  1. Is there a template for asking for the interest to be stopped at all ? I am worried that if I just pay 20 pound they will get heavy handed and turn up on my doorstep. I am going to lose an extra 174 pound due to tax issues so I think I am justified. Should I tell them this figure ?
  2. My next payment is due on 25th April. I pay by Standing Order. If I write to them and tell them I can only afford £20 due to change of circumstances and change the SO then will that be fine. Also I notice I am being charged interest, can I get that stopped at all ?
  3. If I do that what can they do if the do not agree ?
  4. I have never actually sent them an I & E statement. I was advised not to on this board. If I did send when Capquest said they may ask for proof ! Is that allowed. Would I have to include my partners income ? the debt has nothing to do with her ?
  5. They seem to be sending me letters and statements from two locations. I have been paying £120 a month for ages but the last statement states that I am on a £100 pcm agreement. I have also now got to pay some income tax arrears to HMRC which they are collecting via my tax code but it has reduced my income by about £167. Can I use this to ask Capquest to reduce my payments ? Thanks
  6. Just to summarise. I did get the CCA verified I am paying £120 pcm, I have a letter from them dated October 2010 confirmin that I was then paying £100 but it is now £120. The only letter dated in 2009 that HL refer to is the one informing me that they have taken over the loan. As with Citi I have never ignore any letters and always kept in touch.
  7. I have been in agreement with the aboce for a year. This morning I got a letter from HL Legal stating the following; Capquest Debt Recovery has appointed this firm to act in the above matter, following your failure to respond to their letter dated 17 Nov 09. I need to settle in full or provide a satisfactory proposal before 11th Jan otherwise it will go to court. What should I do please ?
  8. So how can I contest the default, do I write to the CRAs explaining what has happened ?
  9. I have posted on the above subject before but now have a question. My loan was with Citifinancial and I got behind. However when I could I paid above the monthly amount. I was constantly in touch via phone with Citi and was told that I was not in default and the arrears would be added to the end of the loan. I then had a letter saying it had been passed to Capquest. It is marked as Defaulted. Am I correct in thinking that before a default is issued you should be sent a letter giving you 28 days to clear the account ? I never received this from Citi. Although I have no proof I certainly would have made contact and tried to resolve the issue before it was defaulted. One other thing that prior to the loan being sold to Capquest, and when I thought I was talking to Citi, a payment I made via debit card showed up as being paid to Capquest. Any advice is welcome.
  10. December 09. There are no entries prior to that and the loan was taken out in 2007 ? I CCA's Capquest on 1/12th and they put the account on hold, they then sent me the paperwork on 24/2/2010 and I have since agreed a payment plan. Every entry on the credit file since 12/2009 is a "D". Is that normal ?
  11. The Credit File shows no history of all the payments I did make to Citi. It starts about 8 mths ago as in default, no history prior to that. I kept in touch all the time and was told that I was no in default.
  12. I have just checked my callcredit rating and have a score of 626, is this bad ? It has some defaults against Capquest. As far as I was concerned this account never defaulted when it was with Citifinancial, I missed some payments, and I now have agreed a repayment plan with Capquest, but the last entry for May 2010 is "Default" even though I paid.
  13. What does affect the credit rating then, would be interested to know. Thanks. I have mobile phone accounts, a a mortgage etc, so should I be OK. Anybody advise on this please. Thanks
