  3. Not sure how the Courts see that. I would suggest that you gave them ample opportunity to settle before you issued Court claim and 8% interest is now required. Just write back and tell them that if they settle the full amount you would be prepared to write to the Court until then you would not consider the claim as settled
  4. If it's close to judgement by default I would not call. (You might sound deserate ) If you call and they acknowledge they then have a further 28 days, which would make it much longer. I know the waiting is nail biting. My case was only issued yesterday and already I check the Moneyclaim site every hour in case it is acknowledged. Patients is a virtue! apparently

  7. I have the same problem. Need to take it to Court. Apparently emailing Rachel Hinchliffe helped some forum members (but not me) Because I have to physically go to the Court it will have to wait a few days. You can send LBA for failed DPA anyway if you haven't already.

  9. Well surprise no statements. Got all excited on Saturday when the postman brought a big bundle but it turned out to be Amex. Has anyone actually submitted a N1 for DPA and how did it go?
  10. Moneyclaim sent. £3005 + £428 at 8% plus £120 Court Costs. Yes I'll send copy to RK with schedule that once the claim is accepted. Think I have to tell a mod that litigation started.! Eek how?

  12. Moneyclaim Hoping someone will confirm what I am doing is correct. I have filled out the MCOL stuff apart from hit send. What about the schedule of charges. I thoguht I read somewhere that is needs to be sent to FD. Who at FD. Anyone can point me at a good FD and MCOL thread. I've read 100s but need help on this last ish bit
  13. I can assure there is no more to it. But I was late on Gold card (by a few days (because I was out of the Country on hols )! not sure if that makes a difference. I suspect it is because I had £10,000 interest free balance transfere for life on Blue card and then cut it up and never used it. i.e. £10,000 interest free until it was paid off! They normally expect people to run up bills and then start making a profite. In the 2 years I had it only sent about £40. In late fees on Blue about 135 so not a bigun

Their DRC is even worse. Their administration is crap and the file notes show both Amex and DRC don't know their A*se from elbow.

After sending letter back to Debera Malins suggesting if they needed to escalate the claim to RK then they needed to do it as I had already address letters to Customer Relations Manager (which is RK job title - Derrr) Anyway got a nice standard letter from RK Saturday morning. Ombudsman blar blar blar. Just completing interest calculation for Sec 69 bit on Money claim. Just to check! I need to send copy of schedule of charges to FD (again) when I make Moneyclaim. I take it they don't need a copy? But I must advise I have sent it? how. Thought Moneyclaim would be easiest route but not so sure now.
  16. Oh I think it is going to be a long one. Hope you don't fall asleep reading this thread. Well interesting developments with Amex. After letter from them confirming no default notice was issued I wrote asking for it to be removed and as it was confirmed by them in a letter that no default was actually issued I sent it to credit reference agencies. I suggested as they now knew that the information on their files was not correct they had a duty under the Data Protection Act to remove it. I'll have to wait and see on that one. Now received my DPA statements and written notes, which make interesting reading. The cr*p debt recovery agent "Newman and Co" that Amex used were clearly harrassing me. I now have documentary evidence that they were making around 6-8 calls a day to me at work and threatening to send people to my house. If only then I had known what I know now. Anyway it transpires that I didn't default they just cancelled my accounts because I was late on my Gold card by one day. Cancelled all cards. This is where I need advice.... If they cancelled the cards does the consumer credit act apply after this time? i.e. can they then choose to default me later (although they didn't follow correct procedures). The strange thing is although I took out a loan and settled to the £11,000 plus they asked for they have added interest and my accounts show a debit of £1100 ish. They have never asked for this but continue to create statements with a minimum payment of £35. They have never sent these to me though. The information reads really strange it is almost like I still have an account. They have stopped adding interest though. Can they add it is no longer credit agreement. The copies of letters sent by Newman and Co do not correspond to the amount I owed ! Say £2800. I paid £11000. Anyway I am going to send first request for the £135's worth of late payments charges incurred since I opened my account and see what happens. However as I was defaulted can I add this to my request. But the confusing bit is I was late on Gold card and they default Amex Blue. The Gold card did not have any charges but Blue was £135 and the payment that was later for the Gold card was £150 i.e. most of what they owed me. Hopefully a mod will read this and can advise. I see from other posts Amex ignore letters and requests for refunds. They did reply quite quick to my first default letter so here's hoping.
  17. On the recorded delivery slip that you keep is a track and trace number. got to http://www.Royalmail.co.uk and track and trace. Type in the number and it will tell you when and where. They will even post proof too if you need it.
  18. Ok now 'er indoors is nagging that we will never get our Court fees back. Oh she of little faith. Money claim all filled out read to hit the send button on Tuesday first thing.
  19. Well let me see the owe you £900 and offer less? why would you want less than you are owed. If you go into Tesco's to buy a pint of milk and they say £900 would you pay it! nah of course not. I know it is tempting to accept but if they offered you that there is more to come but you will have to follow it through to the end. If you are not prepared to do this then accept it. Looking at other threads Halifax will go all the way until Court files issued.
  20. The wife rang to say no statements in the post today hey ho. Fired of email to Rachel Hinchliffe and copy letter in the post advising off to Court for failed DPA on Tuesday 1st. Just so happens I am putting in another claim for FD that day so I can kill to birds with one stone.
  21. The OFT really gave the banks something to cling to with this magic £16 figure. Egg is totally automated and don't even send out charges notifications. Cost more like 5p to administer.
  22. I my humble opinion it is from when they received it. If you sent recorded, that is the date royal mail delivered it. If not recorded add a couple of days from the date you sent it.

  24. Your hubby sounds like my wife lol. I am sure once the first one is done you will feel better. Anyway they haven't entered the Court room yet to defend. I can't see any reason why they would risk it with you. Don't be surprised if the actual defence is never entered and you ge the magic phone call or letter offering you loads of doshhhhhhhh
