Yeah you're right wd, we didn't want to be negative after what we'd been through but things didnt seem to be going our way, I just hope there is such a thing as karma and they all get whats coming to them soon.... on a more disappointing note my partner didnt go through with his tribunal claim because he couldnt face another knock back, so he just let it go, i was really sad about that but did understand his decision, we're putting it all behind us and concentrating on the good things = our little boy started walking last week for instance, thats more important, I still have panic attacks when I see a white van in the area but i spose that'll never go away but we've put the car in a relatives name so thats safe and thats the main thing, and partner should be accepting a new job this week which is great news, just got to keep taking the tablets and thinking positive and i should be back to work when we know what days off he'll have... finally some things to look forward to! xxxxxxx

Hi everyone, just wanted to close this thread as so many people helped and supported me through the darkest period of my life.... firstly, sorry to w/d for going completely AWOL, cant access my old email and only just remembered my password for this site,,, so... we got evicted and have been relocated to a lovely but tiny little place, at least its a fresh start of sorts... we lost all our court cases and am now sure we are going to go bankrupt, and this sounds really petulant but mainly for me to make sure no one else gets a penny from us and a big up yours to the bailiffs and that awful greedy landlady. So thanks again to the brilliant self less people on this site, I KNOW i would have cracked up if it had not been for their advice, support and kind words. xxxxxxx

Yeah I hope they come on and see this soon, we have our set aside hearing this friday, now writing up a timeline of events and facts to give to the judge. I need to also know that if the judgement was £3000 (give or take) and the fees are £3000 (give or take) and they sold the car for £3000 (g or t) that the car value will go towards the bailiffs fees first, so in theory although we have a stay of enforcement, we still owe the total judgement to the claimant but with the sale of the car we have paid off the fees? All this will be going to the district judge tomorrow ready for the set aside, so I need to be clear xxxxxxxx

Hi Digitaly, Yes we've suffered some hardships, I know its our own fault, and we should pay what we owe, its the way it is done though, we hid because I didnt know of this forum or indeed our rights at all, and we were led to believe no installments were allowed it was the full amount or they tzake everything we own.... therefore we hid petrified of anyone knocking at our door for months, it was and is awful. When im sorted out I will be making everything public, i have nothing to lose, I'll have a look at your thread, hope you fighting it too xxxxx XXXXX

Hi all, following on from my previous thread.... http://www.consumeractiongroup.co.uk/forum/employment-problems/224712-disciplinary-hearing-next-week.html The boss submitted his response and we recived a copy of it this morning. He is standing by his reasons in all the letters and has his (scared) members of staff to back him up... this is the thing, when we go to the tribunal, it will effectively be my other halfs word against his, is there something he can do; like swear he is telling the truth to a solicitor or have a statement made up to that effect? Also, there are at least a dozen or so former employees of this hotel that have been mistreated and would stand up and say that, and sort of give an idea to this mans real personality, as could associates, suppliers etc.... but could we do it and would it be seen to be relevant? And could we also contact my other halfs former employers to give a reference as such, to prove his (genuine) integrity? I know each and every person my other half has ever worked for would only speak VERY highly of him.... Sorry if I'm not articulating this as well as I could, its been a hard week HH xxxxxx

Yes, interesting website that.... They charge the client just £60 for enforcing a ccj, and you can expect 3 visits and a report if unsuccesful for that... no wonder my friendly hce charges so much fees to us... my support worker was astounded at my £3000+ fees and I am desperate for a reply on those breakdowns, which HCE himself stated were high.... and then didn't comment anymore... strange that....

Hi Debtweary, I really sympathise with you, it's so frustrating to get that far and have them mess you about, If you have a statement showing you have paid the ccj, and the bailiffs only legal fees are around the £42.00 mark I've seen for 2 visits, can you not just send a cheque for that amount with a letter quoting from the Act that stated those fees, and make it very clear you know your rights and will pursue them in the county court and report to police for fraud? I've seen that info somewhere, some of it is on my Thread, Obviously I am not an expert, I'm still fighting my own case... but that is what I would do in your position, how can sherforce enforce a judgement that doesn't exist??? Hiya, Just wanted to say Hi! and I'm sure someone more knowldegable than me will be along to help you soon, while you wait have a read of any similar posts you can find on clamping. I suspect the bailiffs will want payment of their "fees" before they unclamp but if it was an unlawful clamping anyway due to the fact the car is on finance, there might be a way around it, XX

And, nice and quickly just got this response from said Mr C (HCEO, Operations Director) "We acknowledge your email and not the content therein. This matter has been passed for my attention I shall review the documents you have attached and respond accordingly in due course. Yours faithfully xxxxx xxxxxxxx" Hmmmmm....... I think he meant "note" not "not" X

Just found a number for them and got through to the "operations team". Told her I needed an email response confirming receipt of the email including the scan of the order and the letters sent as attachments before 5pm.... Just got this - "We confirm we have received your email dated 26 January 2010 together with attachments."This matter is currently being dealt with by Mr C***** who will respond under separate cover." I also had her confirm which address I should send my recorded delivery letter to.... and got her name..... xxxxxx

Only a badly spelt automated reply recieved "Thank you for your email, this will been passed to our Operations Team who will reply accordingly. ", so just called friendly bailiff again, told him i need him to nudge his office again to reply they have received my emails before 5pm today, He said he will do his best..... Funny how I had a nice flow of convo going, then we mention the car and fees and it goes all quiet.... loving the grammar mistake on the automated response... done in a hurry was it, do you think? xxxx
