  1. Any advice would be great, thanks. Sorry it's a bit long. I was swapped from ESA to JSA in February. I didn't realize I had to inform the council that I had a change of circumstances, till a month later, when I got a letter saying my benefit was suspended. I rang and was told to bring proof of benefit, child tax credit etc. I did that straight away but then got a court summons for non payment of that council tax I rang again and was told to make a new claim and to ask for my benefit to be back dated. Went into the council again to sign a declaration, she told me that the DWP should have told them I had a change in benefit and that it shouldn't have gone this far, as she could see I had brought in proof weeks ago. I rung the council tax 3 times and done as I was told. I went back into the council and saw someone else. He said not to worry, it will get sorted. He said it's their fault for being so behind with my claim and it will be sorted soon. He said don't bother going to court as the summons will get cancelled if the benefit gets sorted before the court date I received a letter, telling me I have full council and housing benefit, backdated. Great! Today I have a liability order and a form, asking me for my details, so the £100 can be taken from my benefits! I have just rung up and the lady on the phone said I must fill in the form and return it, and when it's sorted, the money I owe (which I shouldn't, as it is there fault. they were behind processing my claim) will be wiped out! I then pointed out that this was just for court costs, which I should owe. She ummed and said fill it in and wouldn't say if I had to pay it or not. I have been told different things by different people at the council. Do I have to pay the court costs?
  2. Hello again. I don't know how much the loan is for. I couldn't ask him today. I'm trying to think of how to word it. We don't live together. He does stay over, but our finances are seperate. I won't get financially trapped again (been bitten badly before)
  3. I am going to tell him I found the letter. He needs help. The things I have read about this company, well, they sound like they would really take and arm and a leg if they could. He won't be angry with me. He is a decent man. I have read online, if you ask this company to lower the payments, they add charges and you never get out of paying them. You end up paying interest on interest for years! Thank you!
  4. I overheard him on my phone once talking about consolidation. Doesn't sound good does it. We haven't been going out that long, but I love him to bits and he is a lovely man. He must be ashamed to admit how much he owes. He knows I don't like debt. I think if you can't afford it, try and do without, not get a loan for luxuries I mean. He certanily has nothing to show for it. He doesn't have a car or own his own home. Maybe it was debt from a past realationship. I sort of wish I had never seen it. He'll think I'm a right nosy mare
  5. I have found out my boyfriend has a loan with them and is paying £300 a month. I feel bad becuase he left a letter in my bedroom by mistake and I looked at it I feel awful for looking, but am very worried about how he is managing to pay off such a big amount and how long is the loan for If I ask him about it, he will know I looked at the letter. But, I am worried about the debt he is in. Our finances are seperate, so I am not worried about any possible affect on me. I want to help him if he is in trouble, maybe look on the net or go to the cab to look at the loan terms. Any ideas how big a mess he is in? Thanks for any replies
  6. Hello again. I haven't used Kays for at least 3 years. I have the form (thank you anyway) and will fill in my income and outgoings and see what the court says. Will let you know how it goes. Thank you all again.
  7. The debt is for a catalogue (Kays) A couple of family members ordered things then ran off and left me with the debt. I have sorted out rent, council tax, water, gas and electric debts. They are all being payed off. I am struggling with those, but keeping up repayments. Can they accept a £1 a month? I have nothing spare at the moment (job hunting, but still not going to have a good income for a long time yet)
  8. Hello, back again. Sorry it's taken so long to get back. The court only sent me the claim form to offer reduced payments, not a copy of the judgement. I rang and was told, I DO have a CCJ by default. It was from May 2008 for £250.00 Now they (Brian Carter) want over £700, so what do I do now please. And thank you for helping
  9. I got a letter saying we have issued proceedings in respect of this debt and have obtained judgment against you and the next step is to instruct the county court bailiff to call on you. As soon as the papaers from the court arrive, I'll post what they say.

I rang the court and they are sending me new copies of the court claim details and a form to ask for reduced payments. this is the bit worrying me now! next step is to instruct the county court bailiff to call on you. you will have to pay the bailiff a minimum of 172.00 to stop him taking away your possessions! this is the last chance to reach an agreement. We enclose a pre-warrant payment card you have 10 days to use the card and make a payment should I ring brian carter or write and ask them to give me time to sort things out?   11. To palomino - cheeky beggars! I have a payment card too. but i'm sure a judge would only say I had to pay 1 pound anyway, when it gets sorted. He has done the same, the court order was for 200 but now the letter says 760!
  12. Thank you so much everyone! Yes, i remember it was Northampton court. I'll ring tomorrow and get back on here and let you know what is said. I think it was 2006/7 It said that he wanted 200, but had the right to come back for the rest of the balance later, (but in legal jargon) I want to ignore it again, but you can't live like that can you!
  13. will just add. I haven't agreed to any payment plan with them or had any letters from the court asking for money. And I remeber brain carter tellin me a default judgement had been obtained (?) All this was a couple of eyars ago. I know, I should have got help, but I was unable to leave the house or hardly speak to people at the time.

I was not mentally well at the time and ignored it. They also ring my home and leave a message to contact them. I do remember asking the court to let me apply for a lower payment, as I am on benefits, but I never filled it in. I thought it would go away and now it has come back. The origional court claim was for about 200.00. now they want a lot more. Can I just offer a pound a month? (still on benefits due to my illness) Thank you for any help. The debt was for a catalogue. I stupidly let other people use my name and trusted them that they would pay, but they left and also left me with this and other debts
