  1. sorry forgot i posted on here moving out in 1 month today, basically theres a few things that need doing that i dont overally wanna do unless i have to, yes very detailed inventory that i will be going through, but who has the say about deductions estate agent or LL ? ok fair few marks on walls which i assume is wear and tear, got little hole in one wall that could be filled, few other bits like that, few handles on the windows (3) have broken still work but not full handle, carpets got bit wax on em (could get that off hairdryer?) one wall marked with blu tack (not wear and tear)? lots little bits like this and the house just needs a bloody good dust, hoover and clean, which i will do. Light fixture missing (it broke when changing bulb) Can they take any deposit for these things ?? or similar? and as the LL will not be carryin out any of these things as he no longer owns the house, would he or could he take deposit for this ?? also we have smoked in the house when we shouldnt if they found this out could they take all our deposit ? its just little bits and bobs, but i know what estate agents are like they end up chargin us half our deposit for all these bits ! we have lived there 2 years now and it wasnt in the best condition when we got there but inventory says all this about condition, it probably needed redecorating or at least lick paint years before we moved in.
  2. hey looked around couldnt find my exact situation. My landlord has nearly sold his property i think we are gonna be given our notice within the next week, with this i was wondering if we should be recieve our full deposit back, it should be in a scheme through the estate agent. there are a few things that need doin to the house maybe bit paint and bit filler here and there, but i dont want to do this if the new owners are gonna just knock walls down and redecorate anyway. im willing to scrub and hoover. whats the chances of me receiving a full deposit back ? is it the landlords duty to say about deductions or is it the estate agent ? house was rented with full 11 page inventory. thanks
  3. Im not sure, but an agreement was signed showing amount of money paid as deposit. Dont think T1 would no how to put a claim in. T2 and T3 have new agreement coming to sign. Hes not in arrears other than to T2 and T3 who have foot the bill and was told thats how it is.

Sorry if this is already somewhere on this forum but ive had a good look and not found what i was after. 3 tennants have been renting a house on a 6 month joint short hold tennancy agreement ? this then moved to a rolling contract T1 decided to leave the property 2 weeks ago and did this verbally to the estate agent. He then returned to the property with the police to collect his belongings leaving T2/3 out of pocket as he not payed rent or bills for the last few months and also left 2 weeks before the rent was due again so also would have had to contribute to that month rent. Estate agent agreed that they didnt think that T1 would put his leaving into writing. so agreed that T2/3 if put the situation into writing would remove T1 from the tennancy, T2/3 are waiting for new agreement to be signed (next week) but have put the situation into writing and estate agent agreed that he would be taked off as soon as it was handed in(2 weeks ago) as they believed T1 would never hand sign that or hand his notice in writing, and that T1 wouldnt be entitled to any deposit back. From what i am led to believe T1 thinks he can go to estate agent and ask for his share of deposit back, T2/3 would be very upset if he did recieve it as they are already out of pocket. are t2/3 safe even though new contract hasnt been signed yet?but he should have been removed of current tenancy. if not are they as soon as new tennancy has been signed ? Also can T2/3 take T1 to small claims court despite not knowing where they have gone and also knowing that T1 has bad debt and also not likely to turn up? is it worth it ?
