  1. I am in a similar position. They have replied to my letter asking for detaisl of the overpayment and ignoring all the points i made in it. They have said that i did not submit a detailed claim for 2003 to 2004 and therefore they made the award for April and May 2004 based on the information they did hold and since it turned out to be incorrect I have to repay the money. Sue, you were right, I told them that I lived there until the 29 April and spent the money received on the family thereafter, but it seems to be irrelevant. I still dont know how much money we are talking about, as they did not give the information i aksed for in thier letter. yet they are saying I have to pay it back. I phoned and spoke to a very defensive woman who told me that I have to dispute on the COP26 and thatt i have to liase with my ex, even though our divorce was very bitter and I dont actually know where she is. I really dont know what to put on the form, that I havent already told them. Will I have to pay the full amount, or if I do owe it , should i offer to pay half ? (when and if i find out how much it is!!)
  2. thank you catsue22 for this helpful advice. i have talked to them and got no where at all. So now I have written a letter and hope that someone will respond....I dont know what dates i had conversations with them. it was a lng time agao and i have moved house, thrown away paperwrok since then. When my ex made a claim for income support, wont it have been documented then that she was receiving Child tax credits and therefore no longer entitled to both benefits?
  3. Hello Can anyone help/ shed any light on this please?. I received a call from a debt recovery agency on 10 March this year, saying that they had been authorised to collect overpaymets by the TAx Credit office. It was the first I heard about this so I called the Tax credit helpline. They said that i had been overpaid working tax and child credit in April and May 2004. I had separated from my wife in April 2004 and believe I had told them of this fact, as the May 2004 payment was the last one. I disputed the amoutn they quoted and said that my now ex wife must have been paid some of the money. They said they woudl send me a breakdown of the amoutns and where they were paid, but said that as it was a joint claim they wanted the money from one of both of us. All i then got in the post was a leaflet expalining how I could appeal against the over payment. Icalled again on 15th March saying i needed a breakdown of amoutns. They said they would send it. Instead I got again another leaflet about appealing. I called again on 24th March and was told these things take a long time. Im fed up of ringing them ,yet fully expect another contact from teh debt recovery team or court threats as I have made no attempt to send any money. Not that I want to throw money at them, but I agree I received some money in April and May 2004 even though i was not living at home. This money did go on the family however. My ex also received some money. My ex went on income support for a bit after I left. I have had nothing in writing as to the amoutns they claim were over paid. I cant discuss it with her as I dont know where she is. Should i carry on waiting for the breakdown to be sent; should I do nothing or should I gee them up? any advice appreciated. thank you

I have received a court date and have now been asked to deliver the copes of all ducuments intended to rely on in court. i have been preparing the court bundle so am ok with that. however they also ask for Written witness stements endorsed with a statment of truth". Is this just a rehash of POC and a case summary which should be added and to the Court Bundle, indexed accordingly? ( I didnt say i was going to rely on witness in the initial claim) thanks
  5. I agree in retrospect that it would have been better to have no verbal dialogue with them at all. However I see from the forums that some people have chosen to do so, and others have been called by the bank out of the blue. My query is have those people referred to those conversations as part of their court bundle, and if so how did they do that?.
  6. So now I am preparing my court bundle. Have got my written correspondence with B....together and indexed that , but still not sure how or if I should make reference to their telephone call where they told me to see them in court? Is the fact that there is no written response from them sufficient to speak volumes in itself? Thanks everyone.,

  8. Thsi may be a daft question, but if your claim was served on 20th sep, after you filed on 15th, as per your sig, 14 days after that is 4th oCTOBER, surely, ie today? If they have not acknowledged by then , you can go for it:)
  9. sometimes insurers are waiting for relevant medical reports. Call insurer to check on progress of claim management and if they are still waiting for reports from specialist and GP, call the GP and Spec secretaries involved and inform them of the urgency. Often specialists and GPs leave reports for insurers until they are quiet, and of course they are always busy.Tho there is no obligation on them to complete them, they are paid well for such reports. In terms of time scale, well unfortunately it depends really on your brother's prognosis. There is always a back log and the persistent and polite person usually takes priority.
