  1. Hello, Well i had my meeting today and pretty much lay my cards on the table. They have agreed that my employment ends today on the grounds of redundancy and i will get my compensation accordingly. However, i have asked for my payment to be enhanced as part of a compromise agreement to avoid ET and they are prepared to negotiate. I know i would get roughly a years salary if i progress to ET but i have said i would be happy to walk away with 6 months tax free. They are coming back to me on Monday with an answer. I have also made them aware i will expose them for mal-practice as there is a lot of 'dodgy dealings' going on in my place of work that i have evidence of. Fingers crossed they will agree to settle and i wont have to appeal or progress to ET. If i need further advice i will post. Thanks to geekay88 for your advice so far

  3. Technically my appeal will be tomorrow as this is only the 2nd time i have met with HR since my initial consultation. Do you think i should outline this in a letter in preperation for tomorrow? Do i need to do it as an appeal or a grievance? Also, i want them to go away and come back to me with a higher figure for payment and i will walk away without going to ET which is why i was going to mention the compromise agreement tomorrow to see what they come back with. I would like to wrap this up as quickly as possible so would prefer not to go to ET as a manager, im aware we the company i work for prefers to settle out of court quite often!
  4. Hello all - i hope someone can give me some advice if possible! I entered into a 30 day consultation period 29 days ago as the company i have worked for for 6 1/2 years have made the decision to make my role redundant. My role was a Team Manager and i had been in that role for just over 5 years. I have been offered another position which is a drop in status where i would be managing a customer as opposed to a team of people. The training commenced for this role on monday and i requested to exercise my right to a 4 week trial period in the role and i/they feel i am unsuitable then my redundancy terms are still on the table provided i issue notice within the agreed timeframe. I requested this in writing and they have not yet given me this however i have a meeting booked in with HR at 10am tomorrow to look at the new T&C's for this role and to discuss the 4 week trial. Anyway, i have today found out that they have brought an external person into the business to start their job as a Team Manager on 02/11/09 in a different department to the one i was on. Other people have been made redundant including another 3 team managers yet they have not offered us the role or advertised internally for the role the external candidate will be starting on 02/11/09. I have spoken to ACAS and they believe that this is now classed as unfair dismissal, can someone please confirm this? Am i right in thinking i can take my redundancy pay (they have offered me 8 wks notice plus 6 weeks tax free) and also take them to tribunal for unfair dismissal? In addition to this, one of the directors had a meeting with me and my old team and made a comment that my key responsibilites were moving into my manager which is why they were making the role redundant. She then went onto say that 'Joe Bloggs has more years on Clare and i hate to say this, is older, and has more operational experience' This was said in front of 5 people and i have taken this as an ageist remark and i now feel that i have been discriminated against because of my age (im 27). Im not sure of the 5 people in question would provide witness statements, however i am going to raise this as i feel i am being discrimintaed against. I think im going to ask for a Compromise agreement in the meeting tomorrow, as its my last day of consultation i am going to tell them that i will be taking them to ET for unfair dismissal as well as taking the redundancy pay. Do you think they would prefer to settle this out of court? Is it likely that i would win additional compensation in ET because they didnt advertise the other role? Any advice on my situation before 10am tomorrow would be great if anyone can help. Thanks in advance
