  1. Hiya Got the expected 'gesture of goodwill' offer from Cobblers. A bit over half the amount I am owed. Below is the rejection letter I want to send. Its been tweaked to allow for the fact that I have already done the MCOL and are at the return of AQ stage. Also tweaked to remove the specific references to the daily interest stuff as it looked complicated and unnecessary. The section about going further back in time removed too, not relevant to me and sounded a bit vague. Any comments before I send? Ta in advance. I first contacted your client regarding their unlawful charges on XX of XXXX 2006 and therefore disagree with your contention that some of these charges fall outside the scope of the Limitations Act 1980. However I am happy to let the court decide on this matter. I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, interest and court fees. I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder. I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim. I am also not prepared to agree to any confidentiality clauses you try to impose, unless of course your client wishes to make an offer of due consideration in addition to the full amount of my claim, in order to be afforded this privilege by myself.   2. Hiya hope someone can help. I issued my Claim On Line on the 31st October and it was allocated to Northampton County Court (not my choice) I live in Nottinghamshire! The claim was acknowledged on the 9th November and I received the Request for Further Information letter and notification of defence from Cobblers on the 1st December. I responded as per advice on this site. I have now received a letter today 7th Dec from HMCS County Court Bulk Centre telling me that they want to transfer the claim to my local court (something I have not requested) and say they want another £100 to be paid to that local court IF my claim is over £1500. Although, the letter is badly punctuated and written so I can't tell whether that is actually what it means. "You must complete the enclosed allocation questionnaire on or before the on 23 December 2006 and return it, where the claim is over £1500, the court fee of £100 to [my local] County Court". This is exactly as the text appears in the letter. My claim in total including MCOL fees is just over £1440. Didn't expect it to get to this stage but I aint stopping now.   3. Hi All I received a reply from Carol Jones on the 3rd September offering me a 'partial' refund. After looking over Warms' reply and Bobinramsey's responses I can't help feeling that Warms' is closest to the best response required. The offer letter say's "as a goodwill gesture and without any admission of liability Barclaycard is prepared to credit your account ........." Surely, saying that you accept the offered amount but will be claiming the rest anyway you have agreed that they do not accept any admission of liability? Clever approach, tempting people with a figure of perhaps half of what they claim. What do you all think? Angela
  4. Hiya I posted my prelim letter on the 21st 1st class and got Mr Higley's letter yesterday 24th! 'NatWest will not be refunding any of the charges' I detailed in my schedule. All charges were lawful and furthermore Stuart is disappointed that I am contemplating legal action against the bank. Signed off with 'Please would I use the bank's registered address for issuing proceedings. Now I've read through the FAQ and lots of postings and I believe the next stage is to wait for my 12th September deadline (initial 14 days) and then do what it says in the prelim template from the library.......
