this thread. you were incredibly brave! I gasped in shock when I read the post that you had lost the case! Maybe when things pick up speed, more is exposed about the rotten, inhuman practises of these institutions, and more people are pursuing this kind of claim, you could try again.   12. Thanks, B. There are a couple of threads there that I haven't looked through yet, so thanks for that. I've been looking for an actual copy of contract law online so that I can start to plough through it, but no joy as yet. I don't think I'm going to accept the offer though, so that extra information should help me get started, because it's basically from scratch again! Grrr!! Lol! I sold the house in 2007, and paid the mortgage balance, so no, I no longer have an account with them.
  13. Just a little addition to this. I've just remembered that I received a letter from GMAC two days ago, dated 20th November 2009 - an offer of a refund to which the FOS refer to in their letter which I received today.. I was a bit non plussed when I opened it the other day, but it's clear now that the FOS are under the impression that it was sent last year, when the FSA made that decision against them. Tricky, tricky, tricky!
  14. Thanks, Bustthematrix. At the moment, I'm really ticked off, so I'm thinking I'm going to take further action - just have to do even more research now! Bleh! Lol! Just noticed after I'd posted that earlier, they have added interest to the tiny amount they offered, but still been charged God knows how much interest on all of those arrears charges that were added to my balance.
